Abstract

Penerapan prinsip syariah dalam pengelolaan zakat secara umum dimuat dalam Undang-Undang No. 23 Tahun 2011 tentang Pengelolaan Zakat. Salah satu dari pengelolaan zakat yang harus diimplementasikan adalah asas transparansi. Sedangkan sebagai bentuk jaminan konstitusional terhadap hak atas keterbukaan informasi publik, transparansi atas penyelenggaraan fungsi pelayanan di Indonesia ditetapkan melalui UU Nomor 14 Tahun 2008. Oleh karena itu, penelitian ini bertujuan untuk menganalisis asas transparansi dalam pengelolaan zakat melalui perspektif maqashid syariah dan mengevaluasi kesesuaian asas transparansi dengan UU Nomor 14 Tahun 2008. Penelitian ini merupakan penelitian kualitatif dengan pendekatan normatif yuridis. Sedangkan pengumpulan data dilakukan melalui literatur riview atau kepustakaan pada konsep maqashid syariah dan perundang-undangan terkait. Adapun hasil penelitian ditemukan bahwa asas transparansi dalam pengelolaan zakat merupakan kewajiban yang bersifat normatif dan sesuai dengan syariat. Hal ini tercantum sebagaimana Pasal 9 sampai dengan Pasal 11 UU Nomor 14 Tahun 2008 yang mewajibkan bagi lembaga zakat agar menyediakan informasi publik baik laporan keuangan maupun laporan kegiatan. Selain itu transparansi juga merupakan pengejawantahan dari maqashid syariah melalui penguatan etika, pemenuhan hak mustahik, pencegahan penyelewengan dana, edukasi publik dan distribusi yang adil dan berkelanjutan.

Abstract

This study aims to analyze the values of Maqashid Syari’ah contained in prenuptial agreements and their urgency in fostering harmonious households. The research employs a normative juridical approach through library research, utilizing primary data from statutory regulations such as Law No. 1 of 1974 on Marriage, the Civil Code, the Compilation of Islamic Law (KHI), and related provisions. Secondary data were obtained from literature and academic studies concerning Maqashid Syari’ah and Islamic family law. The results indicate that prenuptial agreements align with the principles of al-kulliyat al-khamsah, namely the protection of religion, intellect, life, lineage, and property. Implementing prenuptial agreements can prevent disputes, safeguard spousal rights, and create families imbued with sakinah, mawaddah, and rahmah. The study recommends wider socialization of prenuptial agreements, emphasizing their role in preserving household welfare rather than merely separating assets.

Abstract

In principle, everyone wants a normal and acceptable life in social life. Human beings naturally follow the rules of people's lives, including the rules in family life, but the social environment, position, social status, and experience can change a person. Similarly, in married life, the original situation can be so harmonious that it can turn into conflicts and quarrels when the husband commits an act of infidelity and the wife does the opposite. This reality is sometimes difficult to overcome, in fact, not a few households end up divorced. The author feels the need to raise the issue of infidelity as the reason for divorce in the South Jakarta religious court where there are still many lawsuits filed by both wives and husbands. This type of research is qualitative research or field research with a juridical and non-juridical approach, namely by conducting a search for the study of Law No. 1 of 1974 concerning marriage and also looking at the mutual benefits of the decision of the Panel of Judges. The results of the study show that: First, the ban on divorce in the South Jakarta Religious Court has several factors, including economic factors, moral crisis, and also infidelity factors. Second, the consideration of the Panel of Judges in deciding case No.503/Pdt.G/2019/PA.JS is to look at the facts at the trial, if the plaintiff's lawsuit can be proven correctly, it becomes the consideration of the Panel of Judges in deciding the case.

Abstract

Fenomena relasi gender dalam masyarakat modern seringkali masih disalahpahami, baik karena pengaruh budaya patriarki maupun karena minimnya pemahaman mendalam terhadap nilai-nilai Islam yang adil dan seimbang. Pengabdian masyarakat ini bertujuan untuk mensosialisasikan konsep relasi gender dalam Islam kepada remaja dan pemuda usia nikah agar mereka memiliki pemahaman yang benar dan berperspektif Qur’ani dalam membangun rumah tangga. Kegiatan dilaksanakan dalam bentuk seminar interaktif, diskusi kelompok, dan simulasi peran yang menekankan kesetaraan hak dan kewajiban antara laki-laki dan perempuan sesuai dengan prinsip Islam. Hasil kegiatan menunjukkan bahwa peserta mengalami peningkatan pemahaman terhadap makna relasi gender yang harmonis, serta menunjukkan kesiapan lebih tinggi dalam membentuk keluarga yang sakinah, mawaddah, wa rahmah. Program ini direkomendasikan untuk direplikasi di berbagai komunitas sebagai bagian dari pendidikan pranikah berbasis nilai Islam.

Abstract

Imam Ibn Taymiyyah was a great scholar with the title of Shaykhul Islam who played a role in purifying the teachings of Islam from khurafat and deviations. However, he never married in his life. This thesis discusses Imam Ibn Taymiyyah's views on the law of marriage and tabattul in Islam through library research. This research formulates two main problems: 1) Imam Ibn Taymiyyah's opinion on the law of marriage, and 2) His view on tabattul. The aim is to describe the law of marriage and tabattul in his thought based on existing sources. The results show that according to Imam Ibn Taymiyyah, the law of marriage is basically sunnah, in line with the opinion of the majority of scholars. If someone is worried about falling into adultery, marriage is preferred to the obligatory Hajj. Marriage is seen as a means of maintaining personal chastity and fulfilling human nature. Meanwhile, tabattul, which is the attitude of avoiding marriage absolutely, is not recommended because Allah SWT has ordered marriage as a good for His servants. Imam Ibn Taymiyyah emphasized that avoiding marriage without a justifiable reason could mean forbidding something that Allah has already legalized. Therefore, Islam recommends marriage as part of worship and a more perfect life.
