Abstract

Kegiatan Pengabdian Kepada Masyarakat ini bertujuan untuk memberikan pemahaman kepada Masyarakat terutama kepada para guru-guru dan siswa siswi di Lingkungan SMA Mandala Trikora Jayapura terkait dengan tindak pidana anak disekolah dan bagaimana pencegahan tindak pidana anak disekolah. Kegiatan ini menggunakan metode ceramah serta diskusi dan tanya jawab. Melalui ceramah peserta akan diberikan penjelasan dan informasi mengenai gambaran contoh kasus tindak pidana anak dan bagaimana pencegahan tindak pidana anak jika terjadi di sekolah. Pemateri yang ahli dibidangnya akan memberikan wawasan yang komprehensif sehingga diharapkan mendapatkan ilmu pengetahuan hukum baru kepada guru-guru dan siswa siswi SMA Mandala Trikora Jayapura terkait tindakan hukum yang diterima jika melakukan kekerasan seperti perundungan atau terjadi kekerasan secara fisik di lingkungan sekolah.

Abstract

Drafting legitimate and profitable business contracts is a crucial aspect in the business world. This article aims to analyze the legal aspects that must be considered in the preparation of a business contract in order to qualify it for validity and provide benefits to the parties. This study uses normative methods with a juridical approach, namely analyzing the applicable legislation, legal doctrine, and court decisions related to business contracts. The results showed that the validity of the contract is highly dependent on the fulfillment of the conditions in Article 1320 of the Civil Code, including the agreement of the parties, legal competence, clear object, and lawful cause. Non-fulfillment of such conditions may result in cancellation of the contract or be null and void. In addition, a profitable contract must observe the principle of fairness and balance between the rights and obligations of the parties in order to avoid potential disputes that could harm business continuity. Therefore, transparency in the preparation of contracts and effective dispute resolution mechanisms are important factors to ensure contracts are not only legally valid, but also support the stability and sustainability of the business.

Abstract

This study aims to analyze the application of the principles of equality and non-discrimination in Indonesian civil law as well as its harmonization with international legal standards. These principles form an essential foundation in protecting human rights and ensuring justice for all citizens without any discriminatory treatment. The research method used is normative, with a documentary study approach and comparative analysis of national legislation and related international legal instruments. The results show that although national legal norms have accommodated the principles of equality and non-discrimination, challenges in implementation still arise due to socio-cultural factors, limited understanding among legal officials, and a lack of regulations addressing modern discrimination issues. This study emphasizes the need to strengthen regulations, enhance the capacity of legal officials, and educate the public as efforts to effectively enforce these principles. A more progressive legal harmonization is expected to support the realization of social justice and human rights protection in Indonesia.

Abstract

Tujuan: Penelitian ini bertujuan untuk mengevaluasi efektivitas dan tantangan implementasi pelayanan terpadu sidang keliling berdasarkan Perma Nomor 1 Tahun 2015 dalam meningkatkan akses keadilan bagi masyarakat di wilayah terpencil. Metode Penelitian: Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Data dikumpulkan melalui studi kepustakaan yang mencakup regulasi, putusan pengadilan, literatur ilmiah, dan laporan empiris dari beberapa Pengadilan Agama di Indonesia. Analisis dilakukan secara kualitatif dengan interpretasi preskriptif terhadap data sekunder yang relevan. Hasil dan Pembahasan: Hasil penelitian menunjukkan bahwa sidang keliling efektif meningkatkan partisipasi masyarakat dan percepatan penyelesaian perkara, terutama pada kasus perceraian dan isbat nikah. Keberhasilan program sangat dipengaruhi oleh intensitas sosialisasi hukum, penguatan kapasitas sumber daya manusia, inovasi teknologi informasi, kualitas infrastruktur, dan kolaborasi antar lembaga. Namun, masih ditemukan kendala berupa keterbatasan SDM, infrastruktur, dan disparitas akses digital. Implikasi: Temuan ini berimplikasi pada perlunya kebijakan yang lebih adaptif dan berkelanjutan dalam penguatan pelayanan hukum berbasis masyarakat. Penelitian ini merekomendasikan penguatan pelatihan, digitalisasi, dan kolaborasi multi-aktor, serta mengusulkan studi lanjutan yang lebih komprehensif secara lintas wilayah.

Abstract

Tujuan: Penelitian ini bertujuan untuk menganalisis pelaksanaan penghapusan Barang Milik Negara (BMN) di lingkungan Pengadilan Agama, serta mengidentifikasi hambatan dan upaya yang dilakukan dalam konteks hukum administrasi negara. Penelitian ini didasarkan pada hipotesis bahwa efektivitas penghapusan BMN dipengaruhi oleh ketersediaan data yang valid, regulasi yang operasional, serta kualitas kelembagaan pelaksana kebijakan. Metode Penelitian: Metode penelitian yang digunakan adalah deskriptif kualitatif dengan pendekatan normatif-empiris, menggabungkan studi pustaka terhadap regulasi perundang-undangan dan observasi lapangan di Pengadilan Agama Arso. Teknik pengumpulan data dilakukan melalui dokumentasi, wawancara, dan observasi partisipatif, yang kemudian dianalisis secara tematik dan konstruktif. Hasil dan Pembahasan: Hasil penelitian menunjukkan bahwa penghapusan BMN telah mengikuti prosedur normatif sebagaimana diatur dalam PMK 83/PMK.06/2016, namun masih dihadapkan pada hambatan seperti ketidaklengkapan data aset, birokrasi yang berlapis, serta lemahnya pemahaman aparatur terhadap regulasi teknis. Pembentukan Tim Penertiban BMN terbukti sebagai solusi strategis yang mampu mempercepat proses penghapusan. Implikasi: Temuan ini memberikan kontribusi terhadap pengembangan kebijakan pengelolaan aset negara berbasis prinsip good governance, serta merekomendasikan digitalisasi sistem informasi aset dan penguatan literasi hukum sebagai agenda penelitian lanjutan.

