Abstract

Masalah Dalam penelitian ini menggunakan peneliatian normative dengan pendekatan kualitatif. penelitian ini bertujuan untuk memahami bagaimana desain model pengawasan hakim Mahkamah Konstitusi pasca putusan Mahkamah Konstitusi Nomor No. 49/PUU-IX/2011 serta meninjuau dengan teori check and balances dalam menakar kembali pengawasan hakim Mahkamah Konstitusi. Hasil penelitian menyimpulkan bahwa model pengawasan hakim mahkamah konstitusi saat ini yang hanya melalui pengawasan internal tidak memenuhi teori checks and balances sehingga rawan terhadap timbulnya sikap kesewenang-wenanganan oleh karenanya perlu adanya pengawasan yang lebih independen dalam mengawasi serta menindaklanjuti setiap perbuatan hakim yang dianggap bersimpangan dengan aturan yang telah ditetapkan. Maka dengan adanya hal tersebut Model pengawasan terhadap hakim Mankamah Konstitusi yang dianggap memenuhi prinsip teori checks and balances dapat dijadikan solusi dalam menangani permasalahan yang ada

Abstract

Tujuan artikel ini untuk menjelaskan peran hukum dalam mengimbangi percepatan siklus peradaban manusia agar terciptanya kehidupan yang tertib dalam suatu masyarakat. Penggunaan metode untuk membahas fokus penelitian ini menggunakan pendekatan yuridis normatif serta analisis terhadap pengaruh percepatan siklus peradaban dalam proses pembaharuan dan penegakkan hukum. Menggunakan pendekatan kualitative serta studi pustaka sebagai pengumpulan data, penulis menemukan bahwa tertinggalnya hukum dari peradaban menjadikan krisis dalam penegakkan hukum. Pada hakikatnya revolusi industri 4.0 menjadikan bergesernya pola pikir manusia dalam kehidupan dan dalam bermasyarakat. Era ini akan mempermudah berbagai aktifitas masyarakat di berbagai bidang, terutama dalam bidang teknologi. Akan tetapi tidak hanya itu efek yang ditimbulkan berpengaruh ke berbagai sektor, yaitu ranah politik, ekonomi, sosial, dan juga hukum. Selain dari hal positif masa tersebut menyimpan beberapa efek negatif, diantaranya penambahan angka pengangguran akibat tenaga manusia yang digantikan oleh tenaga mesin, kerusakan alam disebabkan eksploitasi industri, serta banyak berita yang belum jelas kebenarannya efek mudahnya akses penyebaran informasi. Implikasi dari hasil temuan ini merekomendasikan perlu adanya tindakan pemerintah untuk memperbaharui aturan dalam menanggulangi dampak negatif dari revolusi industri 4.0 tersebut

Abstract

Elections stand as a cornerstone of democracy, yet the burgeoning integration of technology and personal data underscores the pressing need for safeguarding individual privacy within the electoral process. This study endeavors to scrutinize the efficacy of the Electoral Justice System in fortifying the protection of personal data throughout the registration, verification, and adjudication phases of political party participation in the forthcoming 2024 elections. Through an empirical juridical methodology, this research delves into the practical application of the Electoral Justice System across diverse national contexts, elucidating its role in mitigating the perils of data misuse and upholding electoral integrity. The findings underscore the imperative of imbuing the Electoral Justice System with structural robustness, substantive fidelity, and a conducive legal culture to ensure the seamless functioning of electoral processes. Additionally, stringent regulations, robust data verification protocols, independent oversight mechanisms, and punitive measures emerge as indispensable facets of effective Electoral Justice System implementation, essential for curtailing infringements of the exploitation of personal data and fostering accountable electoral practices.

Abstract

Data security in the election process is a crucial aspect of maintaining integrity and public trust in democracy. The threat of electoral data leaks could have serious consequences for individual privacy and the legitimacy of election results. This article discusses steps to identify and mitigate data security threats in the 2024 election. This process begins with a thorough risk assessment to identify potential threats and data sensitivity values. Integrated solutions involve implementing end-to-end data encryption, network protection with firewalls and intrusion detection systems, and regular security system updates. The importance of security awareness training for election personnel and conducting regular security audits was also emphasized. Strict management of access rights, development of emergency response plans, and collaboration with trusted third parties are also a focus. Overall, this approach is aimed at minimizing the risk of data leaks, improving election security, and building public trust in the democratic process.

Abstract

Teknologi membawa manusia kedalam kemudahan dalam berbagai hal dan juga dengan mudah mengekspresikan karya, akantetapi muncul fenomena di masyarakat yaitu meniru, menjiplak dan mencover lagu orang lain tanpa izin yang dikomersilkan sehingga pemegang hak sangat dirugikan. Dalam Undang-undang hak cipta di Indonesia pemegang hak cipta memiliki hak ekslusif sehingga tidak sembarangan orang bisa mengkomersilkan hak cipta tersebuts. Hasil dari penelitian ini dapat disimpulkan bahwa orang yang membawakan lagu orang lain yang dikomersilkan tanpa adanya izin merupakan pelanggaran sehingga akibat hukumnya pelanggar dapat sanksi, denda bahkan sampai pembatasan konten.

