Abstract

Pesatnya perkembangan teknologi dan media sosial telah membawa dampak positif dan negatif dalam kehidupan remaja, terutama di lingkungan sekolah berasrama penuh yang terpisah dari pengawasan keluarga sehari-hari. Penggunaan media sosial yang tidak terkendali dapat mempengaruhi moral dan karakter siswa, serta menimbulkan berbagai ancaman seperti cyberbullying, penyebaran konten tidak pantas, kecanduan, hingga krisis identitas. Oleh karena itu, program pengabdian ini dirancang untuk memberikan edukasi moral yang komprehensif bagi siswa di Sekolah Agama Berasrama Penuh Muahad Ahmadi Negeri Sembilan (SABP MANS), Malaysia, guna membantu mereka menghadapi tantangan bahaya media sosial dengan cara yang bijaksana dan bertanggung jawab. Program ini terdiri dari beberapa tahap, dimulai dengan pemetaan pemahaman awal siswa tentang penggunaan media sosial dan tantangan moral yang mereka hadapi. Selanjutnya, dilakukan serangkaian kegiatan edukatif berupa seminar, diskusi kelompok, serta lokakarya interaktif yang melibatkan guru, siswa, dan orang tua dalam pembahasan dampak media sosial terhadap kehidupan remaja. Pendekatan ini bertujuan untuk menanamkan nilai-nilai moral, seperti kejujuran, tanggung jawab, dan etika digital, sehingga siswa mampu menghindari penyalahgunaan media sosial. Materi pembelajaran juga difokuskan pada peningkatan literasi digital, termasuk cara mengenali dan menghindari berita hoaks, konten negatif, serta risiko pergaulan bebas di dunia maya. Melalui program ini, diharapkan para siswa dapat memahami pentingnya menjaga moral dan integritas di era digital, serta memanfaatkan media sosial sebagai alat yang positif untuk pengembangan diri dan sosial.

Abstract

Globalization has created an interconnected and interdependent world, brought various conveniences while simultaneously raised new challenges in human rights issues. One prominent negative impact is the rise of Transnational Organized Crime (TOC), including human smuggling, which is increasingly facilitated by technological developments and market openness. This practice resembles a free market, where actors compete to attract customers without formal mechanisms for resolving disputes or enforcing contracts, giving rise to trust issues that are often addressed through reputational investment. This study aims to examine the gaps in Indonesia's national law in responding to this phenomenon and assess its relevance to international standards, particularly the Palermo Protocol. Using normative methods through literature review and a comparative approach, this study highlights the relationship between globalization, human smuggling, and the existing legal framework. The findings indicate that although the UN, through the UNODC and the Conference of Parties (COP), has initiated TOC prevention mechanisms, their implementation remains weak without strong normative ties. In conclusion, harmonization of Indonesian law with international standards is needed to strengthen human rights protection and the effectiveness of law enforcement against human smuggling.

Abstract

The research aimed to analyze the alignment between the judge's decision in cases of domestic violence against children and the provisions of Law Number 23 of 2004 on the Elimination of Domestic Violence and Qonun Number 9 of 2019 on the Implementation of Handling Violence Against Women and Children. The study also considered moral considerations and the overall benefits. The research methodology employs a case law study, which involves examining court decisions to get insight into the application of the law in specific circumstances. Specifically, the study focuses on the Decision of the Tapak Tuan District Court Judge Number 37/Pid.Sus/2020/PN. Case law is utilized to examine court rulings to comprehend how the law is implemented in specific instances. The library research method is employed in conjunction with a sociological juridical perspective. The data for the research is sourced from the Law and various pertinent articles addressing the research difficulties. Furthermore, to bolster the ideas of the study, the paper also incorporates the findings of several empirical studies. According to the findings, it appears that the judge primarily focuses on formal factors and gives little weight to material considerations in their decision-making process. This aligns with the viewpoint expressed by Member Judge II and the concurring opinion within the panel of judges. However, the author acknowledges and values the decision made by the panel of judges. The author recognizes the challenging nature of the judges' task, as they must not only consider the legal interests involved in the case, but also consider the community's sense of justice in order to achieve legal certainty.

Abstract

This study analyzes the role of law enforcement officials in implementing Alternative Dispute Resolution (ADR) in traffic accident cases in Indonesia. Although traffic accidents are generally processed through formal criminal justice mechanisms, many cases involve negligence and minor harm, making restorative settlement more appropriate. This research applies an empirical juridical (socio-legal) approach with a qualitative descriptive-analytical design. Data were collected through interviews, observations, and document analysis, and examined using qualitative analysis with triangulation. The findings indicate that law enforcement officials, particularly the police, act as facilitators, mediators, legal educators, and process controllers in promoting peaceful settlements. ADR is conducted through several stages, including initial case assessment, offering mediation, facilitating dialogue, drafting agreements, and monitoring compliance. In exercising discretion, officials consider the severity of the accident, the element of fault, the perpetrator’s attitude, the victim’s consent, and social benefits. However, implementation faces challenges such as the absence of standardized procedures, limited mediation skills, low public legal awareness, and concerns over transparency. Strengthening regulatory guidance and institutional capacity is essential to ensure fair and humane dispute resolution.

