Abstract

Untuk melakukan perkawinan harus memenuhi persyaratan yang di tetapakn agama serta mereka yang ditentukan oleh hukum perkawinan. Jika perkawinan sudah dilakukan tetapi tidak memenuhi persyaratan yang ditentukan, dapat diajukan dalam penelitian ini adalah bagaimana konsekuensi hukum dari pembatalan perkawinan yang telah diputuskan oleh pengadilang Agama metode penelitian yamg di gunakan dalam skripsi ini adalah penelitian pendekatan normatif hukum yang dilakukan oleh studi literatur kualitatif yuridis maka kesimpulan adalah dedukatif. Dari hasil penelitian dapat di simpulkan bahwa pembatalan perkawinan yang dimulai dari putusan pengadilan telah mengikat berlaku hukum dari saat perkawinan, pembatalan keputusanan perkawinan tidak berlaku surut untuk anak-anak yang lahir dari perkawinan dan masyarakat.

Abstract

Perkawinan adalah suatu ikatan lahir dan batin untuk membentuk keluarga yang bahagia dan kekal antara seorang pria dan wanita berdasarkan Ketuhanan Yang Maha Esa. Perkawinan baru dianggap sah apabila dilakukan menurut masing-masing agama dan  di catat oleh pejabat yang memiliki wewenang sebagaimana yang telah ditetapkan oleh peraturan perundang-undangan yang berlaku. Dalam agama islam menikah merupakan sunnatullah, sunnah para rasul dan merupakan sunnah yang sangat dianjurkan oleh Rasulullah SAW. Seiring berjalannya waktu dan perkembangan zaman banyak anak-anak yang menikah di usiahnya belum bisa dikatakan dewasa atau belum cukup umur, yang biasanya sering dilakukan oleh masyarakat pedesaan. Berdasarkan keterangan diatas kita dapat melihat Peraturan Pemerintah tentang Pelaksanaan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, yaitu Peraturan Pemerintah Republik Indonesia Nomor 9 Tahun 1975

Abstract

Perkawinan sah menurut hukum perkawinan dan hukum Islam jika terlaksananya akad nikah yang memenuhi syarat-syarat dan rukunnya. Akad nikah dilakukan dengan adanya ijab kabul yang merupakan bagian terpenting dalam suatu perkawinan.sebagai pelaksanaan mengikatkan diri antara pengantin perempuan dengan pengantin laki-laki. Pelaksanaan ijab kabul yang sudah banyak kali dilakukan di Indonesia yaitu ketika kedua pasangan berada di dalam satu ruangan.               Dengan adanya perkembangan dan kemajuan teknologi yang sangat pesat, ijab kabul mulai dipraktekkan dengan menggunakan bantuan alat telekomunikasi sehingga dilaksanakan dalam jarak jauh walaupun belum ada aturan yang mengatur mengenai keabsahannya. Sehingga kedepannya kepada Pemerintah agar segera untuk membuat suatu peraturan agar pelaksanaan ijab kabul jarak jauh memiliki kepastian hukum.

Abstract

Act Number 16 Year 2019 on Marriage stipulates that the minimum age for marriage for a person is 19 years for both men and women. Whereas the previous Act stipulated the age limit of marriage, 19 years for men and 16 years for women. This is considered very burdensome for some religious people who obey traditions and laws as well as other factors. Thus, child marriage in the period before the Marriage Act Amendment was already quite high and it is even higher afterward. This writing aims to determine and analyze how many applications for marriage dispensation after the Amendment of the Marriage Act at the Religious Court of Palu City, using empirical research methods. The results showed that there was a significant increase in applications for marriage dispensation in the Religious Court of Palu City after the amendment.

Abstract

Introduction: The ease of carrying out marriages and divorces in Kabalutan Village, Talatako District, Tojo Una Una Regency. One of the local residents was reported by the mass media that for marriage or divorce it is enough to bring it to the Penghulu. Whereas the real task of the Penghulu is to provide supervision and registration of marriages. Can get married if the bride does not have a Guardian.Purposes of the Research: It is important to know and analyze how the implementation of marriage in Kabalutan Village is viewed from the perspective of Islamic law.Methods of the Research: The method used is an empirical legal research method with primary data sources from religious leaders, community leaders, and the community in the village.Results of the Research: So that the validity of a marriage is realized and in accordance with the objectives of the Marriage Law and also the Compilation of Islamic Law which states that marriage is a marriage, namely a very strong contract or mitsaqan ghalizhan to obey Allah's commands and carry them out is worship. The people of Kabalutan Village generally have unregistered marriages or marriages that are not registered due to the long distance and the cost of accommodation which is quite expensive to report and register their marriages to the relevant agencies.

Abstract

Generally, stunting is only associated with health issues. However, there are also gender-related problems within it. In fact, the primary role is actually held by men. In Indonesia, men are still formally designated as heads of households and are obligated to provide for their families. Therefore, policies on stunting should ideally not be directed solely at women but also at men. The purpose of this writing is to identify and analyze how gender equality and inequality are reflected in the implementation of Presidential Regulation Number 72 of 2021 on Accelerating Stunting Reduction. This background is due to the high stunting rates in Indonesia. The government and stakeholders are expected to implement policies to address this issue. Efforts range from policies on preventing and reducing stunting rates to accelerating the reduction of stunting in Indonesia, all aimed at tackling this issue comprehensively. Much of the focus, however, is directed toward women, as stunting is often closely associated with them. Yet, the failure of a child to grow (stunting) and child malnutrition are not solely women’s issues—men’s roles are also critical. For this reason, this research was conducted. The method used is a normative legal research method. The findings indicate that gender equality in the efforts to accelerate stunting reduction in Indonesia has not yet been fully achieved.

