Abstract

Penelitian ini bertujuan untuk mengetahui norma-norma hukum adat Suku Serui yang mengatur kekerasan dalam rumah tangga akibat relasi kuasa di Manokwari, serta untuk mengidentifikasi bentuk penyelesaian yang diterapkan terhadap pelaku kekerasan tersebut dalam konteks budaya lokal. Penelitian menggunakan metode normatif empiris, dengan pengumpulan data melalui wawancara sebagai data primer, serta studi pustaka terhadap peraturan perundang-undangan, buku, dan jurnal sebagai data sekunder. Data yang diperoleh dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa hukum adat Serui memandang kekerasan dalam rumah tangga tidak hanya terbatas pada kekerasan fisik seperti pukulan, tetapi juga mencakup kekerasan verbal seperti bentakan dan makian, serta tindakan seperti perselingkuhan. Sanksi terhadap pelaku dijatuhkan dalam bentuk denda adat, berupa piring dan uang, yang besarannya disesuaikan dengan permintaan korban dan kemampuan pelaku. Penyelesaian dilakukan melalui jalur adat, dengan melibatkan kepala suku (mambaiseng) sebagai mediator dalam forum musyawarah atau sidang adat, di mana kedua belah pihak diminta memberikan keterangan dan menyampaikan keinginan untuk mencapai solusi damai yang adil menurut norma komunitas.

Abstract

The Free Nutritious Food Program is an affirmative state policy aimed at improving the fulfillment of children's rights to adequate health and nutrition. However, in practice, this program has created serious problems, particularly related to food poisoning incidents in schools, reflecting weak oversight and law enforcement in the area of ​​food safety. This study aims to analyze the legal accountability of the state and local governments for food poisoning cases within the Free Nutritious Food Program, assess the adequacy of the national regulatory framework related to food safety and consumer protection, and examine the implications of public policy for protecting children's rights to health. The research method used is a normative juridical approach with a statutory and conceptual approach, through a literature review of primary, secondary, and tertiary legal materials. The results indicate that legal accountability for food poisoning incidents can be imposed through administrative, civil, and criminal proceedings, depending on the level of negligence and the resulting impact. Normatively, regulations in the area of ​​food safety and consumer protection are adequate, but their implementation still faces serious obstacles in the form of weak oversight, limited institutional capacity, and a lack of ongoing evaluation mechanisms. Therefore, the free nutritious food policy requires strengthening the integrated monitoring system, implementing the precautionary principle, and increasing state accountability to ensure maximum protection of children's rights to safe and nutritious food

Abstract

This article examines the relevance of Sustainable Development Goal (SDG) 16, which emphasizes peace, justice, and strong institutions, in relation to the practice of customary law (hukum adat) in Indonesia. Employing a normative–juridical approach and the framework of legal pluralism, the study analyzes the role of customary law as a social instrument that safeguards harmony, provides access to justice, and strengthens local institutions. Case studies from indigenous communities in Papua, Maluku, and Kalimantan demonstrate that customary dispute resolution mechanisms—such as Pela Gandong, Bakar Batu, and Dayak ulayat rights—are effective in creating social reconciliation and maintaining community stability. The findings confirm that customary law is not merely a cultural heritage but also a crucial pillar of sustainable development. Consequently, formal state recognition of customary institutions is essential to support the achievement of the 2030 SDGs, particularly in realizing a peaceful, inclusive, and just society.

Abstract

The rise of food influencers on TikTok has fundamentally altered how consumers discover and select food products, including within Manokwari's increasingly dynamic culinary MSME ecosystem. This study examines the partial and simultaneous effects of TikTok food influencer and brand awareness on consumer purchase decisions at culinary MSMEs in Manokwari. Employing a quantitative descriptive-associative approach with multiple linear regression, data were gathered from 100 respondents selected through purposive sampling using Likert-scale questionnaires. Respondents were consumers who had purchased culinary MSME products in Manokwari following exposure to TikTok food influencer content. Results show that: (1) TikTok food influencer positively and significantly affects purchase decisions (β=0.453; t=5.217; sig=0.000); (2) brand awareness positively and significantly affects purchase decisions (β=0.327; t=4.186; sig=0.000); (3) both variables jointly exert a significant effect (F=94.137; sig=0.000) with R²=0.659. TikTok food influencer proves to be the more dominant variable. These findings highlight the importance of collaboration between culinary MSMEs and local TikTok influencers as an effective digital marketing strategy, alongside the need to strengthen brand awareness through consistent brand identity and active digital platform presence.

