Abstract

Indonesia is an archipelago with a variety of art and culture is very rich, the overall wealth of the nation is a potential that needs to be protected. The wealth of art and culture is a source of intellectual property that are given legal protection through legislation. one of the art treasures are protected Indonesian Batik Art. Copyright law protection against Batik Art by Article 12, letter i of Law Number 19 Year 2002 on Copyright. This protection is given as batik art as an intellectual work is a work that has artistic value in the creation of images or motifs or color composition. Wealth of art and culture in every area there in this nation, in addition to useful for the formation of character and dignity of the nation, also can be used to grow the creative economy. Pekanbaru as the capital of Riau province has a variety of art that is steeped in Malay culture, is one of the artistic diversity in creating the famous batik art batik wither. Abstract

The process of development are two sides of the same coin, one side is the physical development and the other side is human development. However, in the development process, usually prefer the physical development, and less attention to human development. Therefore, people as objects, not subjects of development. The political authorities see development only in terms of economic benefits, the development of socio-political side ignored. Therefore, the development has a problem. Maritime development in the coastal areas and archipelago are also experiencing the same dilemma. In order to obtain an understanding of maritime development, this study will analyze the policy of the Sunda Strait bridge. Therefore, this study will analyze, who benefited from the Sunda Strait Bridge project, and who was defeated in the Sunda Strait Bridge project. If we read Peraturan Presiden (Perpres) No 86 Tahun 2011 related to the Sunda Strait Bridge, the actors had been found, they are government officials (local and central) and national enterprises. This research found that conflicts of interest between the central and local elite, has resulted in making the Sunda Strait bridge construction was delayed several times. Clearly, national enterprises seems to be the main actor in the local policy, both in Lampung and Banten. Abstract

The suspension of payment (PKPU) is addressed to reach an agreement. The practice showed there are many obstacles towards an agreement performance. Hence, it is necessary for a legal reform, by conducting the legal harmonization into PKPU concepts. The comparative evaluation of this legal harmonization is the Indonesian Legal Culture. Abstract

Gejala pemekaran daerah di Indonesia sejak tahun 1999 cendrung meningkat. Mulai Oktober 1999 sampai Januari 2008 telah terbentuk 164 daerah baru yang terdiri dari 7 Provinsi baru, 134 Kabupaten baru, dan 23 Kota baru. Gejolak pemekaran daerah di berbagai daerah di Indonesia hingga hari ini terus berkembang. Meskipun hasil evaluasi pemekaran daerah menunjukkan prestasi yang tidak baik namun hingga kini masih banyak daerah di Indonesia yang berniat membentuk daerah otonom baru. Seperti yang terjadi di Provinsi Kepuluan Riau. Wacana tersebut diantaranya di Kabupaten Bintan, karimun dan kabupaten Lingga. Penelitian ini bertujuan untuk mengetahui dan menjelaskan mekanisme pemekaran daerah di Indonesia dan untuk mengetahui dan mengalisa penyebab keinginan pemekaran daerah di Kabupaten Bintan. Penelitian dilakukan dengan pendekatan penelitian kualitatif. Teknik pengumpulan data yang digunakan adalah telaah pustaka dan wawancara. Kajian ini menyimpulkan adanya perubahan proses pemekaran di Kabupaten Bintan, dari Kabupaten Bintan Timur sebagai kabupaten induk dan Kabupaten Bintan Utara sebagai kabupaten pemekaran, dalam perjalanannya berubah Kabupaten Bintan Utara menjadi kabupaten induk dan Kabupaten Bintan Timur menjadi kabupaten pemekaran serta masih ada pro dan kontra dalam proses pemekaran ini, hal ini harus dikelola dengan baik untuk menghindari perpecahan di masyarakat. Abstract

