Abstract

The digital transformation of Indonesia’s judiciary through the e-Court system represents a Supreme Court initiative to realize the principles of speed, simplicity, and affordability as mandated by Article 2(4) of Law No. 48 of 2009 on Judicial Power. This study aims to analyze the effectiveness of these principles in the implementation of e-Court, particularly in civil cases at District Courts. The research employs a juridical-normative and juridical-empirical approach, collecting data through literature review, document analysis, and interviews with court officials, lawyers, and litigants. The findings indicate that e- Court significantly accelerates case administration, claim submission, and inter-party communication, reflecting a faster and more efficient adjudication process. Nevertheless, challenges remain, including technological infrastructure limitations, digital literacy disparities, and regional inconsistencies in implementation. Furthermore, although case fees have become more affordable, accessibility for people in remote areas continues to hinder procedural simplicity. The study concludes that e-Court has positively contributed to realizing the principles of speed, simplicity, and low cost, yet further policy reinforcement, equitable digital infrastructure, and human resource development are necessary to achieve an inclusive and just digital judiciary.

Abstract

Piracy is one of the forms of international crime that threatens maritime security, international trade, and regional stability. One of the regions that has attracted global attention regarding piracy is the waters off Somalia and the Gulf of Aden. The widespread occurrence of piracy in this area is driven by several factors, including weak governance in Somalia, poor economic conditions, prolonged conflicts, and inadequate maritime law enforcement. This study aims to analyze piracy off the coast of Somalia as an international crime from the perspective of international law of the sea and to examine the measures undertaken by the international community to combat it. The research employs a normative legal research method using statutory and conceptual approaches, primarily based on international legal instruments, particularly the United Nations Convention on the Law of the Sea (UNCLOS) 1982. The findings indicate that acts of piracy in Somali waters fulfill the elements of piracy as defined under UNCLOS 1982 and therefore constitute crimes of international concern. Furthermore, the principle of universal jurisdiction grants all states the authority to apprehend, prosecute, and punish pirates regardless of the nationality of the offenders or victims. Various international operations conducted by states and international organizations have contributed significantly to reducing piracy incidents in the Somali region, although challenges related to law enforcement and political instability remain. Therefore, sustained international cooperation is essential to ensure maritime security and prevent the recurrence of piracy in the future.

Abstract

Illegal mining operations (PETI) cause permanent ecological destruction and substantial state financial losses. Using a comprehensive normative legal approach, this article carefully examines the lenient sentence in Judgment Number 44/Pid.B/2021/PN Amp regarding enforcement efficiency and returning heavy machinery to owners. The study reveals a sharp sentencing disparity; the offender received only two months' imprisonment. The judges' rigid legalistic-formal adherence completely overlooked tangible environmental damage. Returning the leased excavator weakens deterrence and inherently legitimizes illegal exploitation. Thus, environmental law supremacy remains suboptimal. Judges must adopt progressive legal steps through the polluter pays doctrine to ensure future ecological justice for the public
