Abstract

Indonesia constitutes state transit to divide illegal immigrant , asylum and refuge e seeker.International protection on refugees is managed in Convention 1951 and Protocols 1967 about status of Refugee. Indonesia until now haven’t ratification Convention 1951 and Protocols 1967 about status of Refugee, so no special national law that manages about status of and in the presence asylum seeker and Refugee at Indonesian. Handle on illegal immigrant , asylum and refugee seeker performed by Immigration General directorate as institute of expatriate supervisor that given by authority by Indonesia Government to do collaboration and asks for UNHCR’S help (United Nations High Commissioner for Refugees) and IOM (International Organizations for Migrant). Abstract

Archipelago are divided into provincial regions and these provincial regions shall be divided into districts and cities, as a unitary state is a consequence of the geographical condition of Indonesia’s maritime territory very wide, approximately 2 / 3 area of the country in the form of oceans. Indonesia was internationally recognized as the State Maritime defined in UNCLOS 1982 which authorizes and expands Indonesian waters with all the provisions that follow. Law politics government now trying to restore the paradigm of the development with a vision of strengthening maritime country, but Article 27 of Law No. 23 Year 2014 on Regional Government requires management of marine areas no longer in the blood of an autonomous government but the provincial government. what the purpose of Article 27 of Law No. 23 of 2014 and whether the politics of law Article 27 of Law No. 23 of 2014 in the management of marine areas in the region in accordance with national law politics? especially in realizing the vision of a maritime nation. The authority of the management of marine areas in the region has shifted from the authority of the government district / city under the authority of the provincial government as a result of the symptoms of centralization of Law No. 23 of 2014, when examined this case is contrary to the principle of local autonomy, so that needs to be re-examined legal political government to rebuild vision Indonesia as a pluralistic character of the State Maritime for society as a main pillar to build a maritime country has been made uniform in Law No. 23 of 2014. Abstract

The geographical condition of Indonesia as a country of two thirds is the area of marine waters which consists of coastal seas, loose seas, bays and straits which has 95.181 km long beach, with 5.8 million km / square of water. The sea waters are large and rich in various types of marine potential of approximately 4 billion USD / year. But unfortunately, who enjoy all the wealth of the sea is not only the people of Indonesia but foreign nationals as well. Starting from the Exclusive Economic Zone (ZEE) to the territorial sea is an area that is often the case of illegal fishing by foreign country, recorded 242 foreign ships caught in the territory of Indonesia which caused losses of up to 160 billion rupiah. The problem in this research is how is the Legal Politics of Fishery Court in Indonesia and whether Fishery Court has been quite effective in examining, hearing, and deciding criminal acts in the field of fisheries. The author uses normative legal research methods in this research. The results of research that the authors get is the legal politics of the Fishery Court in Indonesia can be seen from the birth of Law Number 45 Year 2009, Presidential Decree Number 15 Year 2010 and Presidential Decree Number 6 Year 2014. Fishery Court in Indonesia has not been effective enough in checking, Prosecute, and cutting of criminals offenses in the field of fisheries due to frequent overlapping or authority disputes with agencies or other agencies. Therefore, the Fishery Court needs to synergize with the Water Police, Navy, Department of Marine Affairs and Fisheries (DKP), and the society so that law enforcement efforts against theft of fish can be more effective. Kondisi geografis Indonesia sebagai negara yang dua pertiganya adalah wilayah perairan laut yang terdiri dari laut pesisir, laut lepas, teluk dan selat memiliki panjang pantai 95.181 Km, dengan luas perairan 5,8 juta km/persegi. Perairan laut yang luas dan kaya akan jenis potensi kelautan kurang lebih 4 miliar USD/tahun. Namun sayangnya, yang menikmati semua kekayaan laut itu bukan hanya rakyat Indonesia tapi warga negara asing juga. Mulai dari Zona Ekonomi Ekslusif (ZEE) hingga laut teritorial adalah wilayah yang rawan terjadi pencurian ikan oleh negara asing, tercatat 242 kapal asing yang tertangkap di wilayah Indonesia yang menyebabkan kerugian negara hingga 160 miliar rupiah. Adapun yang menjadi permasalahan dalam penelitian ini yaitu bagaimanakah politik hukum Pengadilan Perikanan di Indonesia dan apakah Pengadilan Perikanan sudah cukup efektif dalam memeriksa, mengadili, dan memutus tindak pidana di bidang perikanan. Penulis menggunakan metode penelitian hukum normatif dalam penelitian ini. Hasil penelitian yang penulis dapatkan yaitu politik hukum Pengadilan Perikanan di Indonesia dapat dilihat dari lahirnya Undang-Undang Nomor 45 Tahun 2009, Keputusan Presiden Nomor 15 Tahun 2010 dan Keputusan Presiden Nomor 6 Tahun 2014. Pengadilan Perikanan yang ada di Indonesia belum cukup efektif dalam memeriksa, mengadili, dan memutus tindak pidana di bidang perikanan dikarenakan sering terjadinya tumpang tindih atau sengketa kewenangan dengan lembaga atau instansi lainnya. Oleh sebab itu, Pengadilan Perikanan perlu melakukan sinergi dengan Polisi Perairan, TNI AL, Departemen Kelautan dan Perikanan (DKP), dan masyarakat sehingga upaya penegakan hukum terhadap pencurian ikan bisa lebih efektif. Abstract

