Abstract

Dana desa yang dikelola belum sepenuhnya bebas dari korupsi. Fakta di lapangan menunjukkan tingginya kasus korupsi dana desa di Provinsi Riau. Penelitian ini bertujuan menganalisis penegakan hukum korupsi dana desa di Provinsi Riau beserta penyelesaian hukumnya. Penelitian ini bersifat deskriptif dengan jenis penelitian yuridis empiris melalui pendekatan perundang-undangan dengan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa penegakan hukum tindak pidana korupsi dana desa belum berjalan maksimal, karena terdapat kendala di antaranya: perbedaan persepsi penegak hukum dalam menghitung kerugian keuangan negara, tersangka kabur, sulitnya menghadirkan saksi, sumber korupsi tidak hanya dana desa, dan terpidana tidak membayar uang pengganti. Penyelesaian hukumnya dengan penjatuhan pidana penjara, denda, dan pidana tambahan bagi terpidana.

Abstract

Tindak pidana teknologi informasi merupakan bentuk kejahatan yang relatif baru apabila dibandingkan dengan bentuk-bentuk kejahatan lain yang sifatnya konvensional. Perkembangan teknologi informasi yang demikian pesatnya haruslah diantisipasi dengan hukum yang mengaturnya. Berdasarkan data dari organisasi dunia yang menangani masalah anak, United Nations Emergency Children’s Fund, angka global anak yang diperdagangkan tiap tahunnya ada sekitar 1,2 juta dan sekitar 2 juta anak di seluruh dunia dieksploitasi secara seksual tiap tahunnya. Berdasarkan latar belakang permasalahan tersebut untuk melakukan penelitian terhadap Kebijakan Penanggulangan Tindak Pidana Teknologi Informasi Melalui Hukum Pidana, maka dalam penulisan artikel ini dibatasi permasalahanya yaitu: Bagaimana kebijakan formulasi terhadap tindak pidana teknologi informasi penjualan online organ tubuh saatini. Kebijakan kriminalisasi di dalam UUITE tidak hanya mengatur terhadap perbuatan yang terkait dengan dunia maya tetapi juga mengkriminalisasi delik-delik tertentu di bidang cybercrime.

Abstract

AbstrakPembinaan Narapidana dan Anak Pidana Narkoba (Narkotika, Psikotropika, Obat-obat Berbahaya) telah membedakan dengan pembinaan narapidana pada umumnya. Penulisan ini dapat diketahui pemberian remisi merupakan hak bagi narapidana dan anak pidana yang tidak dapat dipisahkan dengan kewajiban. Hak dan kewajiban harus saling terpenuhi, dan saling seimbang. Persyaratan pemberian  remisi bagi narapidana  Narkoba  merupakan  suatu pengetatan, selain memenuhi syarat umum berupa berkelakuan baik, juga syarat khusus berupa narapidana yang dipidana penjara paling singkat 5 tahun, dan bersedia bekerjasama dengan instansi penegak hukum untuk membantu membongkar perkara tindak pidana yang dilakukannya. Sedangkan konsekuensi yuridis terhadap pengetatan Pemberian Remisi bagi Narapidana Narkoba akan menimbulkan dampak negatif berupa penyalahgunaan jabatan/kekuasaan, dan perlakuan diskriminatif, bahkan bagi narapidana pengedar / bandar narkoba tidak akan diberikan remisi. AbstractGuidance of Prisoners and Criminal Children Narkoba (Narcotics, Psychotropic, Dangerous Drugs) has distinguished the coaching of convicts in general. This writing can be known Remissions are the right of prisoners and criminal children who can not be separated by obligations. Rights and obligations must be mutually met, and mutually balanced. Giving Remission of Requirements for Narkoba Prisoners is a tightening, in addition to meeting the general terms of good behavior, as well as special terms conditions of prisoners who are sentenced to imprisonment of at least 5 years, and are willing to cooperate with law enforcement agencies to help dismantle cases of criminal acts committed. Whereas the juridical consequences of tightening remission for Narkoba Prisoners will have a negative impact in the form of abuse of office / power and discriminatory treatment, even for Narkoba Prisoners of dealers / bandar who will not be given remission

Abstract

The e-commerce ecosystem has encompassed various aspects of life, giving rise to legal implications, particularly in the areas of intellectual property and personal data protection, which are now inseparable from Indonesia’s economic system in the digital age. This research aims to elucidate the legal relationship between trade secrets as a crucial form of intellectual property to be safeguarded in the digital era and analyze Indonesia’s legal capability to protect trade secrets amidst the escalating challenges of cybersecurity due to the widespread use of various forms of e-commerce. The research employs a normative legal research method to analyze the protection and legal certainty concerning trade secrets, which can be subject to unauthorized access or theft through cyberattacks. Utilizing a legislative approach, the research relies on secondary data in the form of primary legal sources. The findings of this research reveal political-legal issues and normative shortcomings in regulating e-commerce and trade secrets, often underestimating the digital threats that can harm individuals’ intellectual property rights.