Abstract

This article examines the institutionalization of justice in Ancient Babylon through the legal institutions and forms of authority reflected in the Code of Hammurabi. As one of the earliest written legal collections in human history, the Code provides important evidence of how law was used to organize social relations, regulate economic activity, and legitimize political power. Using normative legal research with historical and conceptual approaches, this study analyzes the legal norms contained in the Code and situates them within the broader social and political structure of Babylonian society. The findings show that Babylonian law was supported by a relatively complex institutional order involving the king, judges, administrative officials, local assemblies, written records, and procedures of proof. Royal authority occupied a central position in this system, deriving legitimacy from divine mandate, especially through the association between Hammurabi and the god Shamash. The institutionalization of justice was reflected in the codification of rules on bodily injury, professional responsibility, economic transactions, family relations, and social hierarchy. Although the legal system was not egalitarian, it provided a formal framework for dispute resolution, social control, and the protection of vulnerable groups. The article argues that the Code of Hammurabi should be understood not merely as a legal text, but as an institutional instrument for consolidating justice, order, and royal legitimacy in Ancient Babylon.

Abstract

Ancient Mesopotamia occupies a central position in the history of written law, particularly through the Code of Hammurabi, one of the earliest and most systematic legal collections of the ancient world. This article examines the concept of retributive justice in Babylonian legal thought and analyzes the institutional foundations of punishment reflected in the Code of Hammurabi. Using normative legal research with historical and conceptual approaches, the study explores how punishment was constructed, legitimized, and applied within the social and political order of ancient Babylon. The findings show that the Code of Hammurabi embodied the principle of lex talionis, emphasizing proportionality between offense and punishment as a core expression of retributive justice. However, punishment was not merely a moral response to wrongdoing; it was also embedded in institutional mechanisms involving courts, royal administration, and the king’s authority as the ultimate source of legal legitimacy. The study further reveals that the application of punishment was shaped by Babylonian social hierarchy, where legal consequences varied according to the status of offenders and victims. Historically, the Code of Hammurabi contributed to the development of criminal law thought by providing an early foundation for proportional punishment, legal codification, and the relationship between law, authority, and social order.

Abstract

Organizational communication has increasingly been recognized as a strategic organizational capability that supports employee effectiveness and organizational performance, particularly within service-oriented industries. However, empirical evidence examining this relationship in geographically dispersed and culturally diverse regions remains limited. This study investigates the effect of organizational communication on employee performance in service companies located in Manokwari, West Papua, Indonesia. A quantitative research design was employed, and data were collected through structured questionnaires administered to 100 employees working in banking, telecommunications, hospitality, transportation, retail, and public service organizations. Respondents were selected using purposive sampling based on predefined eligibility criteria. The measurement instruments were adapted from established organizational communication and human resource management literature and analyzed using Structural Equation Modelling–Partial Least Squares (SEM-PLS) with SmartPLS 4. The results demonstrate that organizational communication exerts a positive and significant effect on employee performance (β = 0.756, t = 13.842, p < 0.001). The model explains 57.1% of the variance in employee performance (R² = 0.571), indicating that communication represents a substantial organizational determinant of performance outcomes. The findings suggest that communication characterized by clarity, openness, information accuracy, effective coordination, and constructive feedback enhances employees’ ability to perform their duties efficiently and collaboratively. Beyond confirming existing organizational communication theory, this study contributes to management literature by demonstrating the strategic importance of communication within service organizations operating in a geographically dispersed, culturally diverse, and infrastructure-constrained environment. The findings further imply that managers should prioritize the development of transparent, participative, and responsive communication systems to strengthen employee performance and organizational effectiveness.
