Abstract

The aim of this research is to find out what positive legal views in Indonesia are regarding child maintenance rights after divorce due to domestic violence. This study conducted in order to know whether positive law in Indonesia regulates how children are cared for due to domestic violence, therefore the author looked for information related to this problem through books and also trusted journals, so that the information the author obtained could be used as information. A reference for learning how positive law in Indonesia regulates these problems. The research method that the author uses is qualitative (theoretical), where the author conducts research on books that discuss child care rights, and also on domestic violence, and the author also conducts research on journals and the internet, regarding these problems, and how positive law is applied. Indonesia regulates this problem. The results of this research explain that according to the compilation of Islamic law, Article 105 letter (a) regulates that the care of children who are not mumayyiz or who are not yet 12 years old is the right of the mother. Article 45 of Law Number 1 of 1974 states that parents are obliged to care for and educate their children as best as possible until the child marries or becomes independent, and this obligation will continue to apply. And based on law Number 23 of 2002 concerning Child Protection also states the rights and obligations of children, in this law child protection is given greater priority.

Abstract

Zakat fitrah merupakan kewajiban ibadah sosial yang memiliki fungsi spiritual sekaligus ekonomi dalam sistem Islam. Meskipun secara tekstual zakat fitrah disalurkan menjelang Idul Fitri, pendekatan tradisional yang bersifat konsumtif telah dikritisi oleh berbagai ulama dan lembaga keagamaan, termasuk Majelis Tarjih Muhammadiyah. Fatwa yang dihasilkan dalam Musyawarah Nasional Tarjih ke-31 pada tahun 2020 merekomendasikan pendistribusian zakat fitrah yang dapat didistribusikan sepanjang tahun, dan juga diarahkan pada pemberdayaan ekonomi mustahik melalui model zakat produktif. Penelitian ini bertujuan untuk mengkaji secara kontekstual distribusi zakat fitrah berdasarkan pandangan fikih klasik, fatwa Majelis Tarjih Muhammadiyah, dan teori keadilan distributif Yusuf al-Qaradawi. Metode yang digunakan adalah studi pustaka (library research) dengan pendekatan kualitatif dan teknik content analysis terhadap literatur fikih klasik dan kontemporer. Hasil penelitian menunjukkan bahwa distribusi zakat fitrah secara produktif memiliki justifikasi fikih dari mazhab Hanafiyah, serta relevansi sosial dalam konteks kemiskinan struktural di Indonesia. Fatwa Tarjih menjadi instrumen normatif yang mendorong reformasi distribusi zakat, dengan menekankan aspek pemberdayaan ekonomi mustahik dan penguatan fungsi sosial zakat.

Abstract

This study aims to analyze the values of Maqashid Syari’ah contained in prenuptial agreements and their urgency in fostering harmonious households. The research employs a normative juridical approach through library research, utilizing primary data from statutory regulations such as Law No. 1 of 1974 on Marriage, the Civil Code, the Compilation of Islamic Law (KHI), and related provisions. Secondary data were obtained from literature and academic studies concerning Maqashid Syari’ah and Islamic family law. The results indicate that prenuptial agreements align with the principles of al-kulliyat al-khamsah, namely the protection of religion, intellect, life, lineage, and property. Implementing prenuptial agreements can prevent disputes, safeguard spousal rights, and create families imbued with sakinah, mawaddah, and rahmah. The study recommends wider socialization of prenuptial agreements, emphasizing their role in preserving household welfare rather than merely separating assets.

Abstract

This study aims to determine the concept of Islamic education reform of KH. Ahmad Dahlan and its implementation in modern Islamic education. This research uses concept analysis from various works of K.H. Ahmad Dahlan and materials that become primary sources and secondary sources in various studies, then connected and analyzed through the content analysis process. This research has concluded that KH. Ahmad Dahlan's efforts to renew Islamic education were carried out among others by uniting traditional-based education systems and modern education systems, collaborating religious sciences and general sciences, and integrating Islamic religious education and general education which includes aspects of curriculum, methods and institutions. KH. Ahmad Dahlan also put forward five concepts, namely pragmatic, progressive, pedagogical, social which were applied in the Muhammadiyah  organization. This research can be a scientific treasure in the treasures of Islamic education reform
