Abstract

Openness of public information is an important principle in transparent and accountable government. Openness of information also allows citizens to understand the problems faced by the government and how proposed policies may affect their lives. This research describes the resolution of public information disclosure disputes starting from the Information Commission up to the Cassation level at the PTUN. The approach method used in this research is normative juridical research. This research explains the procedures for resolving public information disputes at the PTUN using the litigation adjudication process regulated by Law Number 14 of 2008 concerning Openness of Public Information and PERMA RI Number 2 of 2011 concerning Procedures for Resolving Public Information Disputes in Court.

Abstract

Fishing licence (SIPI) is one of the things that must be owned by fishermen in fishing in Indonesian waters. In Article 27 paragraph (1) of Law Number 45 of 2009 concerning Fisheries, it is stated that every person who owns and/or operates an Indonesian-flagged fishing vessel used for fishing in the fisheries management area of the Republic of Indonesia and/or the high seas must have a SIPI.Dharma Tanjung Village, Camplong Subdistrict is one of the fisheries areas among the fisheries areas on Madura Island, the people in Camplong Subdistrict are known for their profession as fishermen, especially in Tanjung Village and Pandian Village. The fishing gear used are gill nets and traditional fishing rods and the factors that are thought to affect fishing production using gill net boats are fishing trips, ship engine size, amount of fuel, size of fishing gear and labour and the biggest influencing factor is the trawl gear used by fishermen in Tanjung Village. Many fishermen of Dharma Tanjung Village, Sampang who have ships with a size of 5 gross tonnes still do not have SIPI. so it is necessary to have counselling about the importance of fishermen to have SIPI.

Abstract

Restoration for victims of criminal acts is an essential aspect of the judicial system that is often overlooked. Law enforcement efforts tend to focus on perpetrators, while victims' rights, including physical, psychological, and financial recovery, remain neglected. The case of Een's murder and arson serves as an example where restitution and compensation rights were not clearly accommodated in legal proceedings. This article aims to examine the legal procedures available to victims or their families in obtaining restoration rights. The discussion includes criminal law aspects such as restitution and compensation based on Law No. 13 of 2006 jo. Law No. 31 of 2014 on Witness and Victim Protection, as well as the Criminal Procedure Code (KUHAP). Additionally, this article highlights the civil law route through lawsuits based on Article 1365 of the Civil Code regarding unlawful acts (KUHAPER). With a normative juridical approach and internship experience at the Legal Consultation and Assistance Clinic of Trunojoyo Madura University, this article is expected to contribute to strengthening victims' rights within the Indonesian legal system through the available legal avenues, both criminal and civil.

Abstract

Sexual harassment cases in university environments have become a serious issue that not only harms victims physically and psychologically but also undermines academic and humanitarian values. This article aims to analyze the implementation of legal aid services in addressing criminal acts of sexual harassment within higher education institutions, particularly in terms of victim protection, legal assistance, and the restoration of victims’ rights. This study employs an empirical or socio-legal approach by examining existing legal regulations and the practical implementation of legal services by campus-based legal aid institutions. The findings reveal that although several universities have established task forces or sexual violence service units, their implementation still faces challenges such as limited resources, low legal awareness, and a prevailing culture of silence among students. Therefore, institutional strengthening, continuous awareness campaigns, and victim-centered campus policies are necessary to ensure comprehensive access to justice. Legal aid services must not only be reactive but also preventive and educational, as part of a broader effort to create a safe and violence-free academic environment.

Abstract

Penelitian ini menganalisis implementasi hak inisiatif DPRD Kabupaten Sidoarjo dalam pembentukan peraturan daerah. Hak inisiatif sebagai kewenangan konstitusional DPRD berdasarkan Pasal 150 huruf b UU Nomor 23 Tahun 2014 menjadi indikator penting dalam mengukur fungsi representasi lembaga legislatif. Metode penelitian yang digunakan adalah yuridis empiris melalui studi dokumen dan observasi lapangan. Temuan penelitian mengungkapkan bahwa secara normatif kerangka hukum telah memberikan landasan yang kuat bagi pelaksanaan hak inisiatif DPRD. Namun dalam praktiknya, implementasi hak inisiatif di Kabupaten Sidoarjo masih menghadapi berbagai kendala substantif. Terdapat tiga faktor penghambat utama yaitu pertama, konsistensi political will anggota dewan yang masih fluktuatif kedua, kapasitas teknis penyusunan peraturan yang belum optimal dan ketiga, mekanisme partisipasi publik yang belum berjalan secara substantif. Berdasarkan temuan tersebut, penelitian ini merekomendasikan tiga strategi penguatan yaitu optimalisasi peran kelembagaan DPRD melalui penegasan posisi sebagai mitra setara dengan eksekutif, peningkatan kapasitas anggota dewan melalui program penguatan kompetensi yang terstruktur, dan restrukturisasi kelembagaan DPRD dengan penguatan sekretariat dan perangkat pendukung. Implementasi strategi ini diharapkan dapat meningkatkan efektivitas hak inisiatif DPRD sehingga mampu menghasilkan peraturan daerah yang responsif terhadap kebutuhan masyarakat dan mendukung tata kelola pemerintahan daerah yang lebih baik.
