Abstract

This community service was carried out with the title of Legal Counseling on the Special Regional Regulation of Papua Province Number 23 of 2008 Concerning the Customary Rights of Customary Law Communities and the Individual Rights of Customary Law Community Members to Land in Asei Besar Village, East Sentani District, Jayapura Regency, this activity was carried out for partners due to cases from partners regarding their lack of understanding regarding the resolution of customary land disputes based on applicable laws and regulations in order to obtain legal certainty and where the disputing parties do not want to give in or want to win alone so that with the expertise possessed by the servants, they can carry out legal counseling so that the disputing parties both win or achieve a win-win solution. The method of implementing this community service is carried out through lectures and discussions held on Saturday, August 30, 2025, which was held in Asei Besar Village, East Sentani District, Jayapura Regency by providing knowledge to partners regarding land dispute resolution in general there are two types, namely dispute resolution through Litigation and Non-Litigation to obtain legal certainty, this activity begins with preparation and coordination, then presentation of material on how to resolve customary land disputes based on applicable laws and regulations. The output of this community service is to provide an understanding to partners about how to resolve disputes through Non-Litigation channels along with the advantages and disadvantages of resolving these disputes and also provide legal assistance to partners to resolve cases related to customary land disputes.

Abstract

Pengabdian ini dilakukan dengan judul Penerapan IPTEKS Peraturan Pemerintah Nomor 18 Tahun 2021 Gunanya Memperoleh Kepastian Hukum Pada Masyarakat Di Kampung Asei Besar Distrik Sentani Timur Kabupaten Jayapura, kegiatan ini dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman cara pendaftaran tanah guna memperoleh kepastian hukum sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penerapan IPTEKS tersebut. Metode pelaksanaan pengabdian ini dilakukan dengan cara penerapan IPTEKS melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 29 November 2025 yang dilaksanakan di balai kampung Asei Besar dengan memberikan pengetahuan kepada mitra mengenai sistem pendaftaran hingga terbitnya sertifikat tanah menurut Undang-Undang Pokok Agraria (UUPA) dan Peraturan Pemerintah Nomor 18 Tahun 2021 tentang Pendaftaran Tanah untuk memperoleh kepastian hukum. Adapun luaran dari pengabdian ini adalah memberikan pemahaman kepada mitra tentang Sistem Pendaftaran Tanah hingga terbitnya sertifikat hak milik atas tanah untuk menjamin kepastian hukum berdasarkan Undang-Undang Pokok Agraria Nomor 5 Tahun 1960 dan Peraturan Pemerintah Nomor 18 Tahun 2021 Tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Susun Dan Pendaftaran Tanah, dan juga memberikan pendampingan hukum kepada mitra untuk mendaftarkan tanahnya pada Badan Pertanahan Nasional (BPN).

Abstract

This study aims to analyze the principle of state sovereignty and its limitations in the context of international law, along with its implications for Indonesian foreign policy. This study will be conducted using a qualitative research approach, relying on normative legal research methods and utilizing secondary data from various international legal instruments, academic literature, and relevant policy documents. The study's findings highlight the importance of the principle of sovereignty in international relations, yet its implementation is often subject to various constraints within the context of international law, including international commitments in the areas of human rights, environmental protection, global security, and international cooperation. For Indonesia, the evolving interpretation of sovereignty requires a strategic balance between maintaining national autonomy and fulfilling international responsibilities. Indonesia's active engagement in regional frameworks, particularly within ASEAN, reflects an adaptive foreign policy approach that seeks to uphold sovereignty while promoting regional stability and cooperation.