Abstract

This study analyzes the implementation of the Electronic Traffic Law Enforcement (ETLE) system through traffic CCTV surveillance as an effort to enforce traffic violations in Medan City. The objectives of this research are to examine the legal basis of the ETLE system, analyze its implementation by the Traffic Directorate of the North Sumatra Regional Police, and identify obstacles encountered in its application. This research employs a normative juridical method with a descriptive-analytical approach, utilizing primary legal materials in the form of statutory regulations and secondary legal materials from legal literature and scholarly works. The results indicate that the legal foundation of the ETLE system is established under Law Number 22 of 2009, Government Regulation Number 80 of 2012, and Police Regulation Number 8 of 2023, which collectively provide legal certainty for electronic-based traffic law enforcement. The implementation of ETLE in Medan City has been conducted through public socialization and CCTV-based monitoring to enhance efficiency and objectivity in traffic law enforcement. However, several obstacles remain, including technical limitations of CCTV facilities, weather conditions, low public awareness, inaccurate vehicle data, and the use of fake license plates. These challenges affect the effectiveness of ETLE implementation and require improved infrastructure and inter-agency coordination.

Abstract

This research aims to analyze restorative justice as a breakthrough in resolving legal cases by the Police of the Republic of Indonesia from a theoretical perspective. Data was collected through literature study, observation, and analysis of legislation and other relevant documents. Data analysis uses the interactive model from Miles and Huberman. The research results show that, in the Indonesian context, there are several positive impacts that can be identified related to the application of restorative justice in resolving legal cases as follows: 1) Relationship Restoration, helping to restore the relationship between the perpetrator and the victim; 2) Reducing recidivism, restorative justice can reduce the rate of perpetrators returning to the world of crime; 3) Legal System Efficiency, speeding up the case resolution process, reducing the burden on an already congested legal system, and saving resources, including time and money; 4) Community Participation, involving the community in the case resolution process; 5) Psychological Support, providing psychological support for victims; 6) Alternatives for Young Offenders, a more useful alternative to prison for young offenders. However, the future challenge for the police is not to let restorative justice become a commercial product of the police

Abstract

This study discusses the policy of overcrowding as an effort to prevent violence in the Class I Detention Center (Rutan) Medan. The issues studied include: how the overcrowding policy is implemented in preventing violence between inmates; what are the supporting and inhibiting factors in the implementation of the policy; and how effective are the policies of regulatory arrangement, institutional strengthening, and provision of infrastructure in reducing the number of violence in detention. This study uses an empirical legal research with a qualitative approach, which positions law as a social phenomenon (law in action) and not only as a written norm. The nature of this research is descriptive analytical, namely describing objective conditions in the field while analyzing the relationship between the overcrowding policy and the social dynamics that occur in detention. Data were obtained through interviews, observations, and documentation studies. The results of the study indicate that the implementation of the overcrowding policy has been carried out through the redistribution of inmates, optimization of guidance, and coordination between agencies, but still faces obstacles such as budget limitations, minimal facilities and infrastructure, and bureaucratic institutional structures. Supporting factors such as officer commitment and internal innovation in detention also help reduce the potential for violence. Overall, regulatory reform, institutional strengthening, and infrastructure provision contribute to reducing the risk of violence, although their effectiveness remains suboptimal and requires continuous improvement.

Abstract

This study analyzes human trafficking (TPPO) in Asahan Regency during the period 2018–2023, focusing on modus operandi, criminal policies, and enforcement obstacles. The study employs a normative legal research method, using library research and analysis of legislation, official police documents, annual reports, and scholarly literature related to TPPO. The results indicate that TPPO modus operandi has evolved from traditional methods to modern forms that utilize technology, social media, and cross-regional networks. Perpetrators carry out various actions, including recruiting migrant workers without authorization, document forgery, domestic exploitation, and child exploitation in the plantation sector. These crimes emphasize economic and sexual exploitation of vulnerable groups, particularly women and children, and exploit victims’ lack of knowledge regarding legal procedures and legal migration. TPPO handling in Asahan Regency is conducted through a combination of penal and non-penal strategies. The penal approach emphasizes firm law enforcement oriented toward victims, through enhanced investigator capacity, establishment of special units, actions against organized networks, and optimization of asset seizure. The non-penal approach focuses on prevention through public education, awareness campaigns on illegal recruitment methods, strengthening community networks, monitoring high-risk areas, and providing integrated services for victims. However, law enforcement faces various structural, procedural, social, and institutional obstacles, including limited resources, low public legal awareness, victim trauma, and the complexity of transnational and covert modus operandi. To enhance the effectiveness of TPPO enforcement, a comprehensive strategy is required, including strengthening law enforcement capacity, providing adequate victim protection systems, implementing preventive policies based on education and community empowerment, fostering multi-stakeholder collaboration, and conducting continuous monitoring and evaluation of emerging forms of TPPO.
