Abstract

The modern positivistic paradigm, which places significant emphasis on empirical verification, has led to a shift in the position of Islamic sciences. Islamic sciences, which rely on a balance between revelation, reason, and human experience, have been affected by this shift. In the intellectual history of Islam, the mystical dimension has played an important role in shaping the conception of science. This raises critical questions about the role of Islamic epistemology in contemporary intellectual discourse. This article highlights the need for a reconstruction of Islamic epistemology that unites metaphysics, rationality, and revelation as its main pillars. The prevailing imbalance among these three elements hinders the advancement of Islamic epistemology. By anchoring Islamic epistemology in metaphysics, it aims to present an alternative to the prevailing modern paradigm and contribute to the development of knowledge that is more pertinent to contemporary challenges. The reconstruction of Islamic epistemology seeks to integrate revelation and reason in a more balanced and systematic manner, with metaphysics serving as the conceptual bridge that unites the two. This integration, the study posits, creates new opportunities for dialogue between empirical science and metaphysical understanding, as well as encourages a more holistic perspective in the study of Islam.

Abstract

The backpacker umrah phenomenon reflects the community’s aspiration to perform worship in a more flexible and economical manner, yet it simultaneously generates serious concerns from both positive law and sharī’ah perspectives, as it is conducted outside the framework of official state mechanisms. This study analyzes backpacker Umrah from the perspective of Maqashid al-Shariah and legal sociology and offers ideal regulations that protect pilgrims. This research is an empirical legal study that uses primary data from a Google Form questionnaire to analyze the reasons and objectives of pilgrims performing Umrah as backpackers, supported by legal materials in the form of statutory regulations. The research findings demonstrate that the phenomenon of backpacker umrah embodies broader social dynamics and represents community responses to economic constraints and technological developments, as pilgrims increasingly opt for a more flexible and affordable mode of worship. In the perspective of legal sociology and maqashid asy-syariah, this practice demonstrates a culturally legitimate social construction, but it creates tension with formal regulations, particularly in aspects of security, legal protection, and compliance with legislation. Although it provides benefits to some segments of society, backpacker umrah still carries potential harms that need to be addressed proportionally. Based on the findings of this study, it is recommended that regulations governing ḥajj and umrah be more effectively organized to prevent long queues for pilgrims, and that specific provisions addressing backpacker umrah be formulated to ensure legal protection, along with guarantees of safety and comfort for those undertaking the pilgrimage independently.

Abstract

This research aims to develop a Dictionary of Sharia Economic Law Terms as a supporting teaching material in understanding the term fiqh al-mu’amalah and analyze its development based on the perspective of maqāṣid al-sharī'ah and qawā’id fiqhiyyah. The research uses a qualitative approach with the type of research and development (R&D). The dictionary development process is carried out through the planning stages, identification of reference sources, preparation of lemmas, provision of term meanings, and evaluation through Focus Group Discussion (FGD) involving Arabic students and language experts. Data were collected through documentation studies, observations, and focus group discussions, then analyzed using qualitative descriptive methods and normative-conceptual analysis. The results of the study show that the Dictionary of Sharia Economic Law Terms developed is systematically compiled based on classical and contemporary fiqh sources and contains fiqh al-muamalah terms that are relevant to the learning needs of students. The results of the trial show that this dictionary is effective in helping students in understanding the term fiqh al-muamalah, especially in the Sharia Economic Law Book Study course. Analysis based on maqāṣid al-sharī'ah shows that the development of dictionaries is in line with the goal of preserving religion (ḥifẓ al-dīn) and preserving reason (ḥifẓ al-'aql), while analysis based on qawā’id fiqhiyyah shows relevance to the principles of al-mashaqqah tajlib al-taysīr and al-umūr bi maqāṣidihā. Thus, the development of this dictionary has a practical and theoretical contribution in supporting the ease of learning and improving the quality of understanding of terms in the field of Sharia Economic Law.

Abstract

A persistent gap remains in Indonesian Islamic higher education between teaching Arabic grammar (nahwu) and applying it to authentic Islamic legal discourse, as most instruction relies on decontextualized, fabricated sentences that fail to prepare students for interpreting real legal texts. Prior studies have examined Arabic instruction or active learning separately but have not developed a systematic, empirically grounded model that explicitly links grammatical competence to legal text analysis and authentic assessment. This study aims to develop and examine an active learning model grounded in Islamic law at UNKAFA Gresik. Using a qualitative phenomenological approach, data were collected through interviews, observations, and documentation involving 10 students and 2 lecturers, and then analyzed thematically. The findings reveal that a structured model combining group-based text analysis with guided worksheets significantly enhances both grammatical mastery and contextual legal understanding, though an evaluation gap remains, as exams still prioritize artificial sentences over authentic texts. This study concludes that integrating active learning successfully creates lecturer-initiated contextual activities, student-centered text analysis, and collaborative learning models, and recommends adopting authentic text-based assessment and aligning the institutional curriculum to strengthen epistemological coherence in Arabic language education. Terdapat kesenjangan persisten di perguruan tinggi Islam Indonesia antara pengajaran tata bahasa Arab (nahwu) dan penerapannya pada wacana hukum Islam yang autentik, karena sebagian besar pembelajaran masih menggunakan kalimat buatan yang tidak kontekstual sehingga gagal mempersiapkan mahasiswa untuk interpretasi teks hukum yang sesungguhnya. Penelitian sebelumnya membahas instruksi bahasa Arab atau pembelajaran aktif secara terpisah, namun belum mengembangkan model sistematis berbasis empiris yang secara eksplisit menghubungkan kompetensi tata bahasa dengan analisis teks hukum dan penilaian autentik. Penelitian ini bertujuan mengembangkan dan mengkaji model pembelajaran aktif yang berbasis hukum Islam di UNKAFA Gresik. Menggunakan pendekatan kualitatif fenomenologis, data dikumpulkan melalui wawancara, observasi, dan dokumentasi yang melibatkan 10 mahasiswa dan 2 dosen, kemudian dianalisis secara tematik. Temuan menunjukkan bahwa model terstruktur yang menggabungkan analisis teks berbasis kelompok dan lembar kerja terpandu secara signifikan meningkatkan penguasaan tata bahasa dan pemahaman hukum kontekstual, meskipun masih terdapat kesenjangan evaluasi di mana ujian lebih mengutamakan kalimat artifisial daripada teks autentik. Penelitian ini menyimpulkan bahwa integrasi pembelajaran aktif berhasil menciptakan aktivitas kontekstual yang diprakarsai dosen, analisis teks berpusat pada mahasiswa, dan model pembelajaran kolaboratif, serta merekomendasikan adopsi penilaian berbasis teks autentik dan penyesuaian kurikulum institusional untuk memperkuat koherensi epistemologis dalam pendidikan bahasa Arab.