Sovereignty of the people is placed in the context of political, legal ideals of Pancasila as stated in the preamble of the 1945 Constitution which boils down to, sovereignty, and prosperity of the people. accordance with the spirit of the precepts contained in the 4th Pancasila democracy that requires Indonesian-style democracy that is based on the notion “wisdom of deliberation representative” popular sovereignty in accordance with the ideals of Pancasila law can be seen from the construction of the founding fathers thought, that Indonesia’s democracy is a democracy that has its own characteristics, which is based on the principle of collectivism. Abstract

The most high-income of Indonesia is 75 % derived from Tax. Misappropriation oftax collection came from tax dispute resolution manipulation.  Misappropriation of Tax suspected due to unindependently Tax Court in Indonesia. Academic analythical through a philosophical base of absolute competence in upholding its independence Justice in case of Tax Justice .This review based on the analythical method of the absolute competence of the Tax Court with Juridical aspects associated with Philosophical Aspects of the Tax Justice standing. The results will confirmed with the experts opinion (of Taxation and law, particularly with the Administrative Law and Constitutional Law) The Legal opinion will be  analyzing with the provisions of laws and regulations related to the subject matter following the constitution to the level of the basic aspects of the establishment basic norms of legislation. The opinion of the analysis are expected to provide an answer of the Tax Court standing in order to preserve the independence and impartiality of the Tax Court in its function to examine, hear and decide disputes of  Tax interference any party. Abstract

Since 1999 until 2015, Riau Archipelago Province was a regency. Riau Archipelago had passed development process for six times. In 1999, Karimun Regency, Natuna Regency and Batam City were formed. In 2001, the administrative city of Tanjung Pinang was formed. In 2003, Lingga Regency was formed, and In 2008 Anambas Archipelago Regency was legalized. Until this time, the dynamic of development in Riau Archipelago Province is still powerful. The fact there are five of seven Regencies / cities are in effort to be developed. This dynamic of development also happened in Lingga Regency, eventhought with the smallest Regional Fund Budget in Riau Archipelago Province. the purpose of this study is to explain the efficient estimation and time for new autonomy region increament in Lingga Regency. The parameter of region systemation which is used in this study is based on outonomy region systemation in big design of region systemation in indonesia of 2010-2025 which considered the geography dimension, demography dimension and system dimension. this study concludes based on the dimension of geography, economy, financial system, public administration system, and regional government management system, Natuna Regency is able for one new autonomy region increment. however, based on dimension of demography, security and defence system, and politic and culture social system, Lingga Regency is not recommended for new autonomy Region increment. totally, maximum amount estimation of new autonomy region increment in Lingga until 2025 is only one new autonomy region. Abstract

Whistle blower’s corruption case has a significant role in law enforcement, where they are familiarly known as whistle-blower assist law enforcement role in exposing acts of corruption, especially if the person who is the whistle blower participate as suspects. Should the state provide attitude in providing legal protection in such cases that the person providing the information is also awarded in addition to legal protection. In this research using normative legal research will be reviewed in the presence of whistle blower protection laws in order to be opened in a brightly lit cases.  Keywords: Corruption, whistleblowers, Legal Certainty, Fairness   Peniup peluit untuk kasus tindak pidana korupsi mempunyai peranan yang cukup signifikan dalam penegakkan hukum, keberadaan mereka yang akrab disebut sebagai whistle blower membantu peranan penegak hukum dalam mengungkap terjadinya tindak pidana korupsi khususnya jika orang yang menjadi whistle blower ikut menjadi tersangka. Negara Hendaknya memberikan sikap dalam memberikan perlindungan hukum dalam hal demikian agar orang yang memberikan informasi juga mendapatkan penghargaan selain mendapatkan perlindungan hukum. Dalam penelitian ini dengan menggunakan penelitian hukum normatif akan dikaji keberadaan peniup peluit dalam perlindungan hukum agar dapat dibuka secara terang benderang kasus yang ada. Abstract

