Abstract

This study aims to examine the effect of punishment on the discipline, performance, and motivation of lecturers and staff at Universitas Islam Nusantara Al-Azhaar within the framework of Islamic Business Ethics. This research employs a quantitative approach to investigate a specific population of 185 lecturers and staff, who also serve as the research sample. Data were collected using a questionnaire, and the analysis was conducted using Partial Least Squares (PLS), focusing on two main stages: evaluating the Outer Model (measurement model) and the Inner Model (structural model). An associative approach was used to identify the relationships between variables. The study's findings reveal a significant positive effect of punishment on discipline, performance, and motivation. The research indicates that when punishment is applied fairly and in line with the principles of Islamic Business Ethics, it can enhance discipline and foster higher performance and motivation among individuals. However, the study also highlights that the success of punishment as a tool depends on its implementation, emphasizing the need for adherence to ethical and just guidelines. The results provide insights into the critical role of ethical considerations in applying punishment to foster a productive and disciplined organizational environment. The policies of punishment, discipline, performance, and motivation at Universitas Islam Nusantara Al-Azhaar are carefully designed to be truly aligned with Islamic Business Ethics. The study also shows that the contribution of the punishment variable to discipline is 0.606, to performance is 0.719, and to motivation is 0.794, with the remaining 45.8% explained by other variables outside of this study.

Abstract

This research aims to formulate a mechanism for resolving objections from land rights holders to land procurement activities intended for public purposes. Employing a qualitative approach and literature study, this research is guided by Maslahat Theory with a comparative approach. It relies on secondary data, including primary, secondary, and tertiary legal materials. The study reveals that objections to land procurement activities have existed since the early period of Islam, notably during the times of Prophet Muhammad SAW and al-Khulafā' ar-Rāshidun. Fiqh does not provide a standardized mechanism for resolving land rights holders' objections to land procurement, instead leaving resolution to government policy based on the broader benefits of the state and religion, ensuring land rights holders are not oppressed or harmed. Based on resolutions used by early Islamic caliphs, this research identifies three resolution methods: discussion and dialogue, tahkim (arbitration), and court proceedings. Implementing these three methods is entrusted to the government, tailored to local customs (uruf) and the evolving dynamics of land procurement regulations for public purposes. In Indonesia, objections to land procurement activities are comprehensively regulated, notably through Law No. 2 of 2012 on Land Procurement for Development in the Public Interest.

Abstract

Tingginya angka perceraian di Indonesia, khususnya cerai gugat yang diajukan istri, menjadi tantangan utama bagi Pengadilan Agama dalam mewujudkan keadilan cepat, sederhana, dan rendah biaya. Penelitian ini menganalisis strategi mediasi dalam penyelesaian perkara cerai gugat Nomor 969/Pdt.G/2024/PA di Pengadilan Agama Lubuklinggau, yang menerapkan PERMA Nomor 1 Tahun 2016 sebagai dasar hukum mediasi wajib sebelum sidang pokok perkara. Pendekatan kualitatif deskriptif dengan studi kasus tunggal digunakan, mengumpulkan data primer melalui observasi proses mediasi, wawancara mediator seperti Mawardi Kusuma Wardani, hakim, serta pihak penggugat dan tergugat, ditambah data sekunder dari dokumen perkara dan laporan pengadilan.Hasil penelitian menunjukkan mediasi di PA Lubuklinggau mencapai tingkat keberhasilan 75-81% pada triwulan I-II 2025 dari 165 perkara, didukung optimalisasi fasilitas ruang mediasi khusus, pelatihan mediator, dan slogan "Bangkit, Yes, Yes, Yes!" yang mencerminkan sinergi institusi. Strategi utama mencakup teknik active listening, caucus (pertemuan terpisah), reframing perspektif konflik, serta reality testing untuk menguji kelayakan kesepakatan nafkah anak, hak asuh, dan harta gono-gini, meskipun rujuk gagal dicapai pada kasus ini. Kendala seperti resistensi emosional diatasi melalui edukasi hak Islam tentang talak dan iddah, menghasilkan kesepakatan parsial yang mengurangi beban sidang utama.Secara normatif, PERMA nomor 1 tahun 2016 mengatur prosedur komprehensif mulai pra-mediasi hingga pasca-mediasi dalam 30 hari kerja, dengan prinsip kerahasiaan, kesukarelaan, dan win-win solution, selaras nilai rekonsiliasi Islam. Namun, implementasi masih terkendala minim dukungan kelembagaan dan beban perkara tinggi, meski PA Lubuklinggau unggul dibanding pengadilan lain di Sumatera Selatan. Kesimpulan menegaskan mediasi efektif sebagai keadilan restoratif, dengan saran pelatihan berkelanjutan mediator, sosialisasi digital, dan monitoring IKU Badilag untuk replikasi model sukses.
