Abstract

In order to against the activities of alcoholic beverages in Bintan Regency, Regional Government of Bintan launched Regional Regulation No. 6 of 2011 concerning supervision and control of alcoholic beverages. This research is descriptive and kualitatif methods is used as research methods. Research data sources is a primary and secondary data. The informations is gathering from a number of books and through direct interviews with respondents in Bintan Regency Area. As the result, this Regional Regulation still need a few correction. This regulation is considered weak because it has not touch the distributors of alcoholic beverages but only the merchants. If this going so, the activities of alcoholic beverages in Bintan Regency will remain. The punishment of Regional Regulation breakers is still not strong enough and there is no real action for drinkers. As for islamics perspective, this regulation is not worked. Because in Islam alcohol is definitely forbidden. For moslems specially, this alcoholic beverages activities still be a nuisance.However, so far this Regional Regulation is giving a positive effects for alcoholic activities in Bintan Regency. It can be seen with the activities pre and post publication of the regulation. At the end of writing this research, Author have a suggestions that might be could give a contributes. Bintan Regency Government and Law Enforcement of Bintan could increase the effort to reducing alcoholic beverages activities by establishing a special agency against alcoholism. And hopefully could makes Bintan Regency is a “Alcohol Free Zone”.

Abstract

Children play a pivotal role in a country’s development. Indonesia has given security and protection towards each child in the country, in which it is part of the government policy and it has been billed as part of the State Law. In this case Act 34 2015, discusses about the changes of Act 23, 2002 in Children’s Protection which given the order to the regional government to execute the Children’s protection in the region. Riau Archipelago Province Government has carried out its duties in providing Child Protection in the region by regulating a Region Act 7,2010 for Children’s Protection Implementation. This Region Act is still in line with Children’s Protection Act 23, 2002. However, based on the research, there are still many loopholes in this Region Act as it has not accomodateregulations about the definition of children, definition of family, definition of children’s right, repayment of expenses incurred for medical care, children with disabilities, and children from mixed marriage. Therefore, Riau Archipelago Province Government has not been able to fully perform its duties and serve its roles in providing protection to the childrenin Riau Archipelago Province. The Riau Archipelago Region Act 7, 2010 about Children’s Protection Implementation is no longer relevant to the current children’s condition in Riau Archipelago. Hence, there must be an amendment to the Region Act 7, 2010 especially in certain substances which are based on the Old Children’s Protection Act. Keywords: Children’s Protection   Anak memiliki peran besar dalam pembangunan bangsa. Indonesia memberikan perlindungan kepada setiap anak, hal ini terlihat dari kebijakan pemerintah yang tertuang dalam peraturan perundang-undangan tepatnya Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak yang mengamatkan pemerintah daerah untuk melaksanakan perlindungan anak di daerah. Pemerintah Provinsi Kepulauan Riau telah menjalankan tugasnya memberikan perlindungan anak didaerah dengan dibentuknya Peraturan Daerah Provinsi Kepulauan Nomor 7 Tahun 2010 tentang Penyelenggaraan Perlindungan Anak. Peraturan Daerah tersebut masih merujuk pada Undang-Undnag Perlindungan Anak Nomor 23 Tahun 2002. Namun berdasarkan hasil penelitian, Perda tersebut masih memiliki terdapat banyak kekurangan karena Perda belum mengakomodir aturan tentang definisi anak, definisi keluarga, definisi hak anak, restitusi, anak penyandang disabilitas, dan anak dari perkawinan campuran. Sehingga pemerintah Provinsi Kepulauan Riau belum dapat melaksanakan tugasnya dan menjalankan perannya dalam memberikan perlindungan anak di daerah provinsi Kepulauan Riau dengan maksimal. Peraturan Daerah Provinsi Kepulauan Riau Nomor 7 Tahun 2010 tentang Penyelenggaraan Perlindungan Anak sudah tidak relevan dengan kondisi anak di Provinsi Kepulauan Riau saat ini. Oleh karena itu perlu dilakukan revisi Peraturan Daerah Nomor 7 Tahun 2010, khususnya substansi tertentu dari Perda yang dibentuk atas dasar undang-undang perlindungan anak yang lama. In Indonesia, the protection of human rights spread in product legislation, however the practice field find the constraints that hamper the protection of human rights itself. Abstract