International legal instruments governing trade relations between countries is contained in documents the GATT (General Agreement on Tariffs and Trade) countries signed in 1947, and entered into force since 1948.From time to time the provisions of GATT negotiations enhanced through a range of rotation, the last through the Uruguay Round negotiations that succeeded in forming an organization of world trade (World Trade Organization / WTO). International economic organizations in addition to the WTO there are also regional organizations, namely the ASEAN-China Free Trade Agreement (ACFTA). ACFTA Agreement is a trade agreement between ASEAN countries on the State of China. ACFTA has been effectively running in January 2010. The legal basis of the ACFTA is the Framework Agreement on Comprehensive Economic Cooperation Between the Association of Southeast Asian Nations and the People’s Republic of China, which was signed by the President of the Republic of Indonesia (Megawati) on December 4 Novenber 2002 in Phnom Penh, Cambodia, and has been ratified by the President Republic of Indonesia through the Decree of the President of the Republic of Indonesia Number 48 Year 2004 on Ratification of the Framework Agreement on Comprehensive Economic Cooperation Between the Association of Southeast Asian Nations and the People’s Republic of China (Framework Agreement). The implementation of ACFTA in 2010 marked the entry of Chinese goods are flooding the Indonesian region, including the city of Pekanbaru greatly affect domestic goods produced by Micro, Small and Medium Enterprises (SMEs) Pekanbaru. The influx of goods from China makes more and more choice for the consumer goods Indonesian. The prices of goods from China are relatively inexpensive and varied lead Indonesian consumers prefer and buy goods from China. Abstract

Citizenship is the issue relating to citizen, while naturalization is the procedures for foreigners to obtain Indonesian citizenship as mandated by law no 12 of 2006 concerning citizenship. Riau Archipelago Province as the border area had an impact on the number of international marriage consequences that affects the status of the child which born within the international marriage. Limited dual citizenship filing of applications filed at the Regional Office of the Ministry of Justice and Human Rights of Riau Archipelago Province the raises issues related to the governing law of citizenship and the filing procedure of it. Emerging issues related to the filing of citizenship in border regions associated Islands received a request for the limited dual citizenship and statutory provisions that set the date line of the submission on the limited dual citizenship and statutory provisions that set the date line of the submission on the limited dual citizenship until August 1, 2010 Keywords :  Citizenship.

Abstract

The law governing about employment in Indonesia is Act No. 13 of 2003. Basic of the employment relationship is working contract. Employment contract is divided into two types, namely employment contract limited time (PKWT) and the Employment contract for an unlimited time (PKWTT). Workers rights have often been ignored. Implementation of a limited time employment contract (PKWT) in labor relations according to Law No. 13 of 2003 on Employment in Indonesia has not run in accordance with applicable regulations. For the business sector in the many city in Indonesia, relatively fewer offenses committed by employers related to the provision of workers rights. However, the opposite occurred in the area. Employers have ignored the maximum time limit allowed by Act No. 13 of 2013 on Employment about PKWT time period. Granting rights of workers given time such as wages, hours of work and social security is still not met expectations. Constraints in the implementation of PKWT according to Law No. 13 of 2003 lies in two things, the first factor on the implementation PKWT rules that do not conform to the requirements. Employers may not recruit workers for something that is not needed in the course of the company. Most of the type and nature of the work required is the work that goes into the core work of the production process and are fixed. So in this case there has been a violation of article 59 fatal Employment Act, which is caused by the object of the work that is prohibited by the provisions of law to PKWT. Judging from the facts given time workers should have switched the status of a PKWTT, because they have been doing work that is fixed. The second factor, the omission of the deviation PKWT provisions in the employment relationship is also caused by very lax government oversight of the reality on the ground and nothing punishment on article 59.  Keywords:  PKWT (Employment Contract Limited Time), Work Relationship, Labour Law   Penerapan perjanjian kerja waktu tertentu (PKWT) dalam hubungan kerja menurut Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan belum berjalan sesuai dengan ketentuan yang berlaku. Pengusaha telah mengabaikan batas waktu maksimal yang diperkenankan oleh Undang-Undang Nomor 13 tahun 2013 tentang Ketenagakerjaan tentang masa waktu PKWT. Pemberian Hak-hak pekerja waktu tertentu seperti upah, jam kerja maupun jaminan sosial tenaga kerja juga masih belum memenuhi harapan. Hal ini merupakan pelanggaran terhadap hak asasi pekerja sebagai warga negara Indonesia yang hak-hak dasarnya telah dilindungi di dalam Undang-Undang Ketenagakerjaan RI. Kendala dalam pelaksanaan PKWT menurut Undang-Undang Nomor 13 Tahun 2003 terletak pada dua hal, pertama faktor aturan tentang pelaksanaan PKWT yang tidak sesuai dengan kebutuhan lapangan kerja. Pengusaha tidak mungkin melakukan perekrutan pekerja untuk sesuatu yang tidak dibutuhkan dalam berjalannya perusahaan. Sebagian besar jenis dan sifat pekerjaan yang dibutuhkan adalah pekerjaan yang masuk dalam pekerjaan inti dari proses produksi dan sifatnya tetap. Sehingga dalam hal ini telah terjadi penyimpangan yang cukup fatal terhadap Pasal 59 Undang-Undang Ketenagakerjaan, yang diakibatkan oleh obyek pekerjaan yang dilarang oleh ketentuan undang-undang untuk PKWT.
