Abstract

Restorative justice is a way of handling child criminal cases outside the formal legal channels to guarantee and respect the dignity of the child, as well as the interests of the child and pay attention to justice for the victim. Restorative justice is a process in which all parties with an interest in a particular violation meet together to resolve jointly for the sake of the future. Restorative justice aims to empower victims, perpetrators, families, and communities to correct an act against the law by using awareness and conviction as a basis for improving community life. The application of Restorative Justice to Children Victims of Underage Marriage Crimes is one of them by implementing the Juvenile Criminal Justice System (SPPA). By focusing on the accountability of perpetrators to victims of criminal acts through a Restorative approach.

Abstract

Until now the issue of child marriage in NTB has not yet been resolved. The issue of child marriage in NTB has not been completed because the roots of child marriage in NTB have not touched the root of the real problem. Therefore there must be a more comprehensive policy breakthrough to prevent the prevention of child marriage in NTB. There is a need for a legal policy to prevent child marriages in NTB that needs scientific studies as the basis for scientific legitimacy about the urgency of the existence of regional regulations to prevent child marriage. There are two problems in this research, first, What is the juridical problem in the policy of preventing the occurrence of child marriage in NTB? Second, what is the right and applicable policy model in preventing the occurrence of child marriage in NTB? This research is normative legal research with a focus on evaluating the policy of preventing child marriage that has been taken by the NTB provincial government. The research approach used is a normative approach and an empirical approach.The results showed that the first, juridical barriers to preventing child marriage in NTB not only had juridical obstacles in terms of the validity of the provisions of article 7 paragraph (1) of the marriage law that regulates the minimum age of marriage is 16 years for women, but also still has obstacles juridical relating to the legal policy on the regulation of child marriages in the content of regional regulations because the local regulation must not conflict with article 7 paragraph (1) of the marriage law which is still valid and other constraints are not operational and the effective decision of the constitutional court No. 22 / PUU / XV / 2017 concerning judicial review of Law No. 1 of 1974 concerning Marriage because this decision only delayed the implementation of the Constitutional Court's decision in 2021 and was very dependent on legislative policy from the DPR and the President to amend Law No. 1 of 1974 concerning Marriage according to the order of the Constitutional Court's decision. Second, the appropriate and applicable policy model in preventing the occurrence of child marriages in NTB is done using the transitional policy model and post-transition policy. The transition policy is carried out by making regulations that regulate the prevention of child marriages by using the child protection paradigm, while post-transition policies are carried out using the family quality policy paradigm with a focus on increasing the age of marriage. legislation. First, the Republic of Indonesia Parliament, especially the Republic of Indonesia Parliament for the period 2019-2024 and the President should immediately follow up on Decision No. 22 / PUU / XV / 2017 by taking legislative policies by entering the amendment bill to Law No. 1 of 1974 concerning Marriage into a national legislation program which is subsequently compiled, discussed and stipulated as law. Second, to respond to the dynamic dynamics of marital law and child protection, the NTB Governor and the NTB DPRD should immediately take legislation in the regions by including the draft regulation on the prevention of child marriages in the 2019 local regulation formation program and then compile and discuss it into regional regulations.

Abstract

The confiscation of evidence or confiscation is carried out by law enforcement officers for the level of examination, especially for investigation purposes in terms of sufficient evidence, and Responsibility as law enforcement officers in securing confiscated objects. Investigators cannot arbitrarily seize goods without following the rules outlined by laws and regulations. They must comply with the provisions of the Criminal Procedure Code because this is closely related to the dignity of a person guaranteed by the State, government, law, and every citizen as values. HAM. The purpose of this research is to find out the form of Responsibility of investigators for the evidence confiscated at the Mataram Police and what obstacles are faced by the police in securing confiscated objects as evidence in the investigation of criminal cases at the Mataram Police. This research is empirical legal research, which is legal research conducted by collecting data from primary data or data obtained directly, either through observation or direct interviews. The type of approach used is the statutory approach, the conceptual analysis approach, and the case approach. Legal materials are processed deductively, drawing conclusions from a general problem to a specific one. The results of the study show Responsibility In handling confiscated objects by investigators, the investigators are fully responsible for the seized evidence and are prohibited from being used by anyone sanctions investigators who misuse evidence can be subject to disciplinary punishment in the form of a written warning; delay in attending education for a maximum of 1 (one) year; postponement of periodic salary increases; maximum promotion delay 1 (one year; emotional mutations; release from office; placement in a special place for a maximum of 21 (twenty-one) days. The investigator is fully responsible for confiscating evidence and prohibited from being used by anyone. The sanction for the investigator who misuses the evidence may be subject to disciplinary punishment in the form of a written warning; delay in attending education for a maximum of 1 (one) year; postponement of periodic salary increases; postponement of promotion for a maximum of 1 (one) year; emotional mutations; release from office; placement in a special place for a maximum of 21 (twenty-one) days. Coordination to determine the proper storage place for confiscated objects. Small-sized items will be stored in the sub locker. Mataram City Police evidence unit. The obstacles faced in the storage of evidence are the absence of adequate unique and permanent facilities in the form of a room or warehouse that can use for storage of evidence at the Mataram City Police, the lack of maximum supervision of the evidence, either from investigators or from other existing personnel. At the Mataram City Police, individuals still use evidence for personal gain.

