Abstract

This article aims to analyze the relationship between state withdrawal and the jurisdiction of the International Criminal Court (ICC), particularly in the context of the Philippines' decision to withdraw from the Rome Statute. The problem is focused on the legal implications of such a withdrawal, especially in terms of how it influences the ICC's authority to investigate and prosecute crimes committed prior to the effective withdrawal date. This issue is exemplified by the Philippines' controversial "war on drugs" campaign under President Rodrigo Duterte, which has led to the deaths of thousands of civilians and is alleged to constitute serious human rights violations and crimes against humanity. In order to approach this problem, a normative theoretical reference is used to examine international law and the principles of accountability that underpin the ICC’s mandate. Data is collected through a comprehensive analysis of legal texts, court rulings, and relevant case studies. This study concludes that despite a state’s formal withdrawal from the Rome Statute, its responsibility for international crimes committed before the withdrawal remains intact. The ICC continues to hold jurisdiction over such crimes, as demonstrated by its ongoing investigation into the deaths linked to Duterte’s policies. This case highlights significant challenges related to political sovereignty, while also raising critical questions about the tension between national autonomy and global justice.

Abstract

The armed conflict between Israel and Iran, involving cross-border missile launches through Syrian airspace, presents complex challenges under international law. This study analyzes the legal implications of such violations, focusing on state sovereignty, state responsibility, and the justification of force under Article 51 of the UN Charter. Using a normative juridical method, the research evaluates the effectiveness of international legal instruments such as the UN Charter, the 1944 Chicago Convention, and the Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA) 2001 in addressing modern aerial threats involving third-party states. The findings reveal a legal vacuum regarding the regulation of long-range missiles and armed drones, often exploited by powerful states to avoid accountability. Syria, a neutral state in the Israel-Iran conflict, has suffered civilian casualties and sovereignty violations without effective international legal remedies. Furthermore, the self-defense justifications put forward by both Israel and Iran fail to meet the criteria of necessity and proportionality and infringe upon the principle of non-intervention. The weak response from the international community exacerbated by the UN Security Council’s inaction and ICAO’s limited mandate underscores the urgent need for legal reform. This study advocates for the enhancement of international institutional mandates, the development of additional protocols on aerial warfare, and the ratification of ARSIWA to strengthen legal accountability and protect third-state airspace in armed conflict.

Abstract

Kejahatan pencurian itu merupakan delik yang dirumuskan secara formal dimana yang dilarang dan diancam dengan hukuman, dalam hal ini adalah perbuatan yang diartikan “mengambil". Tindak pidana pencurian sendiri diatur dalam pasal 362 KUHP dan Tindak pidana pencurian dengan pemberatan diatur dalam pasal 363 KUHP. Analisis Hukum penerapan Tindak Pidana Pencurian dengan kekerasan putusan perkara pidana Nomor : 43/Pid.B/2025/PN Mjy Pasal 363 ayat (1) ke-4 KUHP Tentang pencurian dengan pemberatan. Dalam persidangan terdakwa dijatuhi hukuman pidana penjara selama satu tahun, sanksi dijatuhkan oleh Majelis Hakim kepada terdakwa terlalu ringan. Sanksi Pidana dalam rumusan Pasal 362 KUHP paling lama Lima Tahun. Pertimbangan hakim dalam menjatuhkan putusan terhadap Tindak Pidana Pencurian dengan Pemberatan dengan melihat Pertimbangan yuridis: perbuatan Terdakwa terbukti secara sah dan meyakinkan memenuhi semua unsur dalam Pasal 363 KUHP. Pertimbangan Non-yuridis dalam persidangan majelis Hakim tidak menemukan halyang dapat menghapuskan pertanggungjawaban pidana, baik sebagai alasan pembenar atau alasan pemaaf, maka terdakwa harus mempertanggungjawabkan perbuatannya.
