Abstract

Every worker as an Indonesian citizen has the desire to get a decent and prosperous life and get a decent job. A prosperous life can be achieved through the implementation of obligations as workers, the mandate is contained in Article 27 paragraph (1) of the 1945 Constitution of the Republic of Indonesia which states: "Every citizen has the right to work and a decent livelihood for humanity." And in Article 28D paragraph (2): "Everyone has the right to work and receive fair and proper remuneration and treatment in employment relations." The legal issue of this normative legal research: How are labor rights regulated? What is the wage policy for workers? The regulation of labor rights in the Job Creation Law, which is regulated in Law Number 6 of 2023 concerning Government Regulation in Lieu of Law No. 2 of 2022 concerning Job Creation into Law, includes several important aspects that aim to provide certainty and protection for workers. The Job Creation Law stipulates certainty regarding rights and obligations for workers and companies, including arrangements regarding wages, working hours, and leave. The arrangement is expected to build a harmonious working relationship and in accordance with applicable laws and regulations. Wage policies, especially regulated in the Labor Law, have the purpose of protecting workers' rights and ensuring welfare. That regarding wage policies for workers in the form of minimum wages, wage components, protection of workers' rights and labor welfare.

Abstract

Voter education is an important instrument in realizing a quality and sustainable democracy. Through the process of voter education socialization, it is hoped that the public can understand in depth their rights and obligations in the implementation of elections, as well as encourage active and responsible participation in the democratic process. Citizen participation in democratic social life must be based on adequate knowledge, critical reflection, and awareness of the rights and responsibilities as voters. A good understanding of the effectiveness of voter education socialization can shape a critical, rational, and independent attitude in exercising the right to vote, thereby strengthening the foundations of a clean and integrity-based democracy. This community service was carried out in the Selogiri District, Wonogiri Regency, with the aim of providing political education to the public regarding the importance of participation in the 2024 simultaneous regional head elections. Through a Participatory Action Research (PAR) approach, the community was actively involved as subjects in the activity process, not just as objects receiving information. Community service activities are carried out by integrating outreach into various village events, aimed at attracting residents to attend, interact, and directly discuss local political issues and forms of participation in the regional elections. Through these activities, it is hoped that the community will have a more comprehensive understanding of the importance of their role in determining the direction of regional policy through the regional elections. This education is also expected to raise awareness to vote based on conscience, without intervention or negative influences such as money politics, which has been a major challenge in every election at both the central and regional levels.

Abstract

This study examines the fulfillment of remission rights for drug offenders in Indonesia following the enactment of Government Regulation No. 99 of 2012, which introduced restrictive provisions inconsistent with the rehabilitative vision of Law No. 12 of 1995. The research problem lies in the normative contradiction between correctional laws oriented toward behavioural reform and derivative regulations that prioritise punitive measures. The study aims to evaluate the implementation of remission regulations and their alignment with principles of justice and human rights. Employing a normative legal research design, it analyses statutes, judicial decisions, doctrines, and comparative law. Findings reveal that remission has shifted from a universal right to a conditional privilege, disproportionately affecting low-level drug offenders, exacerbating prison overcrowding, and weakening legal certainty. The study concludes that policy reform is necessary through individualised assessments, restorative justice integration, independent oversight, and regulatory harmonisation to restore fairness and uphold human rights.

Abstract

Penelitian ini membahas penegakan hukum terhadap tindak pidana penggelapan apartemen yang kerap terjadi dalam transaksi jual beli atau pengelolaan rumah susun. Kasus ini umumnya melibatkan pengembang, pengelola, atau pihak lain yang secara melawan hukum menguasai atau mengalihkan hak atas apartemen milik orang lain. Permasalahan utama penelitian ini adalah bagaimana pengaturan hukum mengenai tindak pidana penggelapan apartemen menurut Kitab Undang-Undang Hukum Pidana (KUHP) dan peraturan perundang-undangan di bidang rumah susun, serta bagaimana penerapan sanksi pidana oleh aparat penegak hukum dalam menyelesaikan kasus tersebut. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan menelaah bahan hukum primer berupa KUHP, KUHAP, Undang-Undang Nomor 20 Tahun 2011 tentang Rumah Susun, serta putusan pengadilan terkait. Bahan hukum sekunder diperoleh dari buku, jurnal, dan pendapat ahli hukum pidana properti. Hasil penelitian menunjukkan bahwa penggelapan apartemen termasuk ke dalam delik penggelapan sebagaimana diatur dalam Pasal 372 KUHP, dan dalam praktiknya dapat pula dikenakan pasal lain apabila terkait dengan penyalahgunaan jabatan atau perjanjian. Penegakan hukum dilakukan melalui proses penyidikan, penuntutan, dan pemeriksaan di pengadilan, namun terdapat kendala seperti pembuktian kepemilikan, kompleksitas hubungan perdata-pidana, serta rendahnya kesadaran hukum para pihak. Penelitian ini merekomendasikan adanya harmonisasi regulasi antara hukum pidana dan hukum properti, peningkatan koordinasi antar penegak hukum, serta edukasi kepada masyarakat mengenai perlindungan hak kepemilikan apartemen.

Abstract

The fintech business of peer-to-peer lending has experienced a period of considerable growth in recent years. However, it is still the subject of debate and controversy from the perspective of Sharia law. This article aims to analyze Sharia law on fintech peer-to-peer lending businesses, with a particular focus on usury and gharar banking. The methodology employed in this study is descriptive and analytical in nature. This entailed the collection of data from a range of sources, including literature, legal documents, and expert opinions. The findings indicate that the peer-to-peer lending fintech business can be classified as usury and gharar due to the implementation of several practices by the platform, including high interest rates and a lack of transparency regarding the associated risks. From the perspective of Sharia law, usury and gharar are prohibited, as they contravene the principles of justice and balance. Consequently, fintech peer-to-peer lending businesses must adhere to the tenets of Shariah law, such as abstaining from exorbitant interest rates and ensuring transparency regarding risks. In conclusion, fintech peer-to-peer lending businesses must be meticulously analyzed from the perspective of Shariah law to ensure their halalness in Islam. It is also imperative for the government and regulators to prioritize Shariah law aspects in regulating fintech peer-to-peer lending businesses
