Abstract

The Indonesian government is moving towards digital transformation in land administration by introducing electronic certificates (e-certificates) through the Regulation of the Minister of ATR/BPN Number 1 of 2021. This initiative aims to improve the security and legal certainty of land ownership, building upon existing programs like the Complete Systematic Land Registration Program (PTSL). This study used a normative legal research method to investigate the opportunities and challenges associated with implementing e-certificates in Indonesia. Primary legal sources, such as the Electronic Information and Transactions Law (UU ITE) and relevant ministerial regulations, were analyzed. Secondary data from legal journals, academic publications, and theses were also examined. The study revealed that e-certificates offer several advantages, such as increased efficiency in land administration, potential integration with blockchain technology, and improved land mapping and survey processes. However, challenges remain, including cybersecurity risks, limited technological infrastructure, and the digital literacy gap. Furthermore, the legal status of e-certificates as evidence in court, while recognized by the Ministry of ATR/BPN and UU ITE, requires further clarification within the Indonesian legal framework. This study concludes that e-certificates hold the potential to modernize land administration and enhance legal certainty in Indonesia, but successful implementation requires addressing critical challenges and ensuring comprehensive legal and regulatory clarity.

Abstract

Digital transformation of land registration is an important step in improving efficiency and transparency in land asset management. This research analyzes the challenges and effectiveness of implementing the “sentuh tanahku” application in the context of Society 5.0, where technology plays a crucial role in improving social interaction and public services. The research method used includes qualitative analysis through interviews with users and application managers, as well as literature study. The results show that although the application is able to speed up the registration process and reduce bureaucracy, challenges such as the lack of digital literacy among the community and uneven technological infrastructure are still significant obstacles. However, the app's effectiveness in providing better access to information and simplifying land transactions is expected to support the realization of Society 5.0 which focuses on collaboration between humans and technology. This research includes discussions on improving digital training for users and strengthening infrastructure to support the sustainability of this transformation.

Abstract

This article examines the procedural review of legal protection for taxpayers in filing objections to the Land and Building Rights Acquisition Duty (BPHTB). Legal protection for taxpayers is essential to ensure administrative justice and provide a guarantee of rights for those who dispute the BPHTB value determined by the authorities. This study highlights the stages of the objection procedure, the rights and obligations of taxpayers, and the role of the tax court in dispute resolution. Using a normative juridical approach, the article identifies shortcomings in the procedural system that may hinder access to justice for taxpayers. The findings reveal that a more transparent procedure and robust protection mechanisms are essential to safeguard taxpayers' rights in BPHTB dispute resolution.

Abstract

Artikel ini bertujuan untuk menganalisis penerapan Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) dalam program Pendaftaran Tanah Sistematis Lengkap (PTSL) di Indonesia. Latar belakang penelitian ini adalah kebutuhan untuk memastikan pelaksanaan hukum agraria yang akurat dan transparan, khususnya terkait pendaftaran tanah dan pengenaan pajak. BPHTB merupakan instrumen fiskal penting yang mencerminkan komitmen pemerintah terhadap pendaftaran tanah yang terstruktur, sejalan dengan kebijakan publik yang adil dan transparan. Namun, terdapat tantangan dalam penerapan BPHTB, karena praktik yang tidak konsisten dan ketidakjelasan regulasi dapat menyebabkan penegakan yang tidak efisien dan beban pajak yang tidak adil bagi pemilik tanah. Dengan menggunakan pendekatan yuridis normatif, studi ini menelaah regulasi yang ada dan sumber-sumber hukum resmi untuk mengevaluasi peran dan dampak BPHTB dalam program PTSL. Penelitian ini menekankan pentingnya pedoman yang jelas dan penegakan yang adil untuk menjamin kepastian hukum dan kepercayaan publik dalam pelaksanaan hukum agraria. Penyempurnaan kebijakan BPHTB dalam PTSL sangat penting untuk mendukung pendaftaran tanah yang sistematis, sah secara hukum, dan berkeadilan sosial.

Abstract

The sustainability of the agribusiness sector is very dependent on the certainty of land rights, which is the main asset for business actors in this sector. Land registration is an important instrument in providing legal certainty for land ownership, which can ultimately encourage stable and sustainable agribusiness development. This article discusses the role of land registration in protecting ownership rights for agribusiness actors in Indonesia and analyzes the role of government policies, such as the Complete Systematic Land Registration Program (PTSL), in speeding up the land certification process. With legal certainty obtained through land certificates, agribusiness actors can avoid agrarian conflicts, gain access to financing, and run businesses more safely and in a planned manner. Apart from that, land registration policies also have the potential to support regional economic development, reduce agrarian conflicts, and encourage sustainable management of land resources. However, implementing this policy still faces challenges, including bureaucratic obstacles and low public understanding. Therefore, the government's role in improving policies and overcoming existing obstacles is very necessary to create an inclusive, competitive and sustainable agribusiness sector in Indonesia.

Abstract

Tanah memiliki posisi strategis sebagai sumber daya utama yang mengandung nilai ekonomi, sosial, dan kultural yang signifikan bagi masyarakat Indonesia. Meski demikian, pengelolaan agraria di Indonesia masih menghadapi berbagai tantangan, terutama sengketa pertanahan antara masyarakat, pemerintah, dan sektor korporasi. Artikel ini bertujuan untuk menelaah peran lembaga non-pemerintah (LNP) sebagai mitra strategis pemerintah dalam penyelesaian sengketa agraria dengan mengidentifikasi faktor internal dan eksternal yang memengaruhi efektivitasnya. Penelitian ini menggunakan pendekatan kualitatif melalui studi literatur terhadap peraturan perundang-undangan, kebijakan publik, dan karya ilmiah terkait hukum pertanahan. Hasil kajian menunjukkan bahwa optimalisasi peran LNP sangat bergantung pada penguatan kapasitas sumber daya manusia, tata kelola kelembagaan, kemandirian finansial, serta kemampuan advokasi dan mediasi. Sementara itu, efektivitas LNP dipengaruhi oleh dukungan kebijakan publik, keterbukaan pemerintah, serta dinamika sosial politik di tingkat lokal. LNP berperan sebagai jembatan komunikasi antara negara dan masyarakat dalam mendorong penyelesaian sengketa secara partisipatif serta memperkuat keadilan substantif dalam sistem agraria nasional. Dengan demikian, kolaborasi antara LNP, pemerintah, dan masyarakat menjadi faktor kunci dalam mewujudkan keadilan dan kepastian hukum agraria yang berkelanjutan di Indonesia.
