Abstract

Filsafat merupakan sebuah ilmu pengetahuan yang dinamis dan universal termasuk cakupannya dalam filsafat hukum dan filsafat ilmu. Dan ilmu hukum mempunyai kekuatan menjadi ide dasar dalam perkembangan hukum. Pengembangan filsafat Ilmu Hukum terarah pada upaya untuk menjawab pertanyaan hukum dalam rangka menemukan dan menawarkan alternatif penyelesaian yuridis bagi masalah kemasyarakatan tertentu. Abstract

Permission to practice polygamy can only be granted by the Religious Court if a husband has fulfilled the alternative requirements in accordance with Article 4 paragraph 2 and fulfilled the cumulative requirements of Article 5 paragraph 1 of the Law. No. 1 of 1974. However, in the decision of the Serang Religious Court, decision no. 0602/Pdt.G/2020/PA.Srg., alternative conditions not met; Nevertheless, the judge still granted the polygamy permit. By paying attention to the formulation of the problem that has been mentioned, the aim of this research is to find out the analysis of the judge's considerations in this polygamy permit application case. In this research using normative juridical methods, it was concluded that the judge's consideration in granting permission for polygamy was based on considerations of benefit, namely to avoid adultery, obtain consent from the first wife, and fulfill procedural requirements in the form of written evidence and two witnesses. Even though the alternative conditions are not met in accordance with Article 4 paragraph 2 of Law no. 1 of 1974, but based on maslahah considerations, polygamy is considered an urgent alternative, on the other hand, husbands can be fair to their wives, both from a material and biological perspective.   Keywords: polygamy permit, judge, religious court

Abstract

Inheritance law is the law that regulates the transfer of assets left behind by someone who has died, as well as the consequences for their heirs. That is, in inheritance it is regulated who has the right to inherit, as well as things that cause obstacles to heirs in obtaining inheritance. One of the reasons an heir does not receive an inheritance is murder committed by the heir to the heir. This is based one someone’s intention to speed up obtaining inheritance. This research uses a library study method by taking data sources from books and scientific works, then the author will analyze the data. The aim of this research is to determine the review of qowaid fiqhiyah and islamic law regarding murder which is an obstacle to inheritance rights. The results of this research show that cases of murder which cause someone to be prevented from obtaining an inheritance are still a mistake among madzahib arba’ah and the diffrence lies in intentional and unintentional murder. Murder commited by the heir against the heir can prevent him from getting the inheritance, this is in accordance with the rules of fiqh “whoever  is in a hurry to get something before the time, he may be judged as haram for getting it”. Abstract

Islam protects the marriage bond with various guarantees, while making it a sacred act. Every marriage aims to form a harmonious family. However, in life there are bound to be problems. Likewise, when running a household, there are times when disputes occur between husband and wife. The cause of disputes that arise in the household is a form of disobedience to obligations carried out between husband or wife, this form in Islam is called an act of nusyuz. Meanwhile, shiqaq arises when the husband or wife or both do not carry out the obligations they must carry out. When there is a family conflict. In this research, the author uses a method of interpreting the Al-Qur'an which discusses a particular theme, either in the form of surahs or special topics by collecting and analyzing the content of verses related to the theme. The conclusion in answer to the problem formulation above is that the act of nusyuz is an act that is prohibited by religion, because this is a factor that triggers the collapse of a household, so husbands and wives are required to be able to resolve the problems in their household, including problems regarding nusyuz in order to maintain family welfare. Abstract

Perwalian dalam undang-undang perkawinan Maroko menjadi salah satu isu yang ramai dibahas, disebabkan perwalian menurut anggapan kerajaan dan sebagian masyarakatnya sebuah pengekangan terhadap hak perempuan dalam sebuah pernikahan. Padahal Hukum Islam menetapkan hal tersebut karena adanya mashlahat serta hikmah yang besar bagi perempuan. Hanya beberapa pemikir saja yang menyatakan itu sebagai pengekangan hak, salah satunya orang-orang yang berfaham feminis. Merujuk kepada makna literal alquran serta hadits bahwa pernikahan tidaklah sah kecuali dengan wali. Dalam perundang-undangan Negara Maroko persyaratan wali adalah paraktik yang dianggap mengucilkan hak perempuan, oleh kerenanya mereka memberikan kebebasan perempuan menikahkan dirinya sendiri, dan bahkan mensyaratkan adanya surat kuasa dari pihak mempelai jika wali berkeinginan menikahkan. Abstract

Pernikahan dalam syari’at islam ialah ibadah yang memiliki tujuan yang suci untuk mendapatkan ridho Allah SWT dengan cara membentuk rumah tangga yang membahagiakan, sakinnah, mawaddah dan rahmah. Akan tetapi, tidak sedikit dari pasangan suami istri tidak bisa mempertahankan ikatan suci itu karena seringnya terjadi pertikaian dan pertengkaran yang berujung kepada perpisahan, lebih dari itu suami sampai mengatakan talak tiga sekaligus. Artikel ini menyampaikan pandangan empat madzhab dan madzhab dzahiriyah serta fatwa Majelis Uama Indonesia (MUI) terkait talak tiga sekaligus walaupun hukum positif di Indonesia melarang praktif talak bid’I. Penulis menggunakan kitab fiqh sebagai referensi dalam mengkaji permasalahan ini untuk memanfaatkan studi kepustakaan di dalam peneltian. Tulisan ini menunjukan bagaimana syari’at islam memandang persoalan talak yang didasarkan pada keterangan ayat qur’an dan hadits nabi Muhammad SAW mengenai aturan talak sesuai hukum dan aturan negara yang juga dijelaskan di dalam Kompilasi Hukum Islam (KHI). serta alasan yang dikemukakan sebagai landasan dalam menetukan hukum. Kata Kunci: Implementasi talak, Talak tiga sekaligus, Maqashid Syari’ah.

