Abstract

AbstractLegal protection related to the rights of persons with disabilities still causes problems due to various regulations concerning persons with disabilities in the Special Region of Yogyakarta (DIY) are still not harmonious. This research tries to xpolre the question, is the regulation regarding employment rights for persons with disabilities relate to fulfilling qootas to become civil servants in DIY harmonious? And what kind of legal remedies should be done as a form of harmonization of laws and regulations regarding the rights of persons with disabilities related to employment rights in DIY? This research is a normative research, that is the research object of study in the form of legal norms. Primary and secondary materials is obtained through literature study, and analysis of the data will be analyzed legally. The result of the study concluded, the regulation of employment rights for person with disabilities relating to minimum amout of recruitment quota in the government agencies in DIY is not harmonius, and legal remedies can be made with legislative review.Key Words: Persons with disabilities, employment rights, harmonization AbstrakPerlindungan hukum terkait dengan hak penyandang disabilitas masih menimbulkan permasalahan, disebabkan oleh berbagai peraturan tentang penyandang disabilitas di Daerah Istimewa Yogyakarta (DIY) masih belum harmonis. Penelitian ini mencoba menggali pertanyaan yaitu, apakah pengaturan mengenai hak kepegawaian bagi penyandang disabilitas terkait pemenuhan kuota untuk menjadi pegawai negeri di DIY sudah harmonis? dan seperti apa upaya hukum yang harus dilakukan sebagai bentuk harmonisasi peraturan perundang-undangan mengenai hak-hak penyandang disabilitas terkait dengan hak kepegawaian di DIY? Penelitian ini merupakan penelitian normatif, yakni penelitian yang obyek kajiannya berupa norma hukum. Bahan primer dan sekunder diperoleh melalui studi kepustakaan. Analisa data akan dianalisis secara yuridis. Hasil penelitian menyimpulkan bahwa, pengaturan hak pekerjaan bagi penyandang disabilitas yang berkenaan dengan besarnya minimal kuota penerimaan pegawai di instansi pemerintahan di DIY belum harmonis dan upaya hukum yang dapat dilakukan dengan legislative review.

Abstract

After the reformation a change has occurs, a significant one, especially in the state administration as seen in the amendment, the 1945 constitution amendment, strengthening on the legislature in order to lift the power of checks and balances among the institutions, government agencies. On the third amendments in 2001 new institution, an institution of legislation appears in the Regional Representative Board (DPD to be the regional representation and later become a second chamber (bicameral) parliament which believed has made the legislation tasks such as, budgeting, and monitoring implemented optimally. But in reality, the duties and powers of the second chamber is still very limited compared to the first chamber which is the DPR, hence the transformation effort to ius consitutendum, the desirous law, appeared in strengthening the DPD constitutionally through MPR with Pancasila as the foundation. The method used is a normative juridical, by referring to the laws and principles exist. The analysis used in this research is descriptive qualitative analysis. The results shows that there is an inequality authorization in the, DPR and DPD, parliament. It gives a signal that the system we have adopted is a soft bicameral. By constant check and balance with Pancasila as the foundation DPD should be strengthen.

