Abstract

Fenomena cancel culture di media sosial telah memicu perdebatan yang intens mengenai kebebasan berpendapat dan keadilan sosial. Penelitian ini bertujuan untuk mengkaji fenomena cancel culture dari perspektif fiqih siyasah serta bagaimana fiqih siyasah memandang cancel culture dalam konteks kebebasan berpendapat dan keadilan sosial. Penelitian ini menggunakan metode studi kasus deskriptif kualitatif dengan pendekatan sosiologis dan normatif. Data primer dikumpulkan dari konten media sosial terkait kasus Umay Shahab, sementara data sekunder diperoleh dari literatur dan penelitian sebelumnya. Hasil penelitian menunjukkan bahwa cancel culture dapat merusak reputasi individu dan menimbulkan dampak psikologis yang serius. Dalam perspektif fiqih siyasah, kebebasan berpendapat harus diimbangi dengan tanggung jawab moral dan sosial, serta tidak boleh merugikan orang lain secara tidak adil. Prinsip-prinsip keadilan, maslahah, syura, dan peluang untuk bertobat dalam Islam menyediakan kerangka kerja yang komprehensif untuk memahami dan menilai fenomena cancel culture ini. Kesimpulan dari penelitian ini adalah bahwa praktik cancel culture yang berlebihan dapat bertentangan dengan prinsip-prinsip keadilan dalam Islam dan dapat menyebabkan ketidakstabilan sosial yang signifikan.

Abstract

Pengangkatan anak merupakan praktik yang telah dikenal di berbagai budaya dan sistem hukum, termasuk dalam Islam. Studi ini bertujuan untuk menganalisis konstruksi hukum Islam tentang pengangkatan anak (adopsi) serta mengidentifikasi implikasi sosial yang timbul darinya. Dalam perspektif hukum Islam, pengangkatan anak diperbolehkan dengan syarat-syarat tertentu, seperti menjaga garis nasab, nama keluarga, dan hak waris anak angkat. Prinsip utama yang ditekankan adalah perlindungan terhadap hak-hak anak tanpa melanggar aturan syariat. Implikasi sosial dari pengangkatan anak dalam masyarakat Muslim meliputi tantangan dalam menjaga identitas anak angkat, seperti aspek psikologis, sosial, dan hukum. Selain itu, praktik ini dapat memberikan dampak positif terhadap kesejahteraan anak yatim atau terlantar, dengan memastikan hak mereka atas pengasuhan dan perlindungan terpenuhi. Namun, sering kali terjadi miskonsepsi di masyarakat, seperti menyamakan anak angkat dengan anak kandung dalam hal warisan, yang berpotensi menimbulkan konflik hukum dan sosial. Penelitian ini menegaskan pentingnya kesadaran masyarakat terhadap hukum Islam dalam pengangkatan anak, agar praktik ini dapat dilaksanakan secara syar’i serta memberikan manfaat sosial yang optimal. Dengan pendekatan yang sesuai, pengangkatan anak dapat menjadi solusi humanis yang tetap selaras dengan nilai-nilai Islam.

Abstract

The following article highlights how fiqh as a science is developed in the context of the dynamics and demands of humanitarian issues in the contemporary era. The main issue raised in this paper is how the reformulation of fiqh as a science can provide solutions and contribute to solving humanitarian problems such as human rights, the environment, the democratic system, local wisdom and others? To answer these various humanitarian problems, this paper starts from the framework of thought that fiqh as a science in addition to exploring its religious knowledge also needs to be integrated with the humanitarian sciences related to humanitarian issues that are developing at this time. In this way, it is expected that a fiqh study like this will be responsive and a solution to contemporary humanitarian issues. The approach used in this paper is a philosophy of science, history and deconstruction and reconstruction approach to the work of fiqh as science. Based on the results of studies that conducted, it can be concluded that for the development of fiqh as a science, a theoretical device is needed that requires the support of the human sciences that are developing in the contemporary era. That way, the model of fiqh studies with related human sciences is integrative that is multidisciplinary, interdisciplinary or even transdisciplinary.