The domino effect of employment problems is unemployment will have a negative impact on the survival of nation and state. The negative impact of unemployment is the increasing variety of criminal acts, the increasing number of homeless and street singers, has become a social pathology or social germ disease that spread like a virus that is difficult to eradicate. Therefore it is necessary to do a serious step both from the side of the government and the labor itself and of course the willingness of the company. The government serves as a supervisor and regulator as well as facilitators of both parties of the company and workers not to harm each other. The worker should try to continue to improve his competence so that he has a higher bargaining power over the company rather than relying solely on government protection. And finally the good faith of the company so as not to see the worker as a cost factor but an important asset of the company, so that the company can maximize the value of the company itself. This can be seen from the days before independence, after independence, the old order, the new order, and the reform era have each of the existing legal dynamics. In addition, in realizing sustainable legal development must prepare the participation of all parties, so as to realize the protection of good employment. Keywords: Development, Dynamics, Employment, Indonesia.   Efek domino dari masalah ketenagakerjaan adalah pengangguran akan menimbulkan dampak yang negatif bagi kelangsungan hidup berbangsa dan bernegara. Dampak negatif dari pengangguran adalah kian beragamnya tindakan kriminal, makin banyaknya gelandangan dan pengamen, sudah menjadi patologi sosial atau kuman penyakit sosial yang menyebar bagaikan virus yang sulit di berantas. Oleh karena itu perlu dilakukannya sebuah langkah-langkah serius baik dari sisi pemerintah maupun tenaga kerja itu sendiri dan tentunya kesediaan pihak perusahaan. Pihak pemerintah berfungsi sebagai pengawas dan regulator sekaligus fasilitator kedua pihak perusahaan dan pekerja untuk tidak saling merugikan. Pihak pekerja seharusnya untuk berusaha terus meningkatkan kompetensi dirinya sehingga lebih memiliki daya tawar yang lebih tinggi terhadap perusahaan dan bukannya hanya bergantung pada perlindungan pemerintah. Dan terakhir itikad baik dari perusahaan supaya tidak melihat pekerja sebagai faktor biaya melainkan sebuah asset penting perusahaan, sehingga perusahaan dapat memaksimalkan nilai perusahaan itu sendiri. Hal ini bisa dilihat dari zaman sebelum kemerdekaan, setelah kemerdekaan, orde lama, orde baru, dan zaman reformasi memiliki masing-masing dinamika hukum yang ada. Selain itu dalam mewujudkan pembangunan hukum yang berkelanjutan harus menyiapkan keikutsertaan semua pihak, sehingga bisa mewujudkan perlindungan ketenagakerjaan yang baik. Abstract

The Honorable General Elections Administrator Council (DKPP) was formed to check and decide on the complaints and/or reports about ethical codes violation allegations done by General Elections Administrator based on the mandate of Undang-undang Number 15 Year 2011 about General Elections Administrator. However, in reality, DKPP issuing a verdict was controversial because it was not its authority. The problems and the objectivesof this research were: 1) Determining how the authority of DKPP in handling the problems in general elections, and 2) Evaluating DKPP verdict Number 23 -25/DKPP-PKE-I/2012 pursuant to Undang-Undang Number 15 Year 2011 about General Elections Administrator. The method used was normative law research method using secondary data. The secondary data gathered from the library research was arranged in order and systematically to be analyzed using qualitative method to get the picture about the main problem comprehensively. This research showed that DKPP was a council formed to guard the ethics in the general elections. DKPP was an ethical institution assigned by Undang-undang Number 15 Year 2011. The authority of DKPP related to General Elections Administrator ethical codes enforcement was attributive and based on clause 109 verse (2), clause 111 verse (1), and also clause 112 verse (10) and (11). In fact, with the verdict of DKPP Number 23 -25/DKPP-PKE-I/2012, about legislative members general elections arrangement proses in 2014, DKPP verdict was considered controversial by telling KPU to do the factual verification on 18 political parties which were avowed did not fulfill the administration verification by KPU. It meant that DKPP made a decision which contradicted clause 1 verse 3 UUD 1945 which was in line with legality principle. About the DKPP verdict to be final and bounding was mentioned on clause 112 verse (12) where the defendants and the related parties could not do any legal efforts as experienced by the board of KPU secretary generals. This was quite contrary with UUD 1945 clause 28D verse (1) about legal protection rights and legal certainty which is as equal as possible in front of the law if the verdict issued was felt harming the defendants or the related parties. Abstract