Abstract

Political money practice in regional head nominations poses a serious threat to the integrity of democracy and political stability in Indonesia. Political money undermines the electoral process by prioritizing money over competence, resulting in leaders who are more focused on recovering their political investments rather than on public service. This research aims to analyze the impact of implementing criminal sanctions on political money practitioners in maintaining political stability and the quality of democracy at the regional level. The method used is normative juridical, with a legislative and conceptual approach. The research findings indicate that the application of criminal sanctions acts as a deterrent, enhances electoral integrity, strengthens public trust in democracy, reduces corruption, and promotes equal opportunities for competent candidates. However, challenges such as difficulties in proving violations and weak oversight remain obstacles to the effective implementation of sanctions. Therefore, strict and consistent law enforcement is necessary to create fair, clean, and transparent elections and to maintain local political stability.

Abstract

Catering MSMEs in Cimahi play a vital role in the local economy but still face challenges in human resource (HR) management. This study aims to analyze HR development strategies in Cimahi’s catering MSMEs based on Abraham Maslow’s theory. A qualitative approach was used, involving interviews, observations, and documentation of three catering businesses: Katering Bu Ade, Katering Dapur Teh Nunung, and Katering Barokah. The findings show different HR management approaches depending on business scale. Katering Bu Ade focuses on fulfilling employees’ basic needs without structured training. Katering Dapur Teh Nunung has introduced incentive systems and teamwork to enhance motivation. Meanwhile, Katering Barokah applies a more comprehensive HR strategy, including continuous training, reward systems, and career development opportunities. Maslow’s hierarchy of needs suggests that motivation and productivity increase when employees’ needs are met at higher levels. Therefore, HR management strategies based on Maslow’s theory can effectively improve workforce performance. This study recommends enhancing HR capabilities through training, better incentive systems, and professional HR management to boost the competitiveness of catering MSMEs in Cimahi.

Abstract

Fenomena berkembangnya sekte keagamaan menyimpang di Indonesia telah menimbulkan keresahan sosial yang signifikan, seiring dengan meningkatnya penyimpangan ajaran agama dari norma-norma hukum dan ketertiban umum. Penelitian ini bertujuan untuk menganalisis efektivitas penegakan hukum terhadap kelompok keagamaan menyimpang yang berpotensi mengancam integrasi sosial. Dengan menggunakan pendekatan yuridis normatif dan studi kasus terhadap beberapa aliran menyimpang seperti Kerajaan Ubur-ubur, Sunda Empire, Gafatar atau Al-Qiyadah Al-Islamiyah, dan Keraton Agung Sejagat, penelitian ini mengidentifikasi kelemahan dalam regulasi yang berlaku dan implementasi yang belum konsisten. Hasil penelitian menunjukkan bahwa pendekatan hukum yang bersifat represif cenderung tidak menyentuh akar masalah sosial, sehingga dibutuhkan integrasi antara regulasi hukum, edukasi sosial, dan pemetaan risiko sektarian. Kebaruan dari penelitian ini terletak pada pengajuan kerangka model penegakan hukum yang berimbang antara perlindungan hak asasi manusia dan stabilitas sosial. Kontribusinya adalah memberikan dasar konseptual bagi pembaruan kebijakan hukum dan pencegahan sektarianisme di Indonesia secara komprehensif.

Abstract

In principle, educational institutions are formal representatives who have authority over staff, students and the surrounding environment.  In contrast, principals can act as managers, supervisors, instructors, administrators, leaders, and innovators.  Improving the quality, efficacy and efficiency of education is the main goal of educational management, which is very important in implementing education.  The implementation of education needs to be carefully planned through stages which include organizing, directing, supervising and planning so that it can function smoothly and produce quality results.  This scientific research aims to determine the managerial leadership of school principals on teacher performance at HIKARI Vocational School, West Bandung Regency, as well as the principal's efforts to improve school management and increase the caliber of teacher performance at HIKARI Vocational School.  A descriptive approach and qualitative research methodology were used to write this scientific research.  The principal of Hikari Vocational School, the deputy head of curriculum and student affairs, and two teachers each served as research subjects.  This research uses documentation, interviews and observation as data collection methods.  First, research findings show that the principal of Hikari Vocational School applies a democratic leadership approach.  Second, the principal uses supervision as one of two strategies to improve the performance of his staff.

Abstract

Work environment is an aspect that can influence employee job satisfaction, a conducive work environment can increase employee effectiveness and comfort in carrying out their work. This research will discuss the relationship between the work environment and employee job satisfaction in terms of managerial support, relationships between co-workers as well as the work atmosphere and clarity of tasks at the Babi Porridge and Rice Team Mas Pandu. The research method used is qualitative with data collection techniques through direct observation and interviews with the respondents, namely the 8 employees of the Mas Pandu baby porridge and rice team. The data analysis carried out in this research used an interactive analysis method by going through 4 processes, namely, data collection, data reduction, data presentation, and drawing conclusions. The results of this research show that the managerial support that has been implemented in the Mas Pandu team's baby porridge and rice greatly influences the job satisfaction of its employees, as well as good relationships between co-workers and a positive work atmosphere and clarity in providing effective work instructions. significantly increases employee job satisfaction. In this way, employees feel satisfied with a comfortable work environment and are enthusiastic in carrying out their duties which increases work productivity, therefore every company must implement a positive work environment
