Abstract

n this era of modernization, people are very indifferent to the existence of historical buildings and cultural heritage sites, all because people think that old buildings have no value and have been replaced by new, more modern buildings. This research aims to determine the implementation of Bogor City Regional Regulation Number 17 of 2019 using the method used by reading and looking at the condition of cultural heritage in Bogor City. This research is empirical juridical research. Results: Implementation of Bogor City Regional Regulation Number 17 of 2019. Cultural heritage in the form of objects, buildings, structures, sites and areas needs to be managed by the government and regional governments by increasing community participation to protect, develop and utilize cultural heritage. The government's efforts in managing and maintaining cultural heritage sites are still not optimal, even though the government has taken steps to review efforts to protect cultural heritage sites, namely by establishing policies that can overcome acts of destruction. . However, the existence of this policy is still not enough to overcome this problem because there are still strong factors that cause the lack of strong legal protection for cultural heritage sites.

Abstract

Tindakan yang dilakukan oleh teroris sangat membahayakan negara baik keamanan masyarakat maupun keutuhan negara. Terorisme mengancam keamanan dan ketenangan masyarakat, menimbulkan rasa takut dalam jiwa masyarakat sehingga menggangu secara psikologis. penelitian ini bertujuan untuk mengkaji dan mengetahui fungsionalisasi Kesatuan Brimob Jawa Barat dalam pencegahan dan penanggulangan tindak pidana terorisme. Dilihat dadri objek kajian dalam penelitian ini yaitu fungsionalisasi Kesatuan Brimob Jawa Barat dalam pencegahan dan penanggulangan tindak pidana terorisme maka penelitian ini tepat menggunakan metode pendekatan normatif. Hasil penelitian menunjukkan bahwa fungsionalisasi Kesatuan Brimob Jawa Barat dalam pencegahan dan penanggulangan tindak pidana terorisme dilakukan dalam dua bentuk yaitu 1) paya pencegahan terjadinya tindak pidana terorisme yang meliputi upaya patroli di wilayah yang dicurigai sebagai tempat yang rawan teroris, dan melakukan dialog dengan masyarakat. Mengadakan latihan persiapan bagi anggota brimob dalam menghadapi teroris. Bersinergi dengan lembaga terkait seperti BNPT dan lain-lain. Melakukan pendekatan kultural dan partisipasi semua pihak. 2) Upaya penindakan pelaku tindak pidana terorisme. Tindakan berupa penyergapan, penembakan, dan penahanan merupakan tindakan represif yang bersumber dari kewenangan diskresi kepolisian saat bertindak di lapangan yaitu suatu tindakan yang didasarkan pada pertimbangan sendiri oleh anggota Polri saat menghadapi pelaku tindak pidana. Hambatan dari kesatuan Brimob Jawa Barat dalam pencegahan dan penanggulangan Tindak Pidana Terorisme yaitu persepsi yang buruk dapat menjadi hambatan dalam pelaksanaan tugas, sarana dan prasarana serta efektivitas hukum.

Abstract

The purpose of this research is to analyze the position of the authentic deed in the evidence in the trial of civil cases and to find out and analyze the legal force of the sale and purchase deed before the official who made the land deed made based on the power of attorney stated in the deed of the notary sale and purchase binding agreement. This research method uses a normative juridical approach that emphasizes literature studies with the addition of literature, namely decision studies to strengthen the analysis and produce accurate conclusions. The results of the study show that first, the power of attorney listed in the PPJB deed is a unit that is not separate from the PPJB deed as an authentic deed and becomes full proof for judges in civil trials. Second, that the AJB made before PPAT based on the power of attorney stated in the PPJB Notarial deed has perfect legal force and is legally binding and the power of attorney listed in the notary deed is valid as authentic evidence.

Abstract

Marine spatial management in coastal areas faces increasing challenges related to conflicts over space utilization and zoning violations that are often not detected at an early stage. This study aims to analyze the effectiveness of participatory marine spatial audits as an instrument for the early detection of conflicts and zoning violations, as well as to derive policy lessons from their implementation in Bekasi Regency. The study employs a participatory qualitative approach involving pentahelix stakeholders, including academia, government, the private sector, media, and coastal communities. The audit process was conducted through a collective assessment based on three main criteria: (i) conflict and risk, (ii) legality and compliance, and (iii) the suitability of the social-ecological system.  The audit results show an aggregate score of 3.08, categorized as “moderately compliant/requiring capacity building,” indicating that marine space utilization is relatively controlled but still requires strengthened governance. The participatory marine spatial audit proved effective in revealing latent conflicts, gaps between regulations and actual practices, and the influence of socio-economic factors on zoning compliance. Respondent characteristics, such as institutional background, age, education level, household size, and income level, were found to influence perceptions and audit assessment outcomes.  This study concludes that participatory marine spatial audits function not only as a technical evaluation tool but also as a mechanism for social learning and policy capacity building. Integrating marine spatial audits into local policy cycles has the potential to enhance early conflict detection, improve zoning compliance, and support sustainable and equitable marine spatial management.
