Abstract

Law Number 1 of 2023 concerning the Indonesian Criminal Code represents a comprehensive reform of the national criminal law system. This reform not only replaces the colonial criminal code but also introduces a new paradigm in law enforcement practices, particularly for the Indonesian National Police (Polri) as the primary investigator within the criminal justice system. This study aims to analyze the transformation of law enforcement under the new Criminal Code and its implications for Polri’s institutional role and professionalism. Using a qualitative approach with normative juridical and conceptual methods, this research finds that the 2023 Criminal Code shifts the paradigm from retributive justice toward restorative and corrective justice. Such transformation requires structural and cultural reforms within Polri, including strengthening human rights protection, adjusting investigative procedures, and enhancing institutional capacity. The successful implementation of the new Criminal Code depends on Polri’s readiness to internalize substantive justice and due process principles.

Abstract

The purpose of this study is to discover the mechanism for strengthening the protection for the Directors of Indonesian State-owned Enterprises through the Business Judgment Rule and the implementation of Good Corporate Governance so that business policies that have been implemented are not interfered with by law enforcers, for the company's going concerns.  A normative judicial research method was conducted with primary source materials, including laws related to BUMN and Limited Liability Companies which serve as the reference for the implementation of the company's goals and objectives for the benefit of society based on professionalism. Secondary materials were also used in the form of textbook publications, journals in the field of corporate governance, and court decisions related to the issues. The study concludes that the Principles of Business Judgment Rule and Good Corporate Governance guidelines are important references that can protect the directors in running the company. Secondly, the meaning of 'State Financial Loss' is not only understood in the context of the provisions of the criminal act of corruption if there is a loss from a transaction carried out by a company. The meaning of loss in a company must also be viewed from an accounting perspective which has a different meaning from the legal perspectives that are universally subject to financial accounting standards.

Abstract

Surat Edaran Mahkamah Agung Nomor 3 Tahun 2023 (SEMA No. 3 Tahun 2023) diterbitkan sebagai pedoman teknis yudisial bagi hakim dalam memeriksa dan mengadili perkara, termasuk perkara perceraian di lingkungan Peradilan Agama. Penelitian ini bertujuan untuk menganalisis kedudukan hukum SEMA No. 3 Tahun 2023 dalam sistem hukum Indonesia serta penerapannya dalam praktik pemeriksaan perkara perceraian di Pengadilan Agama. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan kasus, yang didukung oleh analisis terhadap putusan-putusan Pengadilan Agama pasca berlakunya SEMA No.3 Tahun 2023. Hasil penelitian menunjukan bahwa secara normatif SEMA tidak berkedudukan sebagai peraturan perundang-undangan, namun memiliki kekuatan mengikat secara internal sebagai pedoman bagi hakim. Dalam praktiknya, penerapan SEMA No.3 Tahun 2023 berpengaruh terhadap pola pertimbangan hakim, khususnya dalam upaya menegakan asar mempersukar perceraian melalui pendalaman alasan perceraian dan optimalisasi upaya perdamaian. Namun demikian, ditemukan adanya perbedaan tingkat penerapan antar hakim yang dipengaruhi oleh interpretasi yudisial dan kondisi faktual para pihak. Oleh karena itu, diperlukan konsistensi penerpapan serta penguatan pemahaman hakim terhadap fungsi SEMA guna mewujudkan kepastian hukum dan perlindungan terhadap institusi perkawinan.

Abstract

Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap anak dari tindakan kekerasan seksual dalam bentuk grooming melalui media game online berdasarkan Undang-Undang No. 17 Tahun 2016 tentang Perlindungan Anak. Grooming merupakan bentuk eksploitasi seksual yang dilakukan secara bertahap dan terselubung melalui manipulasi psikologis, sering terjadi di ruang digital yang sulit diawasi. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang No. 17 Tahun 2016 telah memberikan dasar hukum, namun belum terdapat pengaturan eksplisit mengenai tindak grooming. Oleh karena itu, perlu adanya pembaruan regulasi serta peningkatan literasi digital bagi anak dan orang tua. Penelitian ini merekomendasikan adanya sinergi antara negara, penyedia platform digital, orang tua, dan masyarakat untuk menciptakan ruang digital yang aman bagi anak.

