Abstract

The rapid development of information technology, especially social media, has changed the way people interact and access information. However, this openness creates a digital paradox in the form of the spread of hate speech and disinformation that is difficult to control, potentially triggering social conflicts and political polarization, especially in Indonesia. Social media algorithms that amplify provocative content create an echo chamber that magnifies the risk of radicalization and manipulation of SARA's identity. This phenomenon threatens the quality of democracy and social cohesion, requiring a firm but proportionate response to criminal law. Law Number 19 of 2016 concerning Information and Electronic Transactions (ITE Law) plays an important role in handling digital crime, but its implementation faces obstacles of multi-interpretation norms and limited capacity of the apparatus. Repressive law enforcement has the potential to curb freedom of expression and cause injustice. Therefore, legal reforms are needed that clarify the definition of hate speech and disinformation, improve the digital literacy of the apparatus, and have independent oversight mechanisms. A comprehensive approach that combines legal, technological, and social aspects can create a healthy, democratic, and inclusive digital space, while protecting society from the negative impacts of hate speech and disinformation.

Abstract

Penelitian ini membahas kekuatan alat bukti digital dalam proses peradilan pidana yang melibatkan anak. Seiring kemajuan teknologi, kejahatan berbasis digital dengan keterlibatakn anak, baik sebagai pelaku maupun korban, semakin sering terjadi. Namun, hukum acara pidana Indonesia (KUHAP) belum secara tegas menata terkait alat bukti digital, sehingga menimbulkan kesenjangan hukum. Kehadiran Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) dan disahkannya Kitab Undang-Undang Hukum Pidana (KUHP) baru memberikan dasar normatif terhadap keberlakuan dokumen elektronik sebagai alat bukti di pengadilan. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, yang bertujuan mengkaji kedudukan hukum alat bukti digital dalam perkara pidana anak. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Sistem Peradilan Pidana Anak (UU SPPA) tidak secara spesifik menyebutkan alat bukti digital, alat bukti tersebut tetap sah dipakai selama memenuhi syarat formil dan materiil sesuai ketentuan hukum acara pidana. Dalam praktiknya, forensik digital menjadi penting untuk menjamin keaslian dan integritas alat bukti tersebut. Selain itu, ketika keterangan anak tidak mencukupi karena usia atau trauma, alat bukti digital dapat menjadi pendukung utama untuk memenuhi asas minimal dua alat bukti sebagaimana ditata dalam Pasal 183 KUHAP. Oleh karena itu, alat bukti digital memegang peranan penting dalam memastikan proses peradilan pidana anak berlangsung secara adil dan akurat, khususnya dalam konteks kejahatan siber

Abstract

Kemajuan teknologi digital telah mendorong transformasi dalam pelayanan kesehatan melalui telemedicine. Telemedicine memungkinkan konsultasi medis dilakukan jarak jauh, memberikan kemudahan bagi pasien, terutama di wilayah terbatas. Namun, pelayanan ini juga menimbulkan tantangan hukum baru, khususnya ketika terjadi kesalahan medis yang berakibat pada kerugian pasien. Penelitian ini bertujuan untuk menganalisis bentuk pertanggungjawaban pidana tenaga kesehatan dalam layanan telemedicine yang mengakibatkan kerugian pasien, serta mengidentifikasi dasar hukum yang relevan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundangundangan dan studi pustaka. Hasil penelitian menunjukkan bahwa tenaga kesehatan dalam telemedicine dapat dikenakan pertanggungjawaban pidana apabila terbukti melakukan kelalaian atau kesalahan profesional yang melanggar standar pelayanan, sebagaimana diatur dalam Pasal 359 dan 360 KUHP, UU No. 17 Tahun 2023 tentang Kesehatan, dan UU No. 11 Tahun 2008 jo. UU No. 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik (ITE). Selain itu, PERMENKES No. 20 Tahun 2019 tentang Penyelenggaraan Telemedicine mewajibkan standar profesi dan rekam medis yang valid. Meskipun demikian, penegakan hukum terhadap kasus telemedicine menghadapi tantangan, seperti bukti elektronik yang lemah dan belum adanya regulasi khusus tentang kesalahan medis digital. Oleh karena itu, diperlukan pembaruan kebijakan hukum untuk menjamin perlindungan pasien dan kepastian hukum bagi tenaga kesehatan di era digital.

Abstract

The implementation of the life of the nation and state is inextricably tied to the divine values encapsulated in Pancasila and the Constitution. However, the current reality of Indonesia's diverse nation poses a challenge to these divine values. The absence of barriers between individuals, as exemplified by their interactions and the formation of families through marriage, has resulted in the dissolution of ethnic, cultural, and religious distinctions. Consequently, some couples entering into marriage no longer consider their ethnic and cultural background as a determining factor in their relationship.The purpose of this paper is twofold: first, it aims to analyse the views of Pancasila and the 1945 Constitution of the Republic of Indonesia on the phenomenon of interfaith marriages in Indonesia; second, it seeks to provide confirmation of the actual legal status of these marriages. In order to achieve this, this paper employs a normative legal research methodology, utilising both a statutory and conceptual approach in its investigation. From a conceptual standpoint, marriage encompasses not only its legal and private aspects, but also its religious aspects. Therefore, the state relinquishes its authority to determine the legitimacy of marriage to religious law, which, by its nature, discourages interfaith marriages. This paper concludes that Pancasila and the 1945 Constitution do not acknowledge the existence of interfaith marriages, as they are deemed incompatible with divine values. Accordingly, the judiciary should refrain from recognizing interfaith unions. To resolve legal disputes surrounding these unions, the Population Administration Act should be amended to repeal Article 35, Paragraph 1.