This studyhas the objective toanalyze the data and information regarding the arrangement of credit agreement with collateral vessels in Indonesia. This research is a normative juridical that focus on the legal norms in force which are both contained in the legislation and literature. The method of data analysis was applied by using the model or method qualitative text analysis of the legislation and expert opinions relating to thelegal aspects ofthe loan agreement with collateral vessels. The results showed that, the vessel is possible as collateral in a bank credit agreement. Normatively, there are two ways to do binding guarantee with a form of collateral vessels. The first is the size of mortgagesto 20 m3 vessel with gross tonnage or more, the second is the fiduciary for vessels of under 20 m3 gross tonnage. Keywords : Collateral, Mortgages and Fiduciary

Abstract

Problems often occur in the management of UWTO extension until the extension of the HGB is long term processing time. Whereas the request for an extension not new appliacation. The method used in this research is observation, interview, literature study, design and simulation. Research resut in the office of Notary/PPAT Andreas Timothy, S.H., M.Kn is form procedures for handling UWTO extension until extension of HGB, form completeness of the maintenance file extension UWTO, form completeness of maintenance file extension HGB and monitoring programs are designed with Microsoft Office Excel. The design of the completeness of this file is designed to enable employees of the Office Notary/PPAT to understand the procedures for handling UWTO extension until extension of HGB when explaining to clients. Abstract

As an independent sovereign nation Indonesia has been actively involved in international relations and entered into international agreements with other countries, both bilateral and multilateral. Along with the developments that occur not only countries that can enter into international agreements but local governments have the authority in entering into international agreements with foreign parties. The method used in this research is normative law research. This study uses the legislation approach. The result of the research shows that Law Number 24 Year 2000 gives the regional authority to make international agreement, as regulated in Article 5. In addition, the regional authority in making international agreement is regulated in Law Number 12 Year 2008 regarding Regional Government. Mechanism of making international agreement by region, local government in this case that is Governor, Regent, or Mayor first ask opinion and consideration to DPRD to plan international agreement making. Keywords: Regional Authority, International Agreement   Sebagai negara merdeka yang berdaulat Indonesia telah aktif berperan dalam pergaulan hubungan internasional dan mengadakan perjanjian-perjanjian Internasional dengan negara-negara lain, baik yang bersifat bilateral maupun multilateral. Seiring perkembangan yang terjadi bukan hanya negara saja yang dapat mengadakan perjanjian internasional namun pemerintah daerah mempunyai kewenangan dalam mengadakan perjanjian internasional dengan pihak luar negeri. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Penelitian ini menggunakan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 24 Tahun 2000 memberikan kewenangan kepada daerah untuk membuat perjanjian internasional, hal tersebut diatur dalam Pasal 5. Selain itu kewenangan daerah dalam membuat perjanjian internasional diatur dalam Undang-Undang Nomor 12 Tahun 2008 tentang Pemerintahan Daerah. Mekanisme pembuatan perjanjian internasional oleh daerah, pemerintah daerah dalam hal ini yaitu Gubernur, Bupati, atau Walikota terlebih dahulu meminta pendapat dan pertimbangan kepada DPRD terhadap rencana pembuatan perjanjian internasional. Abstract

State of Indonesia is a country of Islands (Archipelago State), which consists of small islands as well as large and sea area larger than the land area. Geographical conditions is certainly going to require various forms of policies and legislation that have maritime pattern. Experience State of Indonesia ± 69 years gives a description of that in terms of public policy and legislation are born tend to be oriented on the mainland (continental oriented) from the ocean (archipelago oriented). Maritime should be viewed as an object that contains covers many areas of life in which between one and interrelated with other fields. In the "maritime" there are many areas that can be developed such as the legal, cultural, social, engineering and marine fisheries and of course itself. Already after the 1945 amendment ought be the starting point in the unification of maritime perception saw it as having the benefit of the various aspects. Support the legislation in drafting the legal framework of maritime Indonesias development should be one of the priorities in the development of law in Indonesia is better. Change of paradigm and mindset of the management of the State of aspects of the legislation that is based on a maritime course must be started from a higher rule, the Constitution or the Constitution of Republic of Indonesia in 1945.
