Abstract

Act Number 16 Year 2019 on Marriage stipulates that the minimum age for marriage for a person is 19 years for both men and women. Whereas the previous Act stipulated the age limit of marriage, 19 years for men and 16 years for women. This is considered very burdensome for some religious people who obey traditions and laws as well as other factors. Thus, child marriage in the period before the Marriage Act Amendment was already quite high and it is even higher afterward. This writing aims to determine and analyze how many applications for marriage dispensation after the Amendment of the Marriage Act at the Religious Court of Palu City, using empirical research methods. The results showed that there was a significant increase in applications for marriage dispensation in the Religious Court of Palu City after the amendment.

Abstract

This research entitled "Manifestations of Gender Injustice in the Tradition of Divorced Marriage in Kabalutan" is motivated by mass media information which states that in that village, there are many widows of various ages. From young to old age. It was also stated that in this village, it was easy to marry and divorce. Therefore, it is crucial to analyze this tradition from a gender perspective. So that it can be known which parties are harmed by this tradition, to be given socialization of what laws are needed there. The method is an empirical research method with primary data sources from traditional leaders and community leaders in the village. The stages are from surveys, observations, and conducting interviews, as well as collecting data for analysis and giving conclusions. The results of his research are that the term "widows' village" is a term that appeared during the population census in the 90s. At that time, there were many widows in Kabalutan Village for various reasons. But now, not anymore. Thus, the conclusion is that the stereotype of "Kampung Widow" towards Kabalutan Village, Talatako District, Tojo Una Una Regency is a manifestation of gender injustice. The people in the village are not comfortable with this labelling. In addition, it is not proven by the many widows there; it is also not the name of their village. Therefore, they asked to give only Kabalutan Village.

Abstract

Kemiskinan ekstrim adalah ketidakmampuan masyarakat dalam memenuhi kebutuhan dasar seperti makanan, air bersih, sanitasi layak, kesehatan,tempat tinggal, pendidikan dan akses informasi dan layanan sosial. Program padat karya untuk masyarakat miskin ekstrim melibatkan mayarakat langung diawali dengan menyiapan data masyarakat miskin ekstrim, identifikasi pekerjaan, penyusunan rencana kegiatan, perhitungan komponen tenaga kerja. Pengabdian kepada masyarakat yang telah dilaksanakan meliputi Pengenalan Aplikasi PADUNGKU untuk mendata warga meliputi: Pendataan data diri Masyarakat miskin ekstrim pada kegiatan Padat Karya, Pendataan Masyarakat tentang Jenis Pekerjaan, Pendataan Masyarakat tentang Jenis Pendidikan, Pendataan Masyarakat tentang Jenis Rumah dan Pendataan Masyarakat tentang Jenis Bantuan. Salah satu tujuan dari pendataan ini diharapkan dapat membantu menegetahui warga miskin ekstrim agar nantinya dilibatkan dalam program padat karya agar dapat menurunkan angka kemiskinan ekstrem di daerah irigasi Kec. Toili Barat dan daerah irigasi Kec. Moilong Melalui kegiatan pengabdian ini, tim berhasil menyelesaikan pendataan dengan baik dengan prosentase 100%. Harapannya kegiatan pengabdian Masyarakat ini dapat memberikan dampak positif dan bermanfaat bagi seluruh Masyarakat Aliran Irigasi Kec. Toili Barat dan masyarakat Aliran Irigasi Kec.Moilong Kabupaten Banggai Provinsi Sulawesi Tengah yakni dapat menurunkan angka kemiskinan ekstrim

Abstract

Hadirnya peraturan merek dan indikasi geografis yang terbaru yang perubahannya lebih luas lagi dengan disebutkannya Indikasi Geografis dalam penamaannya, namun sejak diundangkannya peraturan tersebut masih ada yang belum menjadi perhatian dari para pelaku usaha dan juga instansi terkait, apalagi pada wilayah Kabupaten, Kota yang masih kurang kesadaran betapa pentingnya perlindungan akan merek barang atapun merek jasa tersebut bagi pelaku usaha. Bagi pelaku  usaha kecil dan menengah yang perlu pembinaan dan bantuan untuk mendaftarkan merek, diuntungkan dengan dukungan  instansi yang lebih mudah dan murah biaya pendaftarannya.  Metode yang digunakan adalah empiris . Mengingat Kopi adalah pilihan peneliti saat ini karena disemua daerah memiliki tanaman kopi dan menghasilkan cita rasa kopi yang khas ditiap daerah. Hasil ini diharapkan dapat memberikan pengetahuan akan perlindungan terhadap produk dan kemasan yang perlu dilabel dan terdaftar perlindungan Dirjen Hukum dan Ham demi menjaga dari peniruan merek serta pemboncengan merek yang dapat merugikan pelaku usaha itu sendiri, sehingga Masyarakat dimudahkan mendapatkan informasi dan fasilitas. Karena mendapatkan perlindungan yang diberikan oleh negara tidak hanya sebatas pemilik merek tetapi kepada konsumen yang menginginkan aman, nyaman, terjamin dalam mendapatkan merek yang asli, dan tidak tertipu dengan barang palsu atau tiruan.  Perlindungan hukum hanya diberlakukan terhadap merek yang telah terdaftar.  Pendaftaran merek memberikan perlindungan yang lebih kuat khususnya merek identik atau yang mirip. Peran aktif pemerintah sangat dibutuhkan untuk mendorong permohonan pendaftaran merek dan indikasi geografis bagi produk kopi untuk kemajuan ekonomi yang berkelanjutan. Hal ini telah terwujud dengan telah dijalinnya kerjasama antara pemerintah daerah dengan akademisi untuk penyusunan dokumen deskripsi persiapan pendaftaran indikasi geografis.