Abstract

Islam has no a complete and ready-made political system and governance, including the discussion about the political dynasty. The phenomenon of political dynasties has occurred in Islamic history, also in Indonesia, in reform era from the regional to national level. If seen in legal aspect, there is no any policy prohibiting the practice of political dynasty in Indonesia, but if this still continues, it can threaten the sustainability of the Indonesian government and damage the substance of democracy as a system used in governance. This study aims to explain how the practice of political dynasty in Indonesia during the reform era and to explain how contemporary Siyasah Fiqh perspective,  which in this case uses Muhammad Abid Al-Jabiri’s political reasoning thoughts on the practice of political dynasties in Indonesia. The research method used in this research was library research that is by collecting data and information through the study of various library materials as research sources. The analysis technique in this study used content analysis. The results of this study showed that the practice of political dynasty in Indonesia has emerged any issues from the political to economic aspect. The increasing political dynasty in Indonesia is also determined by a number of factors, some of which are the absence of policy prohibiting the practice of political dynasty. In the perspective of al-Jabiri about the political rationale, it consists of three dominant motives: aqidah (faith), kabilah (tribes) and ghanimah. Al-Jabiri historically confirmed the practice of political dynasties. In practice, political dynasty in Indonesia, aqidah is defined as a political ideology, tribes as nepotism, and ghanimah as economic interests, both economic benefits from political dynasties, or economic interests to continue to grow a political dynasty. Islam tidak mempunyai sistem politik maupun pemerintahan yang lengkap dan siap pakai, termasuk bahasan mengenai dinasti politik. Fenomena  dinasti politik  pernah terjadi dalam sejarah Islam, begitu juga di Indonesia, pada era reformasi ruang lingkupnya dari level daerah sampai nasional. Memang tidak terdapat kebijakan yang melarang praktik dinasti politik di Indonesia, namun jika terus dibiarkan hal ini dapat mengancam keberlangsungan pemerintahan Indonesia dan merusak substansi demokrasi. Penelitian ini bertujuan untuk menjelaskan bagaimana praktik dinasti politik yang ada di Indonesia era reformasi dan menjelaskan bagaimana tinjauan fikih siyasah kontemporer, yang dalam hal ini menggunakan pemikiran nalar politik Muhammad Abid Al-Jabiri terhadap praktik dinasti politik di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian pustaka, dengan menggunakan pendekatan normatif, historis dan sosiologis. Teknik analisis dalam penelitian ini  menggunakan analisis isi. Hasil dari penelitian ini menemukan bahwa, praktik dinasti politik di Indonesia menimbulkan berbagai persoalan dari bidang politik sampai ekonomi. Terus tumbuhnya dinasti politik di Indonesia juga dipengaruhi oleh beberapa faktor, diantaranya tidak adanya kebijakan yang melarang praktik dinasti politik, dll. Dalam perspektif al-Jabiri mengenai nalar politik yang terdiri dari tiga motif dominan yaitu akidah, kabilah dan ghanimah, al-Jabiri membenarkan adanya praktik dinasti politik secara historis Islam. Dalam praktik dinasti politik di Indonesia akidah diartikan sebagai idelogi politik, kabilah sebagai nepotisme, dan ghanimah sebagai kepentingan ekonomi, baik keuntungan ekonomi dari dinasti politik, ataupun kepentingan ekonomi untuk terus menumbuhkan dinasti politik.

Abstract

This research focuses on understanding the reasons behind divorce claims made by female migrant workers at the Religious Courts of ex-Kediri Residency. These female workers have obtained permission from their husbands to seek employment abroad, and their departure is based on mutual agreement between them and their husband. However, while working overseas, these migrant workers file for divorce against their husbands, citing various reasons.This study aims to answer the question of why female migrant workers file for divorce claims at the Religious Courts of ex-Kediri Residency. The research method employed is qualitative research with a socio-legal, conceptual, and philosophical approach. The results of this study indicate six reasons for divorce claims among migrant workers at Religious Court of Kediri Residency. Firstly, economic issues play a significant role. Secondly, domestic violence within the marriage is a contributing factor. Thirdly, third-party interference from family members and friends is prevalent. Fourthly, misappropriation of funds for indulgent and lavish activities occurs. Fifthly, husbands exhibit irresponsibility or abandonment towards their wives. Lastly, some husbands display laziness and solely rely on their wives' monthly allowance. These phenomena call for efforts to restore the humanistic values of Islam, particularly regarding the provision of family livelihood from the perspective of equality and gender justice within migrant workers' families, through the implementation of mubadalah (mutual consultation).

