Abstract

This study explores the construction of social realities regarding women in Eka Kurniawan's novel "Cantik Itu Luka" and its translation "Beauty is a Wound" by Annie Tucker, using the Critical Discourse Analysis (CDA) approach of Sara Mills. The analysis reveals that language choices and translation techniques significantly impact gender representation. Changes in words and nuances in the translation can alter the original intensity and meaning, affecting readers' understanding of social and gender realities. This study emphasizes the importance of maintaining original nuances to convey social critique effectively and how language reconstructs social views on women in a patriarchal context

Abstract

In many indigenous communities, disputes are usually resolved through deliberation or a family approach involving traditional leaders, religious leaders or respected third parties. In this process, efforts are made to reach a solution that is favorable to all parties, without considering who is right or wrong, but rather the goal of restoring peace and harmony in the community. On the other hand, in the perspective of Islamic law, dispute resolution is seen from the point of view of justice based on the principles of sharia. The plurality of laws is interesting to review how they harmonize in their role in regulating community order. This research uses qualitative research methods classified as normative legal research with a conceptual approach. The results of this study indicate that customary law is one of the bases for judges to decide a case based on the law if the judge does not find a basis for deciding on written law. Enforcement of public order is also seen as a very important obligation from the perspective of Islamic law. Islamic law provides a clear outline of how to build a just, safe and peaceful society.

Abstract

This research discusses the dynamic relationship between political configuration, the character of legal products, and the role of the digital society in Indonesian legal politics post the Fourth Amendment of the 1945 Constitution of the Republic of Indonesia. Two classical views on the relationship between law and politics, between law as a social controller and law as a product of societal dynamics, serve as a foundation for understanding contemporary realities. Mahfud MD's findings on the relationship between political configuration and the character of legal products indicate that political changes have direct consequences on the orientation of the regulations that emerge. However, this study highlights that the current political configuration is no longer solely determined by elites and formal structures, but also by a new force: the digital society. The emergence of actors such as influencers, online activists, and political buzzers marks a shift in the way the public participates and influences the course of legislation. On the other hand, the open digital space also presents threats in the form of polarization, disinformation, and digital oligarchy. Through a qualitative approach and literature study, this research finds that Indonesia's legal politics today are becoming increasingly complex, full of challenges, but also hold new hope for broader and more meaningful public participation. The implications of this study emphasize the importance of adaptive legal reforms, paying attention to digital dynamics, and strengthening media ethics as part of the Indonesian legal political ecosystem that upholds decency.

Abstract

Penelitian ini bertujuan untuk mengkaji tingkat keterserapan alumni Universitas Muhammadiyah Palangkaraya dalam dunia kerja serta menganalisis tantangan hukum dan administrasi yang memengaruhi proses tersebut. Dengan menggunakan pendekatan yuridis-sosiologis dan metode deskriptif-kualitatif, data diperoleh dari tracer study, wawancara, dan dokumen hukum terkait pendidikan tinggi. Hasil menunjukkan bahwa sebagian besar alumni berhasil terserap di dunia kerja, namun sebagian lainnya masih menghadapi waktu tunggu yang cukup panjang atau bekerja tidak sesuai bidang studi. Dalam perspektif hukum administrasi negara, fenomena ini mencerminkan masih lemahnya sinkronisasi antara regulasi pendidikan dan kebutuhan pasar kerja, serta terbatasnya intervensi negara dalam menjamin akuntabilitas perguruan tinggi, khususnya yang berbasis swasta. Tantangan utama yang diidentifikasi meliputi lemahnya akuntabilitas kelembagaan, tumpang tindih regulasi, keterbatasan kapasitas administratif internal kampus, dan minimnya perlindungan hukum terhadap alumni. Temuan ini menekankan pentingnya reformasi tata kelola hukum dan administrasi pendidikan tinggi guna meningkatkan keterhubungan antara pendidikan dan ketenagakerjaan secara lebih sistemik dan berkeadilan

Abstract

Enforcement of election-related criminal offenses in Indonesia continues to face various institutional obstacles due to the limited authority of the Election Supervisory Body (Bawaslu), which functions only as a supervisor and reporter, while investigative authority rests with the Police through the Integrated Law Enforcement Center (Gakkumdu). Data from the National Legal Development Agency shows that in the 2019 General Election, only 345 of 2,798 alleged election criminal offenses discussed at the Gakkumdu Center were declared to meet the elements of a criminal offense, indicating that the effectiveness of election criminal law enforcement remains low. This study aims to analyze the philosophical, juridical, and sociological foundations for strengthening Bawaslu's investigative authority through the perspective of the Responsive Law theory of Philippe Nonet and Philip Selznick. This research is normative legal research employing statutory, conceptual, and case approaches, supported by secondary empirical data in the form of official reports from Bawaslu and the National Legal Development Agency, as well as scholarly literature to reinforce the normative analysis. The results show that the current institutional design for enforcing election criminal offenses still reflects the character of autonomous law, oriented toward formal procedure, and thus does not yet fully guarantee substantive electoral justice. From the perspective of Responsive Law, effective law enforcement requires institutions that are adaptive, independent, and oriented toward protecting citizens' political rights. Therefore, reconstructing Bawaslu's investigative authority is regarded as a viable legal policy alternative worth considering through amendments to statutory regulations, while still upholding the principle of checks and balances within the criminal justice system, in order to strengthen electoral integrity and the quality of democracy in Indonesia.