Abstract

The increase in the number of marriage dispensation cases in the Religious Courts after the amendment of the Marriage Law requires the government to be vigilant. The large number of divorces from young marriages filed with the court is an impact of the increase in the number of marriage dispensation applications. The purpose of this study is to analyze the factors that influence the prevalence of child marriage in Palu, Sigi and Donggala. The method used is socio-legal research method with primary data sources obtained from Penghulu in Palu, Sigi, and Donggala. The results of the study found a strong influence of religious factors, customs, economics, education, pregnancy outside marriage, and narcotics which caused the prevalence of child marriage in Palu, Sigi, and Donggala. All of these influencing factors all lead to the solution of marriage dispensation. A better strategy is needed that is tailored to current conditions. It is also suggested that Penghulu conduct seminars so that they can have the same perception of the Marriage Registration Policy and knowledge of the latest Marriage Law. Cooperation with the courts is needed to facilitate community affairs related to marriage. Abstract

One of the legal rights that must be protected is intellectual property rights. This study analyzes intellectual property legal protection aspects based on a royalty system. This research is the normative legal research to produce legal arguments, usually called legal prescriptions. This study uses primary legal materials, which include: the 1945 Constitution of the Republic of Indonesia, the Patent Law, the Copyright Law, the Government Regulation on Song and/or Music Royalties, also the Plant Variety Royalties Act. Secondary legal materials include the results of studies and research on aspects of royalties in intellectual property rights. Non-legal material includes various non-legal studies of the royalty system in intellectual property. The approach in this research is a conceptual approach and a statutory approach. The results of the study confirm that the implication of the implementation of the royalty system in intellectual property rights requires the state to realize three fundamental legal values ​​related to royalty policies, such as guarantees of legal certainty over the rules regarding royalties, guarantees of benefit from the distribution of royalties, as well as guarantees of fair distribution of royalties based on the principle of proportionality. In addition, legal protection with a royalty system in intellectual property rights needs to be carried out externally and internally. Highlights: Royalty system needs legal certainty, benefits, and fair distribution. Fair distribution based on proportionality is important. External and internal legal protection is necessary. Abstract

Regional budgets (APBD) have an important role in fulfilling human rights (HAM), but the integration of human rights principles in regional financial management still faces challenges. Separate budget management is contrary to efforts to fulfill human rights comprehensively. This study focuses on aspects of budget policy towards the fulfillment of human rights, especially how the principle of indivisibility as a state obligation is realized in policies and implementation of regional financial policies. This study is a normative legal study with a conceptual and legislative approach. The results of the study indicate that optimal and participatory regional financial planning ensures the fulfillment of basic rights in a comprehensive and interrelated manner, such as the right to health which includes health services, a healthy environment, and social security. The APBN and APBD reflect the sovereignty of the state and the aspirations of the people, with the main goal of achieving community welfare. Budget management must prioritize human rights principles, ensure equality, and integrate economic, social, and cultural rights into policies. Regional governments need to set budget priorities that support the fulfillment of relevant human rights, with the aim of realizing sustainable and equitable development

Abstract

The global surge in generative Artificial Intelligence (AI) has triggered unprecedented legal complexities in copyright protection. This article examines how Indonesia and the European Union (EU) approach the challenges posed by AI driven content creation and potential copyright infringement. Through doctrinal and comparative legal analysis, this study explores regulatory frameworks, liability questions, and enforcement mechanisms in both jurisdictions. The analysis reveals that Indonesia's Copyright Law No. 28 of 2014 remains anthropocentric, lacking recognition of AI generated works and mechanisms for regulating AI training using copyrighted materials. By contrast, the EU has developed a more comprehensive approach through the EU Copyright Directive and the AI Act, which incorporates risk-based AI governance and explicit opt out rights for copyright holders. The study identifies significant regulatory asymmetries between the two jurisdictions and examines potential areas for legal development. Drawing on international frameworks such as the OECD AI Guidelines, this research suggests that Indonesia could benefit from adopting more anticipatory regulatory approaches similar to the EU's principle-based strategy. The findings indicate that proactive legal reforms are necessary to address emerging AI copyright challenges in developing legal systems. This study contributes to the growing body of comparative legal scholarship on AI governance and offers insights for policymakers navigating the intersection of artificial intelligence and intellectual property law.

Abstract

This study aims to: (1) To find out the efforts made by the General Criminal Investigation Unit of the Central Sulawesi Regional Police in tackling the crime of trafficking in persons (2) To find out the obstacles faced by the General Criminal Investigation Unit of the Central Sulawesi Regional Police in tackling the crime of trafficking in persons. The method used in writing this is to use an empirical juridical research approach. The results of this research are (1) The Police as law enforcers, protectors and protectors of the community are obliged to maintain the uphold of the law, justice and protection of human dignity as well as order and legal certainty in order to realize the duties and functions of the police, there are several efforts made by the Central Sulawesi Police, especially the criminal investigation unit in overcoming the prevention of human trafficking crimes, namely through the efforts of the Central Sulawesi Police. Pre-emptive, through preventive efforts and through repressive efforts. (2) The prevention of trafficking in persons carried out by the General Criminal Investigation of the Central Sulawesi Regional Police has several obstacles, including victims of trafficking in persons who do not want to report, and the lack of budget for the prevention of trafficking crimes, when this is an obstacle to the general criminal investigation of the Central Sulawesi Regional Police in preventing the crime of trafficking in persons. The Research Suggestions are (1) There is a need for special attention and support from various institutions and the community is also needed to handle trafficking cases. Information and news from trafficking cases need to be reported more to increase public attention so that cases about Human Trafficking do not occur again (2) The government should form a special task force to tackle the crime of trafficking in persons consisting of the police, the Ministry of Manpower and the Protection of Indonesian Workers.
