Abstract

The amendment of Law Number 30 of 2002 concerning the Corruption Eradication Commission through Law Number 19 of 2019 became a turning point in the institutional weakening of anti-corruption institutions in Indonesia. The revision caused widespread controversy because it was considered to shift the character of the KPK from an independent state institution to part of the executive power cluster. This study aims to analyze the direction of government policies in amending the KPK Law and assess its implications on the effectiveness of eradicating corruption. The method used is normative legal research with a legislative and conceptual approach, through the examination of legal norms, doctrines, and academic views. The results of the study show that the revision of the KPK Law presents a number of strategic restrictions, including the establishment of a Supervisory Board with technical authority, restrictions on wiretapping authority, the granting of the authority to terminate cases, and the change in the status of KPK employees to state civil servants. These changes systematically narrow the KPK's space for movement, erode its functional independence, and open up space for political power intervention in the enforcement of corruption laws. The policy direction of the revision of the KPK Law does not reflect the strengthening of the corruption eradication system, but rather shows the tendency of domestication and power control over the KPK, which has the potential to weaken public trust and the effectiveness of corruption eradication in Indonesia.

Abstract

Meskipun terdapat perdebatan mengenai pidana mati di Indonesia, sistem hukum pidana yang diperbarui tetap mempertahankannya sebagai sanksi pidana. Namun, statusnya berbeda dari KUHP lama, jika sebelumnya pidana mati adalah pidana pokok, kini pidana mati diatur menjadi pidana khusus dan bersyarat. Penelitian ini menganalisis dua dimensi normatif dalam pengaturan pidana mati tersebut: Penelitian ini menelaah isu pidana mati melalui perspektif hukum Islam dan perlindungan Hak Asasi Manusia. Pendekatan yang digunakan adalah metode yuridis normatif dengan karakter kualitatif. Data penelitian diperoleh melalui analisis terhadap berbagai ketentuan perundang-undangan, khususnya UU No. 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana beserta regulasi lain yang memiliki relevansi, serta melalui pengkajian fenomena hukum yang muncul dalam praktik. Penelitian ini menunjukkan bahwa pengaturan pidana mati sebagai pidana khusus dan bersyarat yang selalu dijatuhkan secara alternatif, telah mengintegrasikan dua sisi hukum yang berkembang dan hidup di Indonesia yaitu hukum Islam dan Hak Asasi Manusia. Pengaturan pidana mati tersebut merupakan pengaturan dengan formula yang progresif dan dapat memberikan nilai keadilan bagi pelaku dan korban tindak pidana.

Abstract

The utilization of Internet of Things (IoT) devices in everyday social life has generated digital data that is increasingly used as evidence in criminal cases. This development raises legal issues concerning the status and validity of IoT-based digital evidence within the Indonesian criminal procedure system following the enactment of Law Number 20 of 2025 on the Criminal Procedure Code. This study focuses on analyzing the legal validity of IoT-based digital evidence and its implications for the protection of suspects’ rights in the criminal evidentiary process. The research employs a normative juridical method by examining statutory provisions, principles of criminal evidence law, and relevant legal doctrines. The findings indicate that IoT-based digital evidence is recognized as legally valid provided that it is obtained lawfully, meets the requirements of data authenticity and integrity, and is supported by digital forensic examination and expert testimony. However, the use of such evidence also poses risks to the right to privacy and the principle of due process of law if it is not accompanied by clear and proportionate procedures. Therefore, strengthening technical and procedural regulations, as well as enhancing the capacity of law enforcement authorities, is necessary to ensure that the use of IoT evidence operates fairly and in balance within the criminal justice system.

Abstract

Urban green-space conflicts have emerged as a significant challenge for marginalized communities, exacerbating existing social and environmental inequalities in cities undergoing rapid urbanization and environmental transitions. This study explores the dynamics of access to justice for marginalized groups in the context of urban green-space conflicts, focusing on the barriers they face and the enabling factors that improve their ability to access legal remedies. Through a socio-legal research design, data was collected using surveys, case reviews, and stakeholder interviews, which were analyzed to identify key physical, socio-economic, and institutional barriers that hinder equitable access to green spaces. Findings revealed that marginalized communities often experience physical barriers such as limited proximity to green spaces, socio-economic disparities that prevent them from accessing legal resources, and institutional constraints, including discriminatory urban planning policies. Despite these challenges, enabling factors such as legal aid networks, participatory forums, and inclusive urban planning policies emerged as crucial elements in improving access to justice for these communities. Moreover, the study examined the impact of social and environmental transitions, such as urbanization and climate change, on justice outcomes, showing that these transitions can either exacerbate or alleviate barriers depending on how policies are implemented. The study emphasizes the need for policy reforms that promote equity in urban planning and legal aid systems, ensuring that marginalized communities are included in decision-making processes. Future research should explore the impact of environmental justice policies in global contexts and investigate new legal frameworks to address the specific needs of vulnerable populations.

Abstract

Dalam Pasal 51 KUHP Nasional tertulis jelas mengenai tujuan pemidanaan. Tujuan pemidanaan itu sendiri dibuat sebagai acuan atau pegangan untuk hakim dalam memutus suatu tindak pidana agar pemidanaan dapat tercapai sebagai mana tujuan dari pemidanaan dalam KUHP Nasional, yang mana dalam KUHP Lama tidak dijelaskan mengenai tujuan pemidanaan. Penelitian ini hendak menjelaskan mengenai tujuan pemidanaan dalam KUHP Nasional dalam perspektif hukum pidana Islam. Penelitian ini menggunakan metode yuridis normatif, sekaligu analisis hukum pidana Islam. Sumber data yang digunakan yaitu UU No 1 Tahun 2023 tentang Kitab Undang-undang hukum pidana, jurnal-jurnal, dan buku yang terkait. Pada tujuan pertama untuk mencegah dilakukannya Tindak Pidana dengan menegakkan norma hukum demi perlindungan dan pengayoman masyarakat sesuai dengan tujuan tujuan pencegahan Az-Zajr. Pada tujuan kedua untuk memasyarakatkan terpidana dengan mengadakan pembinaan dan pembimingan agar menjadi orang yang baik dan berguna, sesuai dengan tujuan restorasi al-Isti’adah. Pada tujuan ketiga untuk menyelesaikan konflik yang ditimbulkan akibat Tindak Pidana, memulihkan keseimbangan, serta mendatangkan rasa aman dan damai dalam masyarakat sesuai dengan tujuan Pemulihan/Perbaikan al-islah. Pada tujuan keempat untuk Menumbuhkan rasa penyesalan dan membebaskan rasa bersalah pada terpidana, sesuai dengan tujuan penebusan dosa at-Takfir. namun terdapat 1 (satu) tujuan dalam hukum pidana Islam yang tidak diakomodir dalam KUHP Nasional, yaitu tujuan pembalasan al-Jaza.