Abstract

Indonesia is a country of law. Jimly Asshiddiqie formulated twelve main principles of modern rule of law, one of which was the existence of a free and impartial judiciary, and the existence of a constitutional justice mechanism. After amendments of the constitution of the 1945 Constitution of the Republic of Indonesia, it has implications for the structure of more democratic state institutions. These changes give birth to the building of state relief from one another in an equal position with mutual control (checks and balances). Judicial Power is an independent power to administer justice to uphold law and justice. An independent judicial power or what is referred to as the principle of independence cannot be separated from the principle of checks and balances adopted by Indonesia to ensure that the institutions of authority and duties are balanced and the principles of the state are based on law and constitution. In Indonesia, the Constitutional Court judiciary was born on August 13, 2003, which was formed based on Law Number 24 of 2003 concerning the Constitutional Court. The history of the establishment of the Constitutional Court (MK) began with the adoption of the idea of a Constitutional Court in constitutional amendments. In the course of normative juridical arrangements regarding the Constitutional Court, there have been four amendments, namely (1) Law Number 24 of 2003 concerning the Constitutional Court; (2) Law Number 8 of 2011 concerning Amendment of Law Number 24 of 2003 concerning the Constitutional Court; and (3) Government Regulation in Lieu of Law Number 1 of 2013 concerning Second Amendment to Law Number 24 of 2003 concerning the Constitutional Court which has been ratified into law with Law Number 4 of 2014 and has been cancelled by MK Decision Number 1-2 / PUU-XII / 2014. This is due to several problems faced by the Constitutional Court, namely Constitutional Court Judges who violated the code of ethics to commit corruption and bribery. Of course, there is a need for a comprehensive study relating to (1) Appointment of Constitutional Justices and Panel of Experts and (2) External Oversight of Constitutional Justices and the Ethics Board of Constitutional Justices. use the Progressive Legal Theory approach to get solutions to the problematics that occur, which explore the values contained in society. In its arrangement, the Expert Panel and External Oversight have been regulated in Perppu No. 1 of 2013 which has been stipulated as Law Number 4 of 2014, but in that Act, the Court considers that the Expert Panel and External Oversight Committee formed by the Judicial Commission is considered unconstitutional because there is no principle of checks and balances within the judicial authority. With the susceptibility of constitutional judges to take actions outside of authority and other factors that have implications for the declining level of the Constitutional Court's confidence in society. Therefore, the researcher here wants to reconstruct a Panel of Experts and External Supervisors who answer the previous problems. The purpose of the Reconstruction of Panel of Experts and External Oversight is to realize a law enforcement system that is free of corruption, collusion, nepotism.

Abstract

Terrorism is a criminal act that has such a big threat, the State of the Republic of Indonesia as mentioned in the 1945 Constitution must protect the entire Indonesian people and all of Indonesia's bloodshed. Therefore the State and Government are obliged to protect all of their citizens from the threat of terrorism. Law Number 5 Year 2018 concerned Amendments to Law Number 15 of 2003 that concerned to Determination of Government Regulation in Lieu of Law Number 1 Year 2002 concerned to Eradication of Terrorism Crime was one form of legislative policy in its efforts to eradicate criminal acts of terrorism in Indonesia. Lately, criminal acts of terrorism had not only been carried out by adults, but many children were now involved in terrorism groups. The purpose found out and analyzed the involvement of the state in protecting its citizens who were involved in terrorism groups, and to know what legal protection the state can provide. The method used in this research is normative juridical and statute approach, namely the approach of the Law. The purpose of the results showed protect every child involved with terrorism groups and minimize the occurrence of criminal acts of terrorism. Keywords: Children, Terrorism, Legal Protect

Abstract

Environment is everything that exists around human life whose existence is directly and indirectly very influential on the survival of humans and other living things. The environment is an absolute part of human life. Regarding the environment, it has been regulated in the 1945 Constitution of the Republic of Indonesia Article 28H paragraph (1), which determines that every person has the right to live physically and mentally, live and get a good and healthy environment and the right to obtain health services. A good and healthy environment is a right that must be obtained by all Indonesian citizens because it has been regulated in the 1945 Constitution. Indonesia is one of the countries with the highest biodiversity in the world, all of which are in the Indonesian Tropical Forest. With the size of forests in Indonesia and other natural resources, many people manage or use forest land illegally or without permission. Damage to the environment will give a huge loss to people's lives in Indonesia.

Abstract

Abstract : This research was conducted to find out the problem of formation a bill that regulate employment with the concept of the Omnibus Law which was rejected by workers in the labor cluster that regulates about severance pay given to dismissed workers. This study uses a statue approach, conceptual approach, and case approach to make it easier to understanding the problem in that field. The results of the study was found that the amendment to the severance provisions in article 156 of Law with number 13 of years 2003 concerning the employment bill in Article 89, absolutely did not provide a solution of the occured problems so far. With these changes narrowed the labor rights and widen employers to exploit labor for his self profit . Therefore the Government and the Parlement should give a better solution to give welfare and certainty to workers and employers in the Employment Cluster Work Bill in Article 89 number 45 so that it can provide a good impact on the country. Abstract