Abstract

Marriage in Islam regulates the rights and obligations of husband and wife, which are important for the creation of harmony in the household. However, the implementation of these rights and obligations is often influenced by various social, cultural and economic factors, which can have both positive and negative impacts on the husband-wife relationship. This study aims to analyze the rights and obligations of husband and wife from the perspective of the Qur'an and hadith, and identify the social factors that influence their implementation in society. The main research questions are how religious teachings on the rights and obligations of husband and wife are translated into social practices, and what social impacts arise from their application in daily life. This study uses the Library Research method with a qualitative approach, analyzing the texts of the Qur'an, hadith, tafsir, as well as related literature, by connecting the theories of sociology of religion and social justice. The findings of this study indicate that a balanced and fair application of rights and obligations can strengthen the husband-wife relationship and create family harmony. However, an imbalance in the fulfillment of rights and obligations can lead to conflict, inequality and even domestic violence, affecting the overall quality of family life. Thus, this study emphasizes the importance of understanding the social and cultural context in the application of religious teachings to achieve a harmonious and just household.

Abstract

Divorce (talaq) and the iddah period are two very important concepts in Islamic law, with both having a profound impact both theologically and psychologically. The Hadiths governing talaq teach that while divorce is permissible in Islam, it is a step that is hated by Allah and should only be done in very urgent situations, after various attempts to repair the relationship have failed. Likewise, the iddah period, which is obligatory for women who are divorced or whose husbands die, has many wisdoms, including providing an opportunity women to self-reflect and ensure their honor and pregnancy status. This paper aims to analyze the normative theological and psychological dimensions of thalaq and iddah. The normative theological approach discusses the Islamic legal basis for divorce and iddah, the wisdom behind their implementation, and the principles of justice and compassion contained in these teachings. Meanwhile, the psychological approach explores the emotional impact experienced by individuals, including husbands, wives, and children, in the face of divorce. The emotional recovery process required, as well as the importance of social and spiritual support during the iddah period, are also discussed in this article. As such, this article not only provides an understanding of the laws of thalaq and iddah in Islam, but also highlights the importance of emotional and psychological well-being for individuals involved in the divorce process and the iddah period.

Abstract

Joint property disputes following divorce are among the most complex and emotionally charged issues in family law. Mediation has emerged as a preferred alternative dispute resolution (ADR) method, particularly in Muslim-majority societies, where legal processes are often shaped by both state law and Islamic principles. This study aims to systematically evaluate the role of mediators in resolving joint property disputes by conducting a meta-analysis and systematic review based on the PRISMA 2020 methodology. Twenty peer-reviewed studies published between 2018 and 2024 were analyzed from databases such as Scopus, ScienceDirect, PubMed, and Mendeley. The findings indicate that effective mediation is characterized by mediator neutrality, cultural and religious competence, gender sensitivity, and a clear understanding of both legal and ethical frameworks. Mediators who integrate Islamic values such as justice (ʿadl), reconciliation (islāh), and public benefit (maslahah) were more successful in achieving durable and equitable outcomes. However, the study also identifies critical challenges, including inconsistent training standards, gender bias, and institutional gaps in supporting mediation practices. This review concludes that mediation, when professionally implemented and ethically grounded, offers a powerful and contextually relevant tool for promoting fair and sustainable resolutions to joint property disputes in post-divorce settings

Abstract

Polygamy remains one of the most debated and controversial practices in Islamic family law, raising significant questions about justice, gender equality, and family welfare in contemporary Muslim societies. This study seeks to answer the central research question: How is polygamy understood and practiced today in light of Islamic legal principles and what are its social and psychological impacts? To address this question, a systematic review and meta-analysis were conducted using the PRISMA framework, analyzing 45 peer-reviewed studies sourced from Scopus, ScienceDirect, PubMed, and other reputable academic databases. The review focused on the legal interpretations of polygamy, its regulation in various Muslim-majority countries (such as Indonesia, Morocco, and Egypt), and its social and psychological consequences for women and children. The findings reveal that while polygamy is religiously permitted as a legal dispensation (rukhshah), it is heavily conditioned on the requirement of justice (as emphasized in Quran 4:3), which is extremely difficult to achieve in practice. Quantitative evidence shows that women in polygamous marriages report significantly lower marital satisfaction and higher levels of depression and anxiety, while children face greater emotional and behavioral challenges compared to those in monogamous families. Moreover, global trends indicate a decline in the acceptance and practice of polygamy, with many legal systems introducing stricter regulations or discouraging it altogether. Despite these insights, research gaps remain, particularly in understanding the long-term effects on children and the perspectives of men in polygamous marriages. Overall, the study underscores that polygamy, as currently practiced, often contradicts the higher objectives (maqasid) of Islamic law aimed at ensuring justice, compassion, and family well-being, suggesting that monogamy better aligns with contemporary ethical and social realities
