Abstract

This research aims to analyze how is the politics of law of the protection of female migrant workers is based on the feminist legal theory in Indonesia. This research uses a normative juridical approach. The results of the study indicate that the politcs of law of the protection of female migrant workers can be traced based on several related regulations, ranging from ideal, constitutional, legislative and implementation arrangements. The law on the protection of migrant workers is deemed unable to protect Indonesian female migrant workers, there are no specific regulations relating to the protection of female migrant workers and has not been consistent in implementing ratified conventions related to the protection of migrant workers, especially women, so special regulations need to be stipulated regarding migrant workers protection Indonesia in order to realize a legal instrument for the protection of migrant workers who is responsive to the needs of Indonesian women migrant workers. Feminist legal theory urges the government to create regulations, especially related to the protection of female migrant workers who place women in a special position.

Abstract

Introduction: One of the health problems in Indonesia that has not been resolved is the HIV pandemic orHuman Immunodeficiency Virus or a virus that attacks/infects white blood cells which causes a decrease inhuman immunity. To combat HIV/AIDS, treatment is performed through antiretroviral drugs. But in fact, antiretroviral drugs are often scarce which causes a decrease in the welfare of people with HIV / AIDS inIndonesia.Research Objectives: This study aims to discover and analyze some policies on administering antiretroviraldrugs that are fair for people with HIV/AIDS in Indonesia. Methods: This study uses a qualitative method with a normative juridical approach. The data used aresecondary data consisting of primary and secondary legal materials. The data was collected through aliterature study and analyzed qualitatively. Conclusion: In making policies, the implementation of antiretroviral drugs must be centered on PLWHAand use the PLWHA as policy actors. The policy of delivering ARV drugs that are centered on PLHIVis expected to produce fair policy outputs and then have implications for the high welfare of PLWHA inIndonesia, this is in line with the formation of a policy based on the study of responsive legal theory initiatedby Nonet and Selznick. Responsive legal theory requires that the law that has implications for PLWHA,should always be sensitive to the needs of PLWHA, especially regarding the availability of ARV drugs.

Abstract

Abstract

The purpose of this research is to find out the implementation and actualization of international and domestic law regarding child trafficking, to find examples of multilateral international cooperation forms that have been created in the context of overcoming child trafficking, and to identify threats and solutions needed by the international community in the prevention of Child Trafficking. This research was legal research with a normative juridical approach with descriptive-analytical research specifications. Child trafficking is a form of human trafficking. This crime can be attributed to the existence and widespread of the concept of "modern slavery." Internationally and nationally, laws regarding the prevention of child trafficking and child protection have been created. Examples in the international spectrum are UNTOC Annex II: Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime, Convention on The Rights of the Child created by UNICEF, International Program on the Elimination of Child Labor (IPEC) by the ILO, the World Congress against the Commercial Sexual Exploitation of Children, and the Palermo Protocol. With evidence of the development of child trafficking with the influence of cyberspace and information technology, the international community's concern on this issue must also increase. Abstract

In the context of the current efforts that Indonesia is making to alter its prostitution laws, it is of the utmost importance to determine the strategy that will be most effective. The two strategies implemented most are known as harm reduction and harm elimination. This study employs a juridical-normative research method to analyse various plans, weighing the pros and cons of each option and providing recommendations on the most suitable approach for Indonesia. The findings highlight the necessity for an all-encompassing and multi-disciplinary approach, intending to strike a balance between the protection of the rights of sex workers and the reduction of harm done to society. It has been found that a policy of harm reduction may be more appropriate for Indonesia as it recognises the existence of prostitution and works toward addressing the root causes of the problem while simultaneously attempting to lessen the adverse effects of the practice. Abstract

When attaining effective governance and justice, as described in the Sustainable Development Goals (SDGs), corruption is a serious hurdle in sustainable development. The issue of corruption continues to be widespread in Indonesia, necessitating responses that are both comprehensive and international in scope. Essential to the fight against corruption is the empowerment of community engagement at the local level; in developing, implementing, and monitoring Anti-Corruption Action programs. On the other hand, there is considerable space for improvement regarding community participation in anti-corruption activities. This study aims to analyze the significance of community involvement in anti-corruption measures within Indonesia by employing a socio-legal methodology: a combination of legal research with sociological analysis. Data collection entails using primary sources, such as interviews and observations made in the field; in addition to secondary sources, including legal literature and decisions made by the courts. Descriptive-analytical approaches are used to examine the elements influencing community participation in preventing and eliminating corruption. After completing the research, the researchers concluded that anti-corruption learning programs, law enforcement, and community awareness are necessities to effectively combat corruption. Additionally notable is the increasing importance of the independent media's role in discovering corruption and increasing public awareness. Among the recommendations are the enhancement of community engagement, the promotion of anti-corruption education, the expansion of media cooperation, and the improvement of government openness. To combat corruption and promote good governance, it is possible to develop an effective and sustainable collaboration between the government and society by implementing these measures.KEYWORDS: Corruption, Community Engagement, Anti-Corruption Action Programs, Local Governance

Abstract

Abstract

Women who work as shallot sellers are vulnerable to the non-fulfillment of their fundamental labor rights, ranging from the right to receive fair wages to the right to protection from discrimination at work. This study focuses on understanding and analyzing the reasons for the need to protect and fulfill the rights of female shallot harvesters. It examines the reality of female shallot harvesters through an intersectional feminist approach, as outlined by Simone De Beauvoir, and proposes strategies for fulfilling the rights of female shallot harvesters based on gender justice and sustainability. This research employs a non-doctrinal research approach, utilizing a socio-legal perspective that combines primary and secondary data through descriptive-analytical and socio-cultural methods. The results of this research and discussion show that female shallot harvesters need protection and fulfillment of their rights because their welfare and wages are still below the regional minimum wage standard, and their working hours are unlimited as stipulated in Law No. 13 of 2003 concerning Manpower, as well as gender bias issues for female shallot harvesters. The relevance of gender bias and the fulfillment of the rights of female onion peeling workers can be linked to the multiple vulnerabilities faced by women. The position of women, who are often placed after men, is highlighted in Simone de Beauvoir's work The Second Sex with an intersectional approach. This intersectional approach sees the multiple vulnerabilities faced by female shallot peeling workers, not only in terms of unmet decent wage standards but also in terms of gender bias issues. The strategy to fulfill the rights of female shallot sellers needs to be pursued through gender-responsive policies that guarantee the sustainability of their economy in terms of fair wages, appropriate working hours, and employment agreements in accordance with applicable regulations, as well as the right to protection from discrimination at work.