Abstract

The purpose of this study is to 1) describe the legal arrangements related to the crime of turtle catching perpetrators. 2) describe the countermeasures carried out by the Ditpolairud Polda NTB in dealing with the perpetrators of the crime of catching turtles. The benefit of this research is to provide insight into ideas for the development of legal science, especially regarding legal arrangements related to the criminal act of catching turtles. The data were obtained from the results of library and field research, and were processed and analyzed using qualitative methods. This research is based on library materials from the results of interviews with informants, namely the Office of Ditpolairud Polda NTB. Based on the results of research related to the legal arrangements for the criminal act of catching turtles, it is clearly regulated in the Law of the Republic of Indonesia Number 5 of 1990 wherein the Law has been regulated in Article 40 Paragraph (2), violators of this Law are threatened with a maximum prison sentence 5 years and a maximum fine of IDR 100,000,000. In the countermeasures carried out by the Ditpolairud Polda NTB in dealing with the perpetrators of the crime of catching turtles, this was carried out in 3 ways, namely Preemptive, Preventive and Repressive. The implications of this research are, 1) It is expected that law enforcement officers will be more active in providing counseling and coaching to coastal communities. 2) It is expected that law enforcement officials will routinely carry out patrols in areas prone to the crime of catching turtles 3) It is expected that law enforcement officials will take firm action by giving appropriate punishments so as to provide a deterrent effect to the perpetrators of the crime of catching turtles in accordance with applicable laws and regulations

Abstract

This study aims to determine the form of coaching and to analyze the obstacles in fostering narcotics dealer convicts in the Class IIA Mataram Penitentiary so as to find out the efforts to overcome these obstacles. The type of legal research used in this research is empirical legal research. This research is descriptive in nature, data collection was carried out by interviewing convicts of narcotics dealers and correctional officers as samples determined by the author's will or purposive sampling. The author also conducts literature studies and observations/observations on coaching activities. Processing and data analysis is done by qualitative data analysis.Forms of coaching consist of personality coaching and independence coaching. The author also conducts an analysis of internal and external constraints in coaching and knows the efforts to overcome these obstacles. Internal obstacles include the lack of enthusiasm and awareness of narcotics dealer convicts to take part in coaching activities, the lack of qualified human resources in the field of coaching, facilities and infrastructure that do not yet support the implementation of coaching. Efforts to overcome internal obstacles include increasing the synergy of correctional officers and increasing the role of Correctional Guardians, establishing cooperation agreements/MoUs, maximizing the use of existing facilities and infrastructure to support coaching activities. External constraints, namely the dense activity of partners during the commemoration of religious holidays so that the implementation of coaching is less than optimal. Efforts to overcome external obstacles are to improve communication with partners and continue to collaborate in the context of development, improvement and or expansion.

Abstract

The mining sector is one of the supports for the welfare of the Indonesian people. Therefore, mining activities must be carried out according to procedures and have legality as applicable regulations. Criminal liability for perpetrators of mineral and coal mining crime Analysis of Decision Number 123/Pid.B/LH/2023/PN Pya is that the defendant has been proven guilty and fulfills the elements in Article 160 of Law of the Republic of Indonesia Number 3 of 2020 concerning amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining. Criminal liability for case Number 123/Pid.B/LH/2023/PN Pya that the Defendant has been proven guilty and meets the elements in Article 160 of Law of the Republic of Indonesia Number 3 of 2020 concerning amendments to Law of the Republic of Indonesia Number 4 of 2009 concerning Mineral and Coal Mining, namely the provision that Every person who has an IUP or IUPK at the Exploration activity stage but carries out Production Operation activities shall be punished with a maximum imprisonment of 5 (five) years and a maximum fine of IDR 100,000,000,000.00 (one hundred billion rupiah). When associated with the maximum penalty, the penalty imposed on the Defendant is still relatively low because mining without a permit is a very serious case and has a major impact on the state and society. The judge's consideration in imposing a criminal sentence based on juridical and non-juridical considerations, the judge decided that the defendant was sentenced to imprisonment of 7 (seven) months and a fine of Rp. 20,000,000.00 (twenty million rupiah) subsidair 2 (two) months.

