Abstract

The Indonesian government is moving towards digital transformation in land administration by introducing electronic certificates (e-certificates) through the Regulation of the Minister of ATR/BPN Number 1 of 2021. This initiative aims to improve the security and legal certainty of land ownership, building upon existing programs like the Complete Systematic Land Registration Program (PTSL). This study used a normative legal research method to investigate the opportunities and challenges associated with implementing e-certificates in Indonesia. Primary legal sources, such as the Electronic Information and Transactions Law (UU ITE) and relevant ministerial regulations, were analyzed. Secondary data from legal journals, academic publications, and theses were also examined. The study revealed that e-certificates offer several advantages, such as increased efficiency in land administration, potential integration with blockchain technology, and improved land mapping and survey processes. However, challenges remain, including cybersecurity risks, limited technological infrastructure, and the digital literacy gap. Furthermore, the legal status of e-certificates as evidence in court, while recognized by the Ministry of ATR/BPN and UU ITE, requires further clarification within the Indonesian legal framework. This study concludes that e-certificates hold the potential to modernize land administration and enhance legal certainty in Indonesia, but successful implementation requires addressing critical challenges and ensuring comprehensive legal and regulatory clarity.

Abstract

This article discusses land disputes over land use rights (HGU) between land owners and the community in the Simongan area, Semarang City. This dispute arises from a lack of legal certainty over the status of land, which has long been managed by local communities. The social, economic and legal impacts of this conflict are significant, including threats to housing, forced relocation and economic inequality. This research also highlights weaknesses in the land registration system which are often the root of problems. Using normative juridical research methods, this article proposes improvements to the land registration system, including the implementation of the Complete Systematic Land Registration (PTSL) program and digitization of land data to prevent similar disputes in the future.

Abstract

This article aims to analyze and compare land registration policies in Europe and Asia and their impact on legal certainty in both regions. The study employs a comparative method, using literature review and policy analysis focused on differences in administrative structures, technology, and community involvement in land registration systems. The main findings reveal that land registration systems in Europe, typically centralized and registry-based, provide a higher degree of legal certainty than many Asian countries, where decentralized approaches and manual methods are often used. These variations influence public trust, investment climate, and legal stability in each region. In conclusion, this study highlights the importance of technology integration and policy standardization to enhance legal certainty, particularly in Asia.

Abstract

Pendaftaran tanah di Indonesia bertujuan untuk memastikan kepastian hukum serta melindungi hak atas tanah bagi pemilik yang sah. Proses ini krusial dalam membangun stabilitas hukum, ekonomi, dan sosial melalui sertifikasi kepemilikan yang sah. Namun, implementasi pendaftaran tanah menghadapi tantangan sistematis, seperti tumpang tindih peraturan, pengakuan hak tanah adat yang belum optimal, serta potensi korupsi dan lemahnya penegakan hukum. Studi ini menggunakan metode yuridis normatif dan pendekatan deskriptif-analitis untuk menganalisis kendala tersebut serta mengidentifikasi solusi implementatif, termasuk digitalisasi sistem, peningkatan transparansi informasi, mediasi sengketa tanah, edukasi hukum bagi masyarakat, dan reformasi birokrasi. Diharapkan, reformasi ini dapat meningkatkan efisiensi dan akuntabilitas, sehingga kepastian hukum atas tanah semakin terjamin dan dapat mendukung pembangunan nasional yang berkelanjutan.

Abstract

Hak tanggungan atas tanah merupakan instrumen jaminan yang penting dalam sistem hukum Indonesia, memberikan perlindungan bagi kreditur dan debitur dalam transaksi pembiayaan. Penelitian ini bertujuan untuk menganalisis peran hak tanggungan dalam memberikan kepastian hukum, mengurangi risiko sengketa, dan mengeksplorasi fungsi notaris dalam proses pendaftaran hak tanggungan. Proses pendaftaran hak tanggungan di Badan Pertanahan Nasional (BPN) adalah langkah kunci yang menciptakan legitimasi atas status hukum objek jaminan. Notaris, sebagai pejabat publik yang berwenang, memiliki tanggung jawab dalam menyusun Akta Pemberian Hak Tanggungan (APHT), yang merupakan dokumen formal dasar untuk pendaftaran. Penelitian ini menunjukkan bahwa notaris berperan penting dalam memastikan keabsahan dokumen, memverifikasi identitas para pihak, dan menjaga integritas proses hukum. Penelitian ini menegaskan bahwa ketelitian dan kepatuhan terhadap ketentuan hukum sangat penting bagi notaris untuk mencegah konflik di masa depan. Kesimpulan dari penelitian ini menyatakan bahwa pendaftaran hak tanggungan yang melibatkan notaris menciptakan stabilitas ekonomi dan kepastian hukum di Indonesia. Melalui pengaturan yang jelas dan pelaksanaan yang baik, hak tanggungan berfungsi sebagai alat efektif dalam meningkatkan akses ke modal dan kepercayaan dalam sistem keuangan, berkontribusi pada pertumbuhan ekonomiyang berkelanjutan. Penelitian ini mengungkapkan bahwa kolaborasi antara pihak-pihak yang terlibat sangat diperlukan untuk memastikan efektivitas hak tanggungan dalam praktik
