Abstract

In economic activities, the main challenge faced is the problem of business capital. This is often the main reason why someone's business does not experience development or progress. Providing business capital in the form of Bai Bitsaman Ajil (BBA) financing is an effort to support the community in improving their business and welfare. As a result of the research conducted by the author, it can be concluded that the Bai Bitsaman Ajil (BBA) financing procedure that meets the implementation of KJKS BMT Agam Madani Nagari Pakan Sinayan is submitting an application for funding to KJKS BMT Agam Madani Nagari Pakan Sinayan, customer financing application form, completeness of fee administration, after that, KJKS BMT Agam Madani conducted a survey of business premises and residences. After carrying out supervision, a financing board meeting is held, the client will decide whether to obtain financing or not, realize the financing request and finally disburse the financing funds. The factors that influence customer interest in Bai' Bitsaman Ajil (BBA) financing are product factors, service factors, promotional factors and location factors. Of these four factors, it can be seen that many customers are willing to finance Bai Bitsaman Ajil (BBA), which is more dominant due to product factors, because the procedures for financing Bai Bitsaman Ajil (BBA) are easier and faster, do not make things difficult for the community, the requirements are not complicated, financing Bai Bitsaman Ajil (BBA) can be paid in installments and is not too burdensome for customers to pay installments. Bai Bitsaman Ajil (BBA) financing is carried out to avoid usury and the margins are small, there is no guarantee of usage.

Abstract

The primary issue in this research is the refusal of tree owners—whose pine and coconut trees have fallen, damaging neighboring houses and gardens—to provide compensation, leading to financial losses and disputes between the parties involved. This study aims to explore and describe the dispute resolution mechanism for compensation related to residents’ plants that damage others' property rights in Nagari Simarasok, Baso District, Agam Regency. Additionally, it examines the perspective of Islamic law on resolving such disputes.This qualitative, descriptive field research gathered data through interviews with four disputing parties, two Ninik Mamak (customary leaders), and community and religious leaders.The findings reveal that compensation disputes in Nagari Simarasok are resolved through agreements between the parties, facilitated by Ninik Mamak. The process involves deliberation, barundiang or baruumbuak, conducted at the property owner's house. Compensation is calculated by assessing all the damaged plants, and payments are often made in installments.From an Islamic law perspective, the dispute resolution mechanism aligns with peaceful settlement principles (al-sulh), mediation, and arbitration (tahkim). However, in some cases, the method used by Ninik Mamak to calculate compensation—by counting all the plants rather than assessing the actual damage—contradicts Islamic principles. Islamic law emphasizes fair valuation to ensure no party is harmed. Compensation payments should be neither excessive nor insufficient, adhering to the principles of justice and benefit (maslahah).

Abstract

Zakat is one of the Islamic economic instruments. Zakat is a sharia fiscal policy in Indonesia which has a strategic role in supporting the economy (Tinggi et al., 2024). Zakat is also a socio-economic instrument for the community to create social justice values through wealth redistribution, economic empowerment and poverty alleviation. This research aims to explore the low level of public interest in giving zakat and paying zakat through BAZNAS which occurs at BAZNAS Dharmasraya. As qualitative research, this article focuses on investigating an in-depth understanding of the lack of zakat muzakki through the Amil Zakat Institution. Data collection techniques through literature studies and interviews with BAZNAS. The research results show that: (1) The community does not yet have full awareness of zakat due to their still minimal understanding of the obligation to zakat; (2) Motivation to give zakat in society is influenced by their level of welfare because in recent years, the level of welfare in society has decreased due to the Covid-19 pandemic; (3) Zakat is distributed independently, such as assistance with education costs, cash assistance, and assistance in the form of business capital to underprivileged communities.

Abstract

Akhlak dalam kontek modernisasi sudah sangat jarang menjadi pembahasan, karena kesibukan terhadap kemajuan teknologi sehingga manusia merasa tidak butuh lagi bagaimana berhubunggan dengan sesamanya bahkan sampai hubungan dengan tuhan. Seharusnya semakin modren zaman, makin sadar manusia pentingnya akhlak. Karena semua itu bisa mereka temui dengan kekritisannya terhadap dasar segala sesuatu, tapi justru itu yang hilang. Padahal kalau kita cermati akhlak adalah hal yang urgen dalam dalam modernisasi, karena selain sebagai pembentuk ikatan saudara yang telah tercerabut oleh kemajuan teknologi. Akhlak juga sebagai penjawab atas kehampaan dan kegersangan hati manusia sekarang ini. Penelitian ini mengungkapkan Masyarakat heterogen merupakan ranah akhlak yang bernilai tinggi, karena manusia tidak lagi berkumpul dari satu komonitas atau ras saja. Modernisasi juga ditandai dengan mobilitas masyarakat yang tinggi seharusnya menjadi alat penyebaran akhlak dalam kehidupanan manusia yang terus mencari tempat yang baru untuk ditinggali. Individualis merupakan corak tersendiri dari kelemahan masyarakan modernis karena pertahan manusia terbaik dalam bersaing dengan teknologi yang serbah canggih adalah koloni yang kuat.