Abstract

Community participation in environmental monitoring is an essential component of the environmental legal system in Indonesia. This article aims to examine the strategic role of the community in the national legal framework, particularly under Law No. 32/2009 on Environmental Protection and Management. Using normative juridical methods and descriptive analysis, this article discusses the rights and obligations of the community, forms of participation, and challenges faced in the implementation of environmental supervision. The results of the study show that although the space for participation has been opened legally, in practice, it still faces obstacles such as limited access to information, lack of legal protection, and lack of community capacity. Therefore, strengthening legal literacy, information transparency, and protection of whistleblowers are important steps to encourage the active role of the community. This article recommends a collaborative approach between the state and the community to realise fair, participatory and sustainable environmental governance

Abstract

Technological advancements have accelerated the use of financial technology (fintech), particularly in online lending services, which facilitate public access to credit but simultaneously raise legal challenges related to the protection of consumers’ personal data. Unauthorized collection, use, or dissemination of personal data by online loan providers without the consent of data subjects poses significant risks to consumer rights. This study examines the legal framework governing personal data protection in online lending services in Indonesia and analyzes the sanctions imposed for violations. Using a normative juridical approach, the study reviews relevant statutory regulations, including Law Number 11 of 2008 on Electronic Information and Transactions, as amended, and Financial Services Authority Regulation Number 77/POJK.01/2016 on Information Technology–Based Money Lending Services. The findings indicate that service providers are legally obligated to ensure the confidentiality, integrity, and availability of consumers’ personal data and to obtain consent for its use. Violations of these obligations are subject to administrative sanctions, including warnings, fines, restrictions on business activities, and license revocation.

Abstract

The regional government has the right to establish regional regulations and other regulations to implement regional autonomy and assistance tasks, this right is regulated in article 18 paragraph 6 of the 1945 Constitution,second amendment. The making of regional regulations in principle must be made based on nad guided by applicable laws and regulations. Regional regulationsare declared to have validity if the process of making them is based on 3 (three ) aspects, namely: authority, procedure and substance. Regional regulatios as an instrument of government are expected to provide benefits to achieve the goals of the state as stated in the 1945 Constitution. Although the making of regional regulations has good intentions and objectives, in practice there are citizens, communities, private legal entities and public legal entities who feel that their interest are harmed by the existence of these regional regulations. The provisions of article 24 paragraph 1 of the 1945 Constitution as amended in the third edition, stipulated that the Supreme Court has the authority to tes laws and regulatios under the law against the law. That according to the provisions of article 7 paragraph 1 of Law number 12 of 2011 concerning the formatios of law and regulations, the hierarchy of regional regulation is below the law. That thus the testing of the validity of regional regulations becomes the autorithy of the Supreme Court to tes it. The procedural law applicable to the examinations of the testing of laws and regulations under the law against the law is Supreme Court Regulations Number 1 of 2011 concerning the right to material review. That because there is a discrepancy between the material law and the proceduaral law governing the right to material review, it raises theproblem of hiw is the mechanism for testing the validity of regional regulations carried out by the Supreme Court ? The research in this thesis is in principle a normative research, so the approach chosen is legislative approach and cases approach; whilw the method used to analyze legal material or research data uses the deductive syllogism method. Testing the validity of regional regulations is in principle based on 3 ( Three ) aspects, namely: authority, procedure and substance. Thus testing these three aspects will begin with research on the basic regulations that regulate. Futhermore, to find out the applications of these regulatios in the practice of examining the to material review in the Supreme Court, it will be carried out on a sample of Supreme Court decisions that test the validity of regional regulations

Abstract

Terrorism constitutes a multidimensional threat that not only disrupts state security but also endangers human rights, public safety, and societal well-being. Research on counter-terrorism in Indonesia has largely focused on state security approaches and law enforcement effectiveness, while comprehensive analyses from a human security perspective remain relatively limited. Addressing this gap, this study offers an analysis that integrates the human security paradigm as a framework for evaluating the effectiveness of Indonesia's counter-terrorism policies. The study aims to analyze the conceptualization and implementation of the human security approach in counter-terrorism efforts and to evaluate policy effectiveness based on parameters such as personal security protection, respect for human rights, community empowerment, and the sustainability of human security. Employing a normative legal research method, the study utilizes statutory and conceptual approaches, with data analyzed qualitatively through a literature review. The findings indicate that Indonesia's counter-terrorism policies have evolved through the strengthening of regulations, institutional frameworks, and prevention and deradicalization programs. However, when assessed against human security parameters, implementation remains predominantly oriented toward state security rather than comprehensive human protection. Therefore, policy strengthening is required to integrate state security and human security approaches, ensuring that counter-terrorism efforts are not only effective in maintaining national security but also capable of guaranteeing human rights protection, bolstering community resilience, and achieving sustainable security.