1982 UNCLOS stipulates that Indonesia as the archipelago state only has the enforcement jurisdiction in its contiguous zone to exercise control to prevent infringement and to punish infringement of its customs, fiscal, immigration and sanitary laws and regulations within its territory or territorial sea. This is detrimental to Indonesia because it can not reach the violation of customs, fiscal, immigration, and sanitary laws and regulations within the contiguous zone itself. Therefore, Indonesia should estabilish Law on The Contiguous Zone to claim legislative jurisdiction in it a long with the enforcement jurisdiction. Then it could also regulate as to the violation of customs, fiscal, immigration, and sanitary laws and regulations within its contiguous zone, not only those conducted within its territory and territorial sea. Abstract

Bondary not only separate territories that are owned by different communities or countries but also ensure the safety and well-being balanced between each area concerned. Riau Islands Province is leading directly adjacent to neighboring countries such as Malaysia, Singapore  the Philippines, and Thailand. Conditions islands region in Riau (Riau Islands) are very much separated by an ocean, the area is 252 601 km2 area consisting of 1,350 islands and 96% Ocean thus making control range of the government in development planning very difficult. This study will look at how the government’s Agenda Setting in the border area development planning Riau Islands, which will discuss the issue and political currents flow in the policy agenda to the policies made by the government of Riau islands as border regions. The method used in this study is qualitative. The study was conducted in Regional Development Planning Board (Bappeda) Riau Islands Province, the Regional Border Management Agency (BNPPD) Riau Islands Province and Commission III of the House of Representatives (DPRD) Riau Islands Province. Data collection techniques performed in this study were interviews, collecting data document written and unwritten, and non-participant observation. Results from this study is the first, the flow of matter to explain the issues and problems that occur on the border of Riau Islands namely the problem of limited infrastructure such as facilities and infrastructure such as facilities and infrastructure of housing, education, health, security, and also facilities and transport infrastructure, telecommunications, and Other causes of this region have low accessibility and isolated from the surrounding region. Secondly, the flow of Politics explains the policy process and then view and objectives to be achieved still has a perception about the construction of the border is still different, the level of public participation, NGOs, academics and NGOs are still relatively low, the handling is still partial, sectoral and yet integritasi, coordination has not gone good, both among sectoral, national level and between the central government and local governments, commitment and development budget in the border area is still relatively minimal. Third, Flow Policy describes several emerging priorities namely, development of processing industry, fishery and tourism in a sustainable manner in order to support the sector of maritime, increasing production and agricultural productivity, as well as self-reliance and food security community, Improved connectivity between regions and between the island and the means and basic infrastructure of society, Improving the quality of the environment and forestry, natural disaster mitigation and climate change, peningatan quality human resources and well-being equitable and civilized society, Improving the quality of public services and good governance. Abstract

Giving some penalties by sinking the foreign fishing vessels is one of the efforts of the country in eradicating of illegal fishing. Besides that it will also give a deterrent effect or will counteracting from violation in the border area or outside the border area that can harm Sovereignty of the country. Indonesian government policy that sinking the fishing vessels that has been proved doing the illegal fishing in Indonesia waters has raised many pro’s and contras. The conclusion that can be reach is what are the Impacts from sinking the foreign Fishing vessels. Is it positive or negative impact? The positive impact that happen from this policy is Indonesia government can stop illegal fishing activity and also to rescue aquatic habitat in the sea from bomb of foreign fishermen.  While the negative impact is pollution because of the explosion and burning the foreign vessels that can pollute the air around the sea.Writers suggest that law enforcement of sinking the foreign vessels must be conducted together with budget support facility that adequate with the enforcement, for example adequate personnel, adequate facilities and infrastructure (firearms, boat/ship, and fuel supply in operating the ship so that the supervisor can reach all part of the sea in Indonesia. Keyword:  Foreign Ship, Illegal Fishing   Pemberian sanksi dengan cara penenggelaman merupakan upaya negara dalam memberantas kegiatan perikanan yang dilakukan secara illegal dan disamping itu juga untuk memberikan suatu efek jera atau menangkal terhadap pelanggaran di Wilayah Perbatasan atau di Luar Perbatasan Laut Indonesia yang dapat merugikan dan mengancam kedaulatan negara. Kebijakan pemerintah Indonesia yang menenggelamkan kapal-kapal yang terbukti melakukan illegal fishing di wilayah perairan Indonesia menuai pro dan kontra, banyak yang mendukung tetapi juga tidak sedikit yang menolak, demikian pula protes dari negara bendera kapal. Kesimpulan yang dapat diambil adalah apa saja Dampak dari penenggelaman kapal nelayan asing ini menimbulkan dampak yang positif dan juga menimbulkan dampak yang negatif. Dampak positif yang diperoleh dari kebijakan ini adalah pemerintah Indonesia dapat menghentikan aktivitas pencurian ikan serta menyelamatkan habitat perairan di dalam laut dari bahaya Bom nelayan asing. Sedangkan dampak negatif yang ditimbulkan dari kebijakan ini adalah ditimbulkannya polusi hasil peledakan dan pembakaran kapal asing yang dapat mencemari udara disekitar laut. Yang mana saran yang penulis berikan adalah Upaya penegakan hukum berupa penenggelaman kapal harus diiringi dengan dukungan anggaran fasilitas yang memadai dalam penegakkannya, misalnya personil yang memadai, sarana dan prasarana menunjang cukup seperti peralatan senjata api, kapal, hingga dukungan suplai BBM dalam pengoperasian kapal sehingga para pengawas mampu menjangkau seluruh bagian wilayah laut Indonesia. Abstract