Abstract

This research examines forms of domestic violence and the considerations of judges at the Batusangkar Religious Court in deciding divorce cases and judges' considerations in divorce cases from the perspective of Law Number 23 of 2004 concerning the Elimination of Domestic Violence. The type of research used in writing this thesis is a qualitative approach. The results of the first research, forms of domestic violence in divorce cases. Second, the consideration of the judge at the Batusangkar Religious Court in deciding a divorce case, one party leaving the other party for 2 (two) consecutive years, a prison sentence of 5 (five) years, the husband violating the divorce agreement. The three judge's considerations regarding divorce cases are seen from the perspective of Law Number 23 of 2004.

Abstract

The main issue in this thesis is to explain the resolution of marital conflicts among non-malacok couples in Nagari Bungo Tanjuang. This field research aims to understand and describe the process of conflict resolution and the impacts of such resolutions in marital conflicts among non-malacok couples in Nagari Bungo Tanjuang. The findings of this research indicate that the forms of marital conflicts among non-malacok couples in Nagari Bungo Tanjuang include visible conflicts such as economic factors, differences in opinions, lack of mutual respect, interference from in-laws, and domestic violence. The reason they do not engage in malacok is due to the high adat costs, amounting to 3,000,000 IDR, which only covers the adat money; further costs will follow for the malacok process. The resolution method employed is non-litigation, using family-based and customary approaches. The impact of this resolution, however, is the dissatisfaction among the conflicting parties, as no peaceful resolution was achieved as expected, which further worsens the relationship, leading to separation, either through living apart or an informal divorce. This situation negatively affects the obligations between husband and wife as well as the children. Despite the application of several resolution models in the marital conflicts, the conflicts did not result in a satisfactory solution, thus not ensuring the resilience of the marriage.

Abstract

The science that is circulating today has been influenced by Western philosophy, namely secularism and skepticism. This has led to the separation of religion (God) from science, with doubt becoming the foundation in the search for truth. This is, of course, in contrast to Islamic values. Therefore, Ismail Raji Al-Faruqi and Syed Muhammad Naquib Al-Attas offer the concept of the Islamization of science as a solution to the problems faced. The aim of this research is to examine the concept of the Islamization of science according to Ismail Raji Al-Faruqi and Syed Muhammad Naquib Al-Attas and its implications for the development of Islamic education. In this research practice, the researcher uses a qualitative approach and a descriptive method of non-interactive study. Data collection was carried out through literature study techniques, with the researcher as the key instrument. The collected data was then analyzed through the stages of data reduction, data display, and conclusion drawing. The results of this study show that there are both similarities and differences regarding several concepts within the Islamization of science in the views of Al-Faruqi and Al-Attas. Among the similarities is the background that justifies the need for Islamization. The differences between them are found in the stages of the Islamization of science. Al-Attas provides a general explanation with two stages: alienation and absorption. In contrast, Al-Faruqi offers a detailed explanation of this process with 12 stages. Another finding from this research indicates that the concept of the Islamization of science has implications for the development of Islamic education, covering institutional, curriculum, and educator aspects.

Abstract

Penelitian ini mengkaji praktik nikah siri di Kecamatan Tanjung Raya yang terbagi menjadi dua jenis, yaitu nikah yang tidak sah menurut agama dan negara serta nikah yang hanya sah menurut agama. Praktik nikah siri yang hanya sah secara agama lebih dominan terjadi, terutama disebabkan oleh ketidakmampuan salah satu pihak menunjukkan akta cerai, yang dianggap sulit, rumit, dan memakan waktu dalam pengurusannya. Logika hukum masyarakat pelaku nikah siri didominasi oleh pemahaman hukum Islam, di mana pernikahan yang memenuhi rukun dan syarat agama dianggap sah, sementara pencatatan di KUA hanya dipandang sebagai urusan administratif. Selain itu, kondisi sosio-kultural masyarakat turut memengaruhi praktik ini, dengan faktor-faktor seperti kuatnya pengaruh ulama, karakteristik wilayah yang agamis, budaya instan, lemahnya penegakan hukum, dan kebiasaan masyarakat yang mendukung praktik tersebut. Sebagai solusi, diperlukan kolaborasi berbagai pihak untuk melarang nikah siri, termasuk penyusunan aturan khusus di tingkat nagari, mendorong pengajuan kasus secara kolektif ke pengadilan, inovasi di tingkat KUA, dan penyederhanaan proses administrasi di Pengadilan Agama, khususnya terkait biaya pengurusan. Temuan ini menyoroti perlunya pendekatan komprehensif dalam menangani fenomena nikah siri secara holistik.

Abstract

This study explores the meaning, function, and social perception of hijab use in the lives of Indonesian Muslim women from the perspective of Islamic law, spirituality, and multicultural dimensions. The purpose of the research is to examine the normative basis of the obligation to wear the hijab in the Qur'an and Hadith, as well as to understand the subjective experiences of Muslim women of various ethnicities in Indonesia. This study uses a phenomenological qualitative approach with in-depth interview techniques with 20 Muslim women from Javanese, Sundanese, Madura, Batak, and Minangkabau ethnic backgrounds, followed by surveys as well as literature and documentation studies. The results of the study show that the hijab is not only understood as a sharia obligation, but also a symbol of spiritual identity, a means of self-protection, and a medium of identity negotiation in a pluralistic society. Muslim women interviewed acknowledged the challenges of social stigma, discrimination, and negative stereotypes, but they also affirmed the hijab as a source of spiritual strength and a symbol of ethno-religious pride. The practical implications of this study recommend the development of multicultural education programs in schools, teacher training on religious sensitivity, and media guidelines to portray the diversity of hijab practices in an equitable and inclusive manner