Abstract

Penelitian ini bertujuan untuk meninjau dan mempelajari penerapan dan penegakan hukum tindak pidana perjudian online dalam hukum positif sebagaimana diatur dalam Pasal 27 ayat (2) Jo. Pasal 45 ayat (2) Undang-undang Republik Indonesia Nomor 11 tahun 2008 sebagaiamana diubah dengan Undang-undang Nomor 19 tahun 2016 tentang Informasi Transaksi dan Elektronik. Jenis Penelitian yang digunakan penulis adalah penelitian yuridis normatif, dengan melakukan penelitian terhadap peraturan perundang-undangan dan berbagai literatur yang berkaitan dengan permasalahan. Hasil penelitian ini ialah pertama, pengaturan tindak pidana dalam hukum positif Indonesia tidak mengenal istilah tindak pidana perjudian online sebagaimana dijelaskan dalam Pasal 303 KUHP serta tidak mendikotomi atau membedakan tindakan perjudian tersebut menjadi tindak pidana perjudian online atau tindak pidana perjudian biasa. Kedua, bahwa dalam konteks upaya pencegahan penyebaran tindak pidana perjudian Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 Tentang Perubahan Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik telah memenuhi perannya sebagai upaya pencegahan secara penal, akan tetapi hal tersebut tentu saja masih jauh dari kata cukup. Karena fokusnya adalah pelarangan setiap orang untuk menyebarluaskan informasi apapun dan dalam bentuk apapun yang berisi muatan perjudian sebagaimana dijelaskan mengenai definisi dan ruang lingkup “mendistribusikan” yaitu mengirimkan dan/atau menyebarkan Informasi Elektronik dan/atau Dokumen Elektronik kepada banyak Orang atau berbagai pihak melalui Sistem Elektronik. Sedangkan yang dimaksud dengan “mentransmisikan” adalah mengirimkan Informasi Elektronik dan/atau Dokumen Elektronik yang ditujukan kepada satu pihak lain melalui Sistem Elektronik

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis Faktor-Faktor Yang Menyebabkan Prostitusi Terselubung Yang Melibatkan Anak Di Bawah Umur Di Desa Batu Layar, Kecamatan Batu Layar, Kabupaten Lombok Barat Nusa Tenggara Barat dan bagaimana Upaya Penanggulangan Yang Dilakukan Untuk Mengatasi Prostitusi Terselubung Terhadap Anak Dibawah Umur. Metode yang digunakan adalah Penelitian penelitian hukum empiris yang sifatnya kualitatif, sumber data primer diperoleh melalui wawancara di lokasi penelitian, dan didukung data sekunder dari kepustakaan serta didukung dengan data tersier atau bahan hukum penunjang yang memberi petunjuk berkaitan dengan topik penelitian ini. Hasil dari penelitian ini adalah bahwa Faktor-faktor penyebab prostitusi terselubung yang melibatkan anak di bawah umur di Desa Batu Layar sangat kompleks dan saling berkaitan. Kemiskinan menjadi pemicu utama, diikuti oleh rendahnya pendidikan, minimnya pemahaman hukum, serta penyalahgunaan tradisi “merariq” sebagai pembenaran pernikahan dini yang bertentangan dengan UU No. 16 Tahun 2019. Lemahnya pengawasan, lingkungan sosial permisif, kurangnya akses layanan perlindungan anak, serta budaya diam akibat stigma sosial turut memperparah situasi. Rendahnya partisipasi masyarakat dan koordinasi antarlembaga juga menjadi hambatan serius dalam penanganan kasus. Upaya penanggulangan harus dilakukan secara menyeluruh dengan melibatkan seluruh unsur, mulai dari masyarakat, pemerintah desa, hingga lembaga pendidikan seperti Fakultas Hukum UNIZAR. Strateginya mencakup edukasi hukum, pelurusan adat, penegakan hukum yang konsisten, pembentukan Satgas Perlindungan Anak, serta penguatan sistem perlindungan anak berbasis masyarakat. Dukungan ekonomi keluarga, akses pendidikan, layanan konseling, kampanye anti-stigma, dan sistem pelaporan ramah anak juga sangat penting. Kolaborasi lintas sektor dan komitmen berkelanjutan diperlukan untuk menciptakan lingkungan yang aman bagi tumbuh kembang anak.

Abstract

Early marriage is a contributing factor to stunting, which remains a serious problem in Indonesia, including in Janapria Village, Janapria District, Central Lombok Regency. This community service activity aims to increase community understanding, particularly among adolescents and parents, regarding the dangers of early marriage and its link to stunting. The activity method involved initial observation, legal counseling regarding the minimum age for marriage in accordance with Law of the Republic of Indonesia Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage, nutrition counseling, and interactive discussions. Evaluation included pre- and post-tests, along with feedback from participants. The results of the activity showed an increase in junior high and high school students' understanding of the minimum age for marriage, as well as an increase in housewives' awareness of the role of balanced nutrition and the age of marriage in preventing stunting in Janapria Village, Janapria District, Central Lombok Regency. Participants' enthusiasm was evident in their active participation in discussions, Q&A sessions, and practical sessions on preparing balanced nutritional menus. The conclusion of this activity is that legal socialization and nutrition counseling contribute to increasing public understanding of law and health so that it can become a preventive strategy in reducing the number of early marriages and stunting in Janapria Village.