Abstract

This research aims to analyze the regulation development of objection against the KPPU's decision after the issuance of the Supreme Court Regulation (PERMA) No. 3/2021 and its implementation. The research is descriptive with normative juridical type, using primary data through interviews and secondary data through library research, using qualitative analysis and logical deduction reasoning. There are differences in absolute competence, timeframe, and case examination between PERMA No.3/2021 with previous arrangements. This PERMA has been implemented at the Commercial Courts of Central Jakarta, Surabaya, and Medan. In addition, the transfer of absolute competence to the Commercial Court makes the performance of the KPPU's litigation team more efficient because it no longer needs to travel to many cities to face objections, considering the Commercial Court is only domiciled in 5 regions throughout Indonesia. Commercial Court judges should also understand business law better and be expected to produce quality decisions.

Abstract

This study examined the factors that contributed to the non-establishment of the Policy Guarantee Agency. As stipulated in Article 53, paragraph (4) of Law Number 40 of 2014 concerning Insurance, the formation of the Policy Guarantee Agency was mandated within three years of the enactment of this law. The establishment of this agency held significant importance in furnishing legal safeguards for policyholders. Employing a descriptive research design encompassing normative juridical analysis through statutory and conceptual frameworks, this study regarded secondary data acquired through documentation studies for data collection. The ensuing qualitative analysis of the data revealed that the establishment of the Policy Guarantee Agency necessitated a comprehensive investigation, encompassing considerations such as funding, human resources, and the agency's structural integration, whether as an autonomous entity or as part of an existing Deposit Insurance Corporation. Consequently, achieving consensus among legislative bodies was imperative to advance the establishment of the agency.

Abstract

This study aims to investigate the scheme of virtual land transactions based on blockchain technology and the legal relationships among parties involved in such transactions. This research is descriptive, with the type of normative juridical research, using statutory and conceptual approaches, data collection techniques in the form of literature studies, then the data are analyzed qualitatively. The results reveal that the transaction process on platforms like Decentraland and The Sandbox includes registering a digital wallet, purchasing virtual land, managing and developing the land, reselling it as an NFT asset, and exchanging cryptocurrencies for local currency. The legal relationships between sellers, buyers, and platform owners are also identified. This research contributes to users' understanding of virtual land transactions and intellectual property ownership in the digital realm.

Abstract

The development of International Law that is taking place today has led to fragmentation. As a result, conflicts of norms arise from international treaties generated by each regime. This study aims to examine how conflict of norms can take place in a fragmented international law system and how to resolve it. It is normative legal research, used secondary data in the form of primary legal materials, secondary legal, and tertiary. The data collection technique uses library reserach, then analyze qualitatively. The results indicate that the absence of an authorized institution to create International Law causes conflict of norms International Law. The ways to resolve conflict of norms include not applying one of the conflicting norms; considering one of the conflicting norms is illegal; taking into consideration one of the conflicting norms is still valid but not illegal; and the two conflicting norms are considered to have the same position.

Abstract

Forfeiture of assets from corruption crime has not shown signifi cant results in termsof assets returned; in fact, the value of assets returned is smaller than state losses. Thisstudy aims to explain the dynamics of the problem of asset forfeiture due to corruptioncrimes and the concept of eff ective law enforcement to seize assets resulting fromcorruption. The specifi cation of the research is descriptive with normative juridicalresearch type, using a statutory and conceptual approach based on secondary datacollected by documentation study technique, and analyzed qualitatively withoutapplying formulas and numbers. The results of the study show that the state hasdiffi culty seizing assets resulting from corruption crimes since the assets placedabroad have been transferred to other parties and the restitution has not been paid.The concept of eff ective law enforcement is to track assets, apply restitution withouta subsidiary, which is preceded by blocking and forfeiting assets, and carry outexecutions through auctions, with the proceeds going to the state treasury.

Abstract

Terrorism as a universal threat to peace has been a huge problem specifically for Indonesia, threatening the fabrics of Indonesian society in collaboration with radicalism, which can reach even minors. To fight this, efforts to eradicate radicalization as an important factor in the spread of terrorism’s influence should be supported with by adequate regulations. Using the normative legal research method, this research analyzes the reality of terrorism and its relation to the existing relevant legal framework in Indonesia. This research finds that terrorism has a wide grip on Indonesian society, especially the youth, due to the spread of radicalism and the weak normative structure surrounding the act of radicalization. Findings and analysis of this research argue that there are possibilities of using the restorative justice approach through the process of deradicalization, according to Indonesia’s ideology, Pancasila.