The purpose of granting regional autonomy is to empower the region in the form of improving care, protection, welfare, initiative, creativity, and community participation in development, foster democracy, equity and justice, and unity, unity, and national harmony in the remembrance of the origin of an area, diversity and characteristics, as well as potential areas that lead to the improvement of the welfare of the people in the system of the Republic of Indonesia. In that regard, it has been made Cooperation Agreement between PT. (Persero) IPC I Branch Tanjung Pinang Tanjung Pinang with the City Government B.XIV-1/TPI-US.15 Numbers and Number 552.3/091.A/HUBLA signed on March 15, 2011 on the Management of Pas Log of Domestic Passenger Terminal in port of Sri Bintan Pura Tanjung Pinang. Examined in this study are some of the regulations that form the basis of law in the cooperation agreement which according to the author it is important to study whether the regulation is used as a legal basis in the agreement is appropriate or not. Also on the principles and factors that must be considered in the drafting of the contract. Methods The approach used in this study is normative methods. From these results it can be concluded that in principle any drafting the contract is to be an agreement of the parties ranging from the use of the term contract until the dispute settlement while referring to the legislation in force, is not contrary to public order and decency. Factors that must be considered by the parties and will hold the legal authority to make the contract are the parties, taxation, over a legal right, the problem keagrarian, choice of law, dispute resolution, termination of contract, and the agreed standard form of agreement. That the legal basis used by PT. IPC I (Persero) Branch Tanjung Pinang in the partnership agreement is in conformity with the applicable regulations. That the legal basis used by the Local Government Tanjungpinang in the partnership agreement does not conform and contrary to regulations. Abstract

Indonesia has a legal tradition from Dutch Law. One of it is Bankruptcy Law, which is Staatsblad 1905 No. 217 jo. Staatsblad 1906 No. 348. In 1998, when Indonesia faced the economic crisis, through IMF’s demand, Indonesia had to make any revisions on that Bankruptcy Law, and become the Act No. 4 Year 1998. There some problems occurred when Act No. 4 Year 1998 was implemented then it changed become Act No. 37 Year 2004. One of the big problems which became the trigger was the case of Prudential Insurance, which was stated bankrupt by the court. This writing has a goal to pierce or detect the interests which might appear among the process of those Bankruptcy Law revisions, whether or not there is a falsifity of law indication. Abstract

Indonesia is a vast archipelago country and borders directly with other countries. This article will look at the role of local government borders on child protection. The author will explain the rights of children to education and health. This paper also discusses how the role of local government borders on child protection, as well as offering ideas on child protection by the border area. The conclusion of this paper, the role of border areas are still lacking in meeting the protection of children, this is due to lack of support from the central government. Abstract

Law number 52 of 2009 on the development of population and family development has formulated a policy to achieve the goal of a prosperous family, through a policy of family planning counseling. Riau Archipelago Province as the local government has not been able to implement the policy to the fullest because it has not had a civil servants as family planning counselor. Keywords: Family Planning Counseling   Undang-Undang Nomor 52 Tahun 2009 tentang Perkembangan Kependudukan dan Pembangunan Keluarga telah merumuskan kebijakan untuk mencapai tujuan keluarga sejahtera, melalui kebijakan penyuluhan keluarga berencana. Provinsi Kepulauan Riau sebagai pemerintah daerah belum dapat melaksanakan kebijakan tersebut secara maksimal karena belum memiliki PNS sebagai tenaga penyuluh keluarga berencana.
