Abstract

Abstract: This study aims to examine and analyze the Pure Theory of Law developed by Hans Kelsen, focusing on both its strengths and weaknesses. Additionally, it assesses the extent to which this theory remains relevant and applicable in the context of contemporary law. The research employs a normative method with a conceptual approach to gain an in-depth understanding of the fundamental concepts within the Pure Theory of Law. This study is based on secondary data sourced from primary, secondary, and tertiary legal materials obtained through literature reviews and documentation. Data analysis is conducted using descriptive qualitative analysis. The findings indicate that Kelsen's theory provides a crucial foundation for the legal discipline, emphasizing that law should be understood as an autonomous normative system, independent of moral, social, and political values. However, in the face of ongoing social dynamics, such as globalization, digital technological advancements, and environmental crises, the Pure Theory of Law faces significant challenges due to its rigid and limited capacity to address the complexity of cross-border issues. While this theory remains vital as a basis for ensuring legal objectivity, its inability to accommodate social dynamics suggests that law requires a more flexible and adaptive approach.

Abstract

The increasing problem of domestic violence has triggered a conflict between the implementation of the Law on the Elimination of Domestic Violence and Islamic values. Differences in interpretation and patriarchal culture hinder law enforcement, making it difficult for victims to obtain adequate protection. Therefore, this study aims to examine the principles of justice, gender equality, and feminist theory using a normative legal method by comparing positive law and Islamic law, as well as a conceptual legislative approach. The data used include primary legal materials, namely the Law on the Elimination of Domestic Violence, the Qur'an, and Hadith, secondary legal materials, including literature and journals, as well as tertiary sources collected through a literature review and analyzed qualitatively. The results showed that domestic violence against women is a violation of human rights, currently recognized as a significant crime through the Law on the Elimination of Domestic Violence. This law provides legal protection for victims and sanctions for perpetrators. Gender-based violence rooted in patriarchal culture perpetuates social inequality and discrimination against women. Islam and feminism make significant contributions by emphasizing the values of equality, justice, and respect in domestic relationships. The synergy between positive law, religious values, and feminist theory can be a strategic step toward eliminating violence and creating a more inclusive society.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis Teori Hukum Murni yang dikembangkan oleh Hans Kelsen baik dari aspek kelebihan maupun kelemahannya. Selain itu, menganalisis sejauh mana teori tersebut relevan dan aplikatif dalam konteks hukum kontemporer. Metode penelitian yang digunakan adalah metode normative dengan pendekatan konseptual untuk memahami secara mendalam konsep-konsep dasar dari Teori Hukum Murni. Penelitian ini berbasis data sekunder yang bersumber dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang bersumber dari studi kepustakaan dan dokumentasi. Analisis data yang digunakan yaitu analisis kualitatif deskriptif.  Berdasarkan hasil penelitian bahwa teori yang dirumuskan oleh Hans Kelsen merupakan pondasi yang penting bagi disiplin ilmu, dengan menekankan bahwa hukum harus dipahami sebagai sistem normatif yang otonom, terlepas dari pengaruh nilai-nilai moral, sosial, dan politik. Namun, dinamika sosial yang terus berubah, seperti globalisasi, perkembangan teknologi digital, dan krisis lingkungan, Teori Hukum Murni menghadapi tantangan besar karena sifatnya yang kaku dan terbatas dalam merespons kompleksitas isu lintas batas. Sementara teori ini tetap penting sebagai landasan yang menjamin obyektivitas hukum, ketidakmampuannya dalam merangkul dinamika sosial menunjukkan bahwa hukum membutuhkan pendekatan yang lebih fleksibel dan adaptif.

Abstract

This study aims to examine how war crimes are conceptualised and enforced within the framework of International Humanitarian Law (IHL) and the Rome Statute by analysing the Israel–Palestine conflict as a prolonged and politically contested armed conflict in which serious violations against civilians persist with limited accountability. Using a normative legal research design, this article applies a statutory and case-based approach through doctrinal analysis of the Geneva Conventions, Additional Protocols, and the Rome Statute, supported by qualitative examination of ICC-related documents, United Nations reports, and verified secondary data to assess the implementation of core IHL principles, particularly distinction and proportionality. The findings demonstrate that recurrent violations committed by both parties are not primarily caused by normative gaps in international law, but rather by structural enforcement barriers, including the ICC’s jurisdictional and admissibility constraints, restricted access to evidence, lack of state cooperation, political interference, and selective enforcement through international institutions, especially the UN Security Council. These obstacles contribute to an enduring enforcement deficit that weakens civilian protection and perpetuates impunity in asymmetric and protracted conflicts. The novelty of this study lies in systematically linking fundamental IHL principles—distinction, proportionality, and the prohibition of excessive force—to their qualification as war crimes under Article 8 of the Rome Statute, while critically demonstrating how political realities and institutional dependence on state cooperation undermine the effectiveness of international criminal accountability mechanisms. This research highlights the urgent need to strengthen coordination among international institutions, enhance investigative access and evidentiary reliability, and promote more consistent and impartial enforcement strategies to ensure that IHL and international criminal law operate as effective deterrents and justice-delivering instruments in contemporary armed conflicts.