Abstract

The largest religion in Indonesia is Islam, where more than 80 percent of the population is Muslim. In the midst of many studies on Indonesian Islam, it turns out that studies or books that specifically study the history of Islamic legal thought in Indonesia, both classical and contemporary, are still rarely found. From this point of view, Feener succeeded in filling the gap in this study. Presents the trajectory and history of the debate on Islamic Law in Indonesia, besides that the understanding provided is very comprehensive regarding the dynamics of modern Indonesia. Modern Indonesia is a period of the 20th century until the end of the New Order rule, which means that this study has existed for a long time, about 110 years or more than 1 century. Then chronologically presents the chapters based on the book that appeared in the hope that the close relationship between the three factors driving the modernization of Islamic legal thought in Indonesia can be more freel studied in depth. The 19th century has brought a new awareness as an alternative to the yellow book hegemony which is already deeply rooted. Awareness that later developed into a reformist school that challenged the authority of Islamic boarding school ulema as translators of Islamic traditions via the yellow book. This new movement, by using technological advances in the print and information fields, makes it easy to access products of new interpretations of religious law. In this case, the invention of the massive printing press made the prints of the thoughts and results of the reformist ulama's fatwas easy to be consumed by the wider community. Obviously, the progress of the print culture here has rivaled the authority of the Islamic boarding school ulema who used to be the sole authority on the interpretation of religious texts.

Abstract

One element of society that is vulnerable to the influence of radicalism is teenagers or young people known as the "youth" whose ages range from 16-19 years at the high school level in Indonesia. There are several factors that allow for the emergence of radicalism among adolescents, including mental health, economic factors, socio-political conditions and religious commitment from religious understanding. One of the places where this understanding has developed is schools, especially during this pandemic where many activities are carried out online or various information can be easily accessed via the internet. In order to counteract radicalism so that it does not influence the youth, the role of the family is critical. This study aims to investigate the role of family resilience in fighting and countering radicalism among the youth during the Covid 19 pandemic in Sompilan, Berbah, Selman, Yogyakarta. The study found that the family resilience is built through three key components which form the basis for maintaining resilient attitude, including the family belief system, organizational processes, communication and problem-solving.

Abstract

This Research examines the Naik Dango tradition practiced by the Dayak Kanayatn community in West Kalimantan from the perspective of Maqasid Syariah Abd al-Majid al-Najjar. This tradition is not only a ritual of gratitude for the harvest, but also a social, ecological, and economic system that supports community food security. The method used is a descriptive qualitative approach with ethnographic techniques through participatory observation, interviews, and documentation. The results of the study indicate that Naik Dango contains values of protection for life (ḥifẓ al-nafs), property (ḥifẓ al-māl), society (ḥifẓ al-mujtama‘), and the environment (ḥifẓ al-muḥīṭ al-māddī), as examined within the framework of maqasid syariah. This tradition supports the preservation of local seeds, solidarity-based food distribution, and intergenerational agrarian education. The conclusion of the study confirms that Naik Dango is a local manifestation of universal Islamic values in maintaining welfare and can be used as an alternative model in formulating sustainable food security strategies based on local wisdom

Abstract

The following article discusses the Islamization of science as a solution to the dichotomy of Islam and science in the world of Islamic education. In addition, it is hoped that with this Islamization project Muslims will gain progress and glory of civilization. However, the problem is, is this Islamization really a solution for the scientific world and Islamic education today? The discussion of this paper attempts to analyze the background, basic assumptions, and examples of the application of Islamization both from a conceptual and institutional perspective. At the same time, a critical analysis was also carried out on the controversy surrounding the Islamization of both the supporters and the critics. In general, There are two variants of the Islamization theory, namely the Islamization of the IIIT style in Virginia, United States of America, and the Islamization of al-Attas in Malaysia. An important finding of this article is that Islamization is a creative response and answer from Muslim scholars who are concerned about the decline and backwardness of Muslims in both the fields of science and technology development. However, on the other hand, as a solution offer, this Islamization has also given rise to a number of serious problems, among others, is Islamization being carried out for all sciences whether social sciences, humanities, or the exact sciences? And how? Likewise, is it the knowledge or the knowledge that is Islamized? It seems that these critical questions need attention from supporters of Islamization.
