Abstract

The agricultural sector is a vital component of a nation's economy as it provides food supplies and serves as a source of livelihood for millions of people. In the context of Indonesia, with its predominantly Muslim population, the significance of the agricultural sector has grown alongside the increasing demand for halal raw materials. However, the implementation of agricultural political economy policies to support the provision of halal raw materials faces several challenges, including farmers' lack of understanding of halal standards, dependence on imported raw materials, and limited infrastructure and technology. This study employs a qualitative approach using library research methods to analyze the contribution of agricultural political economy policies in supporting the provision of halal raw materials, including identifying relevant challenges and solutions. The findings reveal that policies such as agricultural land protection, fertilizer subsidies, and the development of halal industrial zones have provided a robust foundation for establishing a halal agricultural ecosystem. Nonetheless, strategic measures, such as educating farmers, enhancing local production, and investing in modern technology, remain necessary to overcome the existing obstacles. This study concludes that adaptive and inclusive agricultural political economy policies can strengthen the role of the agricultural sector in sustainably supporting the availability of halal raw materials while simultaneously enhancing the competitiveness of Indonesia's halal products in global markets.

Abstract

This study examines legal issues related to the execution of collateral auctions in the case of Decision No. 1650/Pdt.G/2017/PA.Mks, where a customer sued the bank, alleging harm caused by the determination of the auction’s reserve price, which was deemed too low and lacked transparency. The main issue addressed is how the court assessed the lawsuit and to what extent the auction procedures complied with the applicable legal provisions. The purpose of this study is to analyze the reasons behind the customer’s perception of harm due to the auction procedures and how the court adjudicated the dispute. The research employs a normative legal method with a literature study approach. The data sources include court decisions, journal articles, legal textbooks, and relevant regulations, such as the Law on Mortgage Rights and the Ministry of Finance Regulations on auction implementation. The findings indicate that the customer's lawsuit was declared inadmissible (Niet Ontvankelijk Verklaard) due to the court's lack of absolute jurisdiction over the dispute. Additionally, the bank's execution of the auction was found to be in compliance with the applicable legal provisions. This study underscores the importance of customers understanding legal procedures and arbitration clauses in Islamic contracts, as well as the need for greater transparency in the execution of auctions by Islamic financial institutions.

Abstract

This study aims to analyze the challenges faced by halal supervisors in Indonesia and examine the role of professional ethics in addressing these challenges. The study employs a qualitative approach with a literature review method, gathering data from various sources such as scholarly journals, books, and official documents. The analysis is conducted descriptively and analytically to understand the relevance of professional ethics in supporting the duties of halal supervisors. The findings indicate that the application of professional ethics, which includes values such as honesty (shiddiq), trustworthiness (amanah), professionalism (fathanah), and sincerity, serves as a primary solution in overcoming various challenges faced by halal supervisors in Indonesia's halal industry. These ethical principles not only preserve the integrity of halal supervisors but also provide concrete guidance in addressing moral dilemmas, such as pressures to relax halal standards and conflicts of interest. The ethical values outlined in SKKNI No. 215 of 2016, such as accuracy, precision, independence, and objectivity, assist halal supervisors in performing their duties to high standards, ensuring product halalness, and maintaining transparency in decision-making. While technical training is important, this study emphasizes the need for training programs that integrate the strengthening of ethical values and real-case simulations to prepare halal supervisors for more complex challenges. Thus, professional ethics plays a strategic role not only in supporting the execution of halal supervisors' duties but also in reinforcing public trust in halal products in Indonesia.

Abstract

The rapid development of the Islamic economy in Indonesia has given rise to various legal disputes that require special attention, particularly those related to the execution of mortgage rights in Islamic banking. These disputes are often complex, involving considerations of both Sharia principles and prevailing positive law. This research aims to analyze Decision No. 456/Pdt.G/2018/PA.Gtlo along with its related appeal and cassation decisions, to understand the dynamics and implications of such disputes. A case study approach is employed in this normative legal research methodology, with primary data in the form of court decisions were qualitatively analyzed. The research findings reveal a consistent pattern in court decisions, across the first instance, appeal, and cassation levels, rejecting the lawsuit for the annulment of mortgage execution. This rejection is based on several reasons, including formal defects in the filing of the lawsuit, the prohibition of retrying a case (ne bis in idem), and limitations on the scope of cassation review. These findings emphasize the importance of a deep understanding of the legal procedures applicable to disputes in Islamic economics, especially in the context of mortgage execution. Misunderstanding or negligence in fulfilling legal procedures can have serious consequences, such as the rejection of a lawsuit and losses for the disputing parties. Furthermore, this research highlights the importance of carefulness in filing lawsuits, particularly concerning formal and substantive aspects, to avoid unnecessary retrials.