Abstract

Tujuan: Penelitian ini bertujuan untuk menganalisis perspektif hukum terhadap pencalonan mantan terpidana korupsi dalam Pilkada Serentak Tahun 2020 di Kabupaten Boven Digoel berdasarkan PKPU Nomor 1 Tahun 2020 Pasal 4 huruf (f). Penelitian ini berangkat dari persoalan yuridis mengenai konflik antara hak politik yang dijamin konstitusi dengan pembatasan administratif yang ditetapkan oleh peraturan teknis pemilu. Metode Penelitian: Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasuistik. Data diperoleh melalui studi kepustakaan, wawancara dengan penyelenggara pemilu, serta dokumentasi hukum di lapangan. Hasil dan Pembahasan: Hasil penelitian menunjukkan adanya ketidakharmonisan norma antara peraturan teknis (PKPU) dan norma hukum yang lebih tinggi (UUD 1945 dan KUHP), serta menunjukkan bahwa hak politik mantan terpidana seharusnya tidak dapat dicabut secara administratif tanpa putusan pengadilan. Temuan ini memperlihatkan lemahnya koordinasi antar lembaga pemilu dan ketidakpastian hukum dalam proses seleksi calon kepala daerah. Implikasi: Penelitian ini memberikan kontribusi terhadap reformulasi kebijakan pemilu yang lebih konstitusional, adil, dan berorientasi pada integritas demokrasi. Kajian ini juga merekomendasikan pembentukan regulasi dan lembaga verifikasi etik independen dalam pencalonan kepala daerah.

Abstract

Corruption in Indonesia is a serious problem, considered an extraordinary crime because of its widespread impact, detrimental to state finances, and damaging the nation's morals and integrity. This research aims to evaluate the role of state administrative law in preventing criminal acts of corruption by state officials, identify factors that influence its effectiveness, and formulate strategies for eradicating corruption from the perspective of state administrative law. The research method used is normative juridical analysis with statutory, conceptual and comparative approaches. Research findings confirm that state administrative law plays a crucial role in preventing corruption through the formulation of clear regulations, effective supervision, and implementation of administrative sanctions. However, its effectiveness is often hampered by weak law enforcement, lack of transparency, and political interference. Factors such as accountability, transparency and bureaucratic integrity have a significant influence on the success of administrative law in fighting corruption. The recommended strategy for eradicating corruption includes strengthening supervisory institutions, increasing the level of openness, community participation, and using information technology to increase efficiency and transparency in government administration.

Abstract

The basic right to life is a human right protected in the Indonesian constitution. In this case, residents of the assisted communities still have the right to life as part of their human rights so that the state is obliged to try to protect them from the dangers of the Covid-19 pandemic which threatens the location of prisons where assisted residents live. The implementation of the policy of the Decree of the Minister of Law and Human Rights of the Republic of Indonesia Number M.Hh-19.Pk.01.04.04/2020 has not been very effective because there are still prisoners and children who are returned to prisons or detention centers for returning to commit crimes. In the field of supervision, there are still shortcomings, namely that supervision only involves elements of the Bapas and the Prosecutor's Office which are limited.

Abstract

This paper aims to deepen the understanding of the Pancasila concept as a legal source within the context of national culture in the framework of the unitary state of the Republic of Indonesia. The research employs a documentary literature review approach. The analysis results conclude that "Panca" signifies five, while "Sila" refers to principles or principles encompassing essential values such as belief in the Almighty, humanity, nationalism, democracy, and social justice. The article explores the manifestation of Pancasila values and concepts in culture by referring to three main concepts: cultural materials, where individuals are considered cultural realities; social interactions; and tangible creative products. The analysis, study, and description provided in this paper lay the foundation for practical recommendations, emphasizing the necessity of embodying Pancasila values and applying these concepts as a national legal foundation. Beyond mere text, the embodiment of Pancasila values must be an integral part of the daily actions of all citizens. This article advocates for the crucial implementation of concrete Pancasila values in societal life, forming a solid foundation for cultural law in Indonesia.

Abstract

This article delves into the role of the Bhinneka Tunggal Ika concept in shaping the national legal framework of the Republic of Indonesia. Within the context of diversity that characterizes the nation, Bhinneka Tunggal Ika is elevated as the central pillar coloring the legal formation process. The analysis involves a review of the values of diversity, unity, and oneness embedded in this concept, as well as how it is implemented in the national legal foundation. The aim of this article is to provide a profound understanding of how Bhinneka Tunggal Ika serves not only as a national motto but also as a philosophical basis inspiring the creation of an inclusive legal framework capable of responding to the dynamics of the heterogeneous Indonesian society. Through this analysis, it is expected that this article will contribute to a richer understanding of the relationship between Bhinneka Tunggal Ika and the sustainable formation of the national legal system in the Republic of Indonesia.
