Abstract

In accordance with Decree MUDP X/2010 which legitimizes women to be involved and play an active role like men in the public and domestic spheres. Socio-legal research, data in the form of legal documents and the results of in-depth interviews are then analyzed using various approaches (legal, theoretical and historical approaches) using inductive-deductive methods. The research results show that Bali Provincial Regulation 5 of 2020 accommodates the role of indigenous communities, including indigenous women, in managing Balinese cultural tourism, therefore Law Number 10 of 2009 is the only reference in managing Balinese cultural tourism. Meanwhile, for Balinese traditional communities, it is known that participation is not only regulated in Bali Provincial Regulation Number 4 of 2019 concerning traditional villages and awig-awig, but also in unwritten forms such as pararem pemahcah awig and perarem, ngele. The existence of indigenous women as public sector workers, namely in tourist villages, is not only found in actual texts, but in general they live their lives based on customary law which contains applicable values, principles and norms. Therefore, it is necessary to formulate tourism policies that accommodate the rights of women indigenous workers in the substance of more specific customary law as a source of gender responsiveness.

Abstract

The imposition of criminal sanctions against perpetrators of illegal investments in Indonesia still demonstrates inconsistencies, particularly when cases with similar modes of operation receive significantly different sentences. This research aims to analyze the disparity of criminal sanctions for perpetrators of illegal investments under the guise of halal businesses, through a case study of the District Court Decision Number: 309/Pid.B/2018/PN Dpk and Decision Number: 83/Pid.B/2018/PN Dpk. This study uses a normative legal research method with statutory, conceptual, historical, and case approaches. Data were collected through document studies of court decisions and relevant legal literature. The results indicate a significant disparity between the two rulings, even though the cases share similar modus operandi and impact. This disparity is caused by various factors, including the discretionary power of judges, subjective judicial considerations, and the absence of standardized sentencing guidelines. Therefore, an evaluation of the criminal justice system is necessary to ensure consistency and fairness in imposing sanctions on perpetrators of illegal investments.

Abstract

Pengelolaan Rekam Medis Elektronik (RME) telah menjadi elemen penting dalam pelayanan kesehatan modern, khususnya dalam konteks wisata medis yang melibatkan pasien asing. Indonesia sebagai negara tujuan wisata medis belum memiliki regulasi spesifik yang mengatur perlindungan hukum terhadap data medis pasien asing dalam sistem RME. Kekosongan norma ini menimbulkan berbagai implikasi hukum, seperti ketidakpastian perlindungan data pribadi, lemahnya posisi hukum dalam sengketa lintas negara, serta terhambatnya kerjasama internasional di sektor kesehatan. Meskipun terdapat peraturan umum terkait RME dan perlindungan data, namun belum ada pengaturan yang mengakomodasi kebutuhan hukum lintas yurisdiksi. Kondisi ini berpotensi menghambat pertumbuhan wisata medis dan menurunkan daya saing Indonesia secara global. Oleh karena itu, diperlukan regulasi yang komprehensif, harmonis, dan responsif terhadap perkembangan teknologi dan tuntutan internasional.
