Abstract

The bankruptcy of a developer company often directly impacts condominium owners who have made a sale and purchase transaction, in the case of the bankruptcy of PT. Dwimas Andalan Bali condominium owners experience legal protection because the units that have been purchased are included in the bankruptcy estate. This study analyzes the developer's responsibility towards consumers in bankruptcy conditions and the legal status of condominium objects that are part of the bankrupt assets. The method used is normative legal research with a case approach focusing on the Supreme Court Decision Number 437 K / Pdt. Sus-Pailit / 2019. The study results show that in bankruptcy conditions, developers still have legal obligations to consumers who have fulfilled their achievements in the sale and purchase transaction. Based on Article 36 of Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations, consumers have the right to submit a request to the curator to ensure the process of extending condominium ownership rights to the Deed of Sale and Purchase (AJB) stage. Consumers are entitled to compensation or damages if these obligations are not met. In the case of developer bankruptcy, consumer rights must still be protected through available legal mechanisms, either through an application to the curator or other legal efforts. Therefore, it is necessary to strengthen legal protection for consumers so that they are not harmed in bankruptcy-related property transactions.

Abstract

This study reviews the problems regarding the mechanism for convicting corruption cases in Supreme Court Regulation Number 1 of 2020 concerning Guidelines for Conviction of Article 2 and Article 3 of the Law on the Eradication of Corruption Crimes. The presence of these normative rules has created a de-organization of the freedom of judges which should still reflect and go high the conception of Divine Justice in accordance with the irah-irah which reads "For the Sake of Justice Based on the Almighty Godhead". The research method used is normative juridical research, while the research approach is to use the assessment of statutory policies (statutory approach). The results of this study show that there are still problems in terms of the normative level and their implementation regarding the misalignment between the decisions decided by judges and the conception of Divine Justice in Indonesia.Keywords: Conviction; Divine Justice; Uniformity of MA Regulations AbstrakPenelitian ini mengulas permasalahan mengenai mekanisme dalam pemidanaan kasus korupsi pada Peraturan Mahkamah Agung Nomor 1 Tahun 2020 tentang Pedoman Pemidanaan Pasal 2 dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi. Hadirnya aturan normatif tersebut telah menciptakan penderogasian terhadap kebebasan hakim yang seharusnya tetap mencerminkan dan menjunjung tinggi konsepsi Divine Justice yang sesuai dengan irah-irah yang berbunyi “Demi Keadilan Berdasarkan Ketuhanan Yang Maha Esa”. Metode penelitian yang dipakai yaitu penelitian yuridis normatif, sementara pendekatan penelitiannya yaitu menggunakan pengkajian peraturan perundang-undangan (statutory approach). Hasil penelitian ini menunjukkan bahwa masih terdapat problematika dari segi tataran normatif serta implementasinya mengenai ketidakselarasan antara putusan yang diputuskan oleh hakim dengan konsepsi Divine Justice di Indonesia.Kata Kunci: Pemidanaan; Divine Justice; Penyeragaman Peraturan MA

Abstract

Repurchase agreements, which govern transactions within the trading community, constitute a type of securities financing that involves the purchase and sale of instruments on cross-border markets. The author examines a variety of documents about contracts, acquisitions, and document-based communication in this article. The author concurs that truthful consumers must be conscious of purchasers' challenges during transactions and that legal considerations and data transfer must be factored into mortgage and real estate transactions. Therefore, consumers must guarantee compliance with these provisions in good faith or at the very least, have confidence in their compliance. Utilizing a qualitative methodology, this study examines statutory regulations and the literature. According to the conclusion, legal repercussions may result from resale agreements with debtors (consumers) who engage in dishonest conduct during pandemic transactions or contracts. They remain perpetually if they are associated with a transaction; they cannot renegotiate or redeem the debt security.

Abstract

Abstract:This paper aims to identify, analyze, and provide an understanding of the implementation of e-courts as well as the impacts and challenges in implementing e-courts at the Central Jakarta Religious Courts. Apart from that, this paper uses empirical normative research methods using the legal approach and conceptual approach. Approach to Law Number 1 of 2019 concerning electronic court administration and electronic courts. In this paper, the results show that the existence of e-court has an impact on the progress of the justice system in Indonesia and realizes justice based on simple, fast and low cost. The impact of the existence of the e-court system itself in the judicial process with the development of digital technology, the transformation of the court to become a modern court that utilizes digital information technology to the fullest is a necessity. Keywords: E-Court, Impact, Challenges.Abstrak:Tulisan ini bertujuan untuk mengetahui, menganalisis, dan memberi pemahaman mengenai pelaksanaan e-court serta dampak dan tantangan dalam pelaksanaan e-court di Pengadilan Agama Jakarta Pusat. Laindaripada itu tulisan ini menggunakan metode penelitian normatif empiris dengan menggunakan metode pendekatan undang-undang dan pendekatan konseptual. Pendekatan Undang-Undang Nomor 1 Tahun 2019 tentang administrasi pengadilan secara elektronik dan pengadilan secara elektronik. Pada tulisan ini hasil menunjukan bahwa dengan adanya e-court sangat berdampak bagi kemajuan sistem peradilan di Indonesia serta mewujudkan peradilan yang berasaskan sederhana, cepat dan biaya ringan. Dampak dari adanya sistem e-court ini sendiri dalam proses berperadilan dengan semakin berkembangnya teknologi digital, maka transformasi pengadilan untuk menjadi pengadilan yang modern yang memanfaatkan teknologi informasi digital secara maksimal adalah sebuah keniscayaan. Kata Kunci: E-Court, Dampak, Tantangan.

Abstract

Management of Village-Owned Enterprises (BUMDesa) in Indonesia has become the focus of attention in improving public service quality and community welfare. In this context, the integration of sharia principles in the management of BUMDesa becomes very important to ensure compliance with religious and ethical values. This article discusses the importance of legal accountability and integration of sharia principles in the management of BUMDesa in Indonesia. Using library research methods, this article finds that the integration of sharia principles in the management of BUMDesa can increase legal accountability and transparency in financial management. In addition, this article also shows that the integration of sharia principles can ensure compliance with religious and ethical values in the management of BUMDesa. The results of this research can be a reference for the government and BUMDesa managers in improving the quality of BUMDesa management and improving community welfare.