Abstract

This study aims to find out the giving of dowry in the form of a white cloth/shroud in Balaesang Tanjung, Donggala Regency reviewed by Islamic Law. The initial survey was taken through direct information from the Head of the Religious Affairs Office (KUA) in the local sub-district, that the KUA had input data on marriage events as mentioned above. Dowry should be in the form of a materialistic item and can be used by the wife if it is in difficult circumstances. At least, these items can be used for worship as is common, namely a set of prayer tools. Death is a definite thing and not a personal obligation (fardu 'ain) of the wife in its management but is included in the category of fardu kifayah. Although Islam recommends giving the cheapest dowry so as not to be burdensome, dowry in the form of a white cloth/shroud is still very rare. On that basis, how is the review of Islamic Law on the tradition of giving dowry in the form of a white cloth/shroud in Balaesang Tanjung, Donggala regency? The method used is an empirical research method with primary data sources from the community, religious leaders, and community leaders in Balaesang Tanjung, Donggala Regency. The conclusion is that the tradition of dowry of white cloth/shroud in Balaesang Tanjung is in accordance with Islamic teachings, namely including 'urf in the rules of fiqh al-'adatul muhakkamah. Important aspects of dowry in Islam have been included in it such as the existence of women's rights, signs of seriousness in marriage, raising women's dignity, mandatory and should not be eliminated.

Abstract

The rapid expansion of digital technologies has transformed the global investment landscape, prompting states to revisit the structure and objectives of Bilateral Investment Treaties (BITs). Initially designed to protect tangible investments through guarantees such as fair and equitable treatment (FET), non-discrimination, and protection against expropriation, BITs now confront a new set of regulatory challenges associated with cross-border data flows, platform governance, and digital sovereignty. The rise of technology and media platforms-characterized by their intangible, mobile, and data-driven nature-raises fundamental questions regarding the definition of “investment,” the scope of investor rights, and the extent of state regulatory space. This article examines the evolution of BITs in the digital era using a normative juridical method, focusing on how international investment law interacts with technology and media regulation. Through analysis of key jurisprudence, particularly Yahoo! Inc. v. LICRA and UEJF and the Schrems I & II decisions of the Court of Justice of the European Union (CJEU), the study demonstrates that the digital ecosystem demands more adaptive treaty frameworks capable of balancing investor protection with legitimate regulatory objectives such as privacy, cybersecurity, and content governance. The article also evaluates Indonesia’s regulatory landscape, including the Information and Electronic Transactions Law (UU ITE) and the Personal Data Protection Law (UU PDP), to illustrate national perspectives on digital governance within the broader BIT reform movement. Ultimately, this research argues that BITs must incorporate explicit digital-era provisions-such as data governance carve-outs, cybersecurity exceptions, and right-to-regulate clauses-to safeguard state sovereignty and public interests while maintaining a predictable investment environment.

Abstract

Penelitian ini bertujuan untuk menganalisis pertimbangan hukum terhadap hak warga negara dalam pencatatan perkawinan antar beda agama di Indonesia, khususnya pasca Putusan Pengadilan Negeri Surabaya Nomor 916/Pdt.P/2022/PN.Sby dan terbitnya Surat Edaran Mahkamah Agung (SEMA) Nomor 2 Tahun 2023. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Bahan hukum primer meliputi Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan sebagaimana diubah dengan Undang-Undang Nomor 16 Tahun 2019, Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan, SEMA Nomor 2 Tahun 2023, serta putusan pengadilan terkait perkawinan antar agama. Adapun bahan hukum sekunder diperoleh dari buku, jurnal, dan artikel ilmiah mengenai hukum perkawinan, hak konstitusional warga negara, dan hak asasi manusia. Hasil penelitian menunjukkan bahwa Pasal 2 ayat (1) Undang-Undang Perkawinan yang mensyaratkan perkawinan dilaksanakan menurut hukum masing-masing agama dan kepercayaannya sering ditafsirkan sebagai hambatan terhadap pencatatan perkawinan antar agama. Di sisi lain, UUD 1945 menjamin hak warga negara untuk membentuk keluarga, memperoleh kepastian hukum, dan mendapatkan perlakuan yang sama di hadapan hukum. Putusan Pengadilan Negeri Surabaya Nomor 916/Pdt.P/2022/PN.Sby menunjukkan adanya perkembangan interpretasi hukum yang memberikan ruang bagi pencatatan perkawinan antar agama melalui penetapan pengadilan, sedangkan SEMA Nomor 2 Tahun 2023 justru membatasi praktik tersebut dengan melarang hakim mengabulkan permohonan pencatatan perkawinan antar agama. Konflik norma tersebut menimbulkan ketidakpastian hukum dan berdampak terhadap perlindungan hak-hak sipil warga negara, terutama terkait status perkawinan, hak waris, dan hak keperdataan anak. Oleh karena itu, diperlukan harmonisasi regulasi antara hukum perkawinan, hukum administrasi kependudukan, dan prinsip-prinsip konstitusi guna menjamin kepastian hukum, keadilan, dan perlindungan hak konstitusional warga negara tanpa mengabaikan nilai-nilai agama sebagai dasar sistem hukum Indonesia.
