Abstract

Catcalling is a frequent phenomenon in society where a person verbally harasses or humiliates women in public spaces through sexual comments or unwanted behavior. It creates discomfort, anxiety and even trauma for victims, and reflects gender and power inequalities in our culture. A legal and cultural analysis of catcalling of women reveals the complexity of addressing this issue. While some jurisdictions have laws against verbal harassment, enforcement is often ineffective, and cultures that maintain gender stereotypes reinforce the behavior. The importance of education, public awareness and cultural change in combating catcalling is essential in creating a safer and more equal environment for women in society.

Abstract

This study analyzes the legal status of children born from surrogacy in Indonesia, a practice considered illegal yet a potential solution for infertility, creating a serious rechtsvacuüm. The research objective is a juridical analysis of this issue under Indonesian civil law using a normative juridical method. The findings indicate that surrogacy agreements are legally invalid and considered null and void (van rechtswege nietig) because they fail to meet the "lawful cause" requirement stipulated in Article 1320 in conjunction with Article 1337 of the Civil Code. This legal void creates uncertainty for the child. Based on the principle of mater semper certa est, the surrogate is legally recognized as the mother, disregarding genetic parentage. This situation infringes upon the child's fundamental rights to identity and inheritance, undermining the principle of pro bono infantis. The study concludes that there is an urgent need for definitive state regulation, either through a strict prohibition or by permitting altruistic surrogacy under rigorous judicial oversight, to provide legal certainty and paramount protection for the child

Abstract

Perkembangan e-commerce di Indonesia memudahkan transaksi, namun menimbulkan masalah perlindungan konsumen, terutama terkait ketidaksesuaian produk dengan deskripsi. Meskipun UUPK mengatur hak konsumen, pelaksanaannya masih lemah, sehingga banyak konsumen kesulitan mendapatkan ganti rugi atas kerugian akibat produk yang tidak sesuai. Penelitian ini dilakukan dengan pendekatan yuridis normatif yang berfokus pada telaah terhadap peraturan perundang-undangan, doktrin hukum, serta putusan pengadilan yang relevan dalam konteks perlindungan konsumen pada transaksi e-commerce dalam hal terjadinya wanprestasi. Fokus utamanya adalah pada kajian norma hukum yang berlaku sebagai pedoman perilaku, sesuai dengan pemahaman dari Soerjono Soekanto dan Sri Mamudji. Perdagangan e-commerce mempermudah transaksi, namun menimbulkan risiko wanprestasi seperti barang tidak sesuai deskripsi. Perlindungan konsumen diatur dalam UUPK dan UU ITE, namun implementasinya masih lemah. Tanggung jawab hukum ada pada pelaku usaha dan platform. Untuk melindungi konsumen dalam ekosistem e-commerce, diperlukan sistem pengawasan yang optimal, edukasi hukum yang memadai, serta penyelesaian sengketa yang efisien. Landasan hukum perlindungan tersebut tercantum dalam UUPK dan UU ITE, namun implementasinya masih lemah. Diperlukan peningkatan literasi hukum, penguatan pengawasan platform, optimalisasi peran BPSK, serta penegakan hukum terhadap wanprestasi dan klausula baku untuk menciptakan transaksi digital yang adil dan aman.