In order to facilitate the investment in Indonesia, the government of Indonesia issued the Government Regulation Number 24 year 2018 on licensing services attempted integrated electronically (OSS), this is done in order to increase the investment which is an important basis to improve the progress and welfare of the people of Indonesia, but the regulation on the OSS is apparently contrary to law No. 30 year 2014 about about. Government administration, and Law No. 9 year 2015 Second Amendment to Law No. 23 of 2014 on local government, this then resulted in a conflict between the legislation and regulations related to the authorization of business license, the author aims to examine and analyze the conflict of laws and regulations related to the authorization of business license by using normative juridical approach to find the legal certainty in the application of government Regulation Number 24 year 2018 concerning licensing services seeks electronically integrated (OSS). Abstract

In Law Number 37 of 2004 there are many legal vacancies, due to the lack of existing legal principles causing injustice for the parties. The legal vacuum exists because there are many legal principles that are not heeded in the drafting of the Law, so that the justice of the parties is not guaranteed.. This research aims to find the principles that should exist in the Bankruptcy Law in order to be able to guarantee the continuity of perfect law and justice for the parties. This normative research used secondary data consisting of primary, secondary, and tertiary legal materials. It is found that the addition of legal principles is indispensable in order to maximize the presence of the bankruptcy law in Indonesia, the principle that needs to be added to the bankruptcy law is the principle which has an element of justice that is distributive justice.

Abstract

Proses mendirikan CV di Indonesia telah mengalami perubahan dengan beberapa masalah dalam membangun CV dari Permenkumham Nomor 17 tahun 2018, ini adalah yang pertama, pendirian CV harus memesan terlebih dahulu terlebih dahulu sebelum akhirnya mendaftarkan CV mereka dalam Bisnis Sistem Administrasi Entitas (SABU). Kedua, lokasi pendaftaran CV diubah menjadi Sistem Administrasi Entitas Bisnis (SABU). Ketiga, pendirian CV diperlukan untuk menggunakan akta otentik. Konsep peraturan ke depan mengenai proses pembentukan CV saat ini dengan diberlakukannya Permenkumham Nomor 17 tahun 2018 membuat pendaftaran CV lebih mudah dan lebih teratur dan juga ini memudahkan investor untuk mendapatkan informasi tentang CV yang telah terdaftar di Badan Administrasi. Sistem Bisnis (SABTU). Dalam hierarki peraturan perundang-undangan, posisi KUHD di atas Permenkumham Nomor 17 tahun 2018. Konsekuensi hukum selanjutnya adalah Permenkumham Nomor 17 tahun 2018 tidak dapat mengesampingkan KUHD, dengan kata lain semua kewajiban / pengaturan yang terkandung dalam KUHD untuk kepentingan hukum harus dianggap permanen berlaku.

Abstract

Abstract Crowdfunding services through information technology based stock offerings (equity crowdfunding) is an investment for people in the area of the industrial revolution 4.0 where companies that need capital can get funds, beside that people who have excess funds can use it by placing these funds in sectors that are be productive by using intermediaries called crowdfunding services providers. Problems regarding the protection of investor funds are often an important factor that supports the sustuinability of a bussiness beacuse of the factor of trust so that OJK regulates in aregulation concerning the protection of consumers in the financial services sectro. To maintain public trust, it is regulated regarding teh protection of investor funds against the actions of business actors. The organizer who manages the investor’s funds and distributes it to the issuer has an important role in equity crowdfunding so that teh responsibility is heavy as well, this is regulated in OJK regulations. The rsearch method used is normative with a statute approach by examining this principles in investment law with applicable laws and regulations. Regarding the protection of investor funds, basically this is regulated in OJK regulation Number 1/POJK.07/2013 which regulates consumer protection in the financial service sector against the behavior of business actorrs and this is strengthened by article 60 POJK Number 37 /2018 which imposes responsibility for losses on the organizer for the mistakes or negligence of the board of directors, employeses or parties who work with the oganizer.
