Abstract

Marriage is a sacred contract between a man and a woman as husband and wife, which aims to build a Sakina family. Marrying into a Sakina family requires not only physical and psychological preparation, but also social, financial, emotional and responsible preparation. Therefore, limiting the age of marriage is an important principle. This is because the Marriage Law and Civil Code clearly regulate and define the age limit for marriage in such a way that all prospective husband and wife must be truly mature physically and mentally. However, underage marriage still occurs in Bantul Village, which has an impact on family welfare. Based on the explanation above, the author formulates the problem as follows: (1) What are the factors causing underage marriage in Bantul, Malang Regency?; (2) What is the impact of underage marriage on household welfare? By using a qualitative descriptive approach to describe some of the data obtained from the field through interviews, observation, or documentation as data collection methods. Furthermore, it proceeds to the process of data reduction, data presentation, and conclusion drawing by using data analysis techniques. In addition, the analysis process is also supported by literature review as a reference to refine the data obtained from practice. Such a process allows us to draw conclusions as answers to the two questions above. From the research findings, it can be concluded that the factors causing underage marriage in Bantul village are economic factors, education, parents, customs, and pregnancy outside marriage.

Abstract

Akta perdamaian merupakan instrumen hukum yang memiliki kekuatan eksekusi yang setara dengan putusan pengadilan yang sudah berkekuatan hukum tetap. Akta ini lahir dari kesepakatan antara pihak-pihak yang bersengketa di hadapan hakim dalam proses persidangan, yang kemudian dituangkan dalam berita acara persidangan. Dalam praktik penyelesaian sengketa di bidang ekonomi, akta perdamaian sering menjadi pilihan karena mampu memberikan kepastian hukum sekaligus menghemat waktu bagi para pihak. Penelitian ini bertujuan untuk mengkaji kekuatan eksekutorial akta perdamaian dalam penyelesaian sengketa ekonomi berdasarkan perspektif hukum perdata. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan terhadap peraturan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa akta perdamaian memiliki kekuatan eksekusi yang sebanding dengan grosse akta, sehingga dapat langsung dilaksanakan tanpa harus mengajukan gugatan baru. Dasar kekuatan ini tercantum dalam Pasal 130 HIR yang menegaskan bahwa akta perdamaian memiliki kekuatan hukum yang sama dengan putusan pengadilan yang berkekuatan hukum tetap. Kendati demikian, terdapat beberapa batasan hukum seperti keabsahan kesepakatan, kejelasan isi akta, dan syarat bahwa objek perdamaian tidak boleh bertentangan dengan ketentuan hukum. Oleh karena itu, pembuatan akta perdamaian harus dilakukan dengan hati-hati agar tidak menimbulkan sengketa baru pada tahap pelaksanaan.

Abstract

Arbitration has increasingly become the preferred method for resolving business disputes, offering an alternative to the often lengthy and complex litigation process. It presents several advantages, such as expedited proceedings, confidentiality, and final, binding decisions. This article explores how legal certainty is upheld within the arbitration process and evaluates its effectiveness in resolving commercial disputes in Indonesia. The research adopts a normative juridical method, utilizing qualitative analysis of legislation, legal doctrines, and case studies of arbitration awards. The findings indicate that Indonesia’s arbitration framework, governed by Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, provides a solid legal foundation for arbitration proceedings. The final and non-appealable nature of arbitration decisions enhances legal certainty for the disputing parties. Nevertheless, challenges remain in the enforcement phase, particularly in the execution of arbitral awards through the district courts. These issues highlight the need for better coordination between arbitration institutions and the judiciary, along with improved legal awareness among law enforcement officials regarding the role of arbitration. In conclusion, arbitration continues to play a vital role in ensuring legal certainty and promoting the efficient resolution of business disputes in today’s legal landscape.
