The 1945 Constitution explain that Indonesia is a country based on law, that law as the main parameter in making policy and directing ideal of the country . Policy and orientation of country is inseparable from an Indonesian nation ideology and Indonesian basic norms. Because nation ideology is an characteristic of Indonesian nation in inspiring the material substance of constitution and legislation. In recognizing fundamentally ideology values of Indonesian nation can be traced in the thinking of the founders of Indonesian nation. The founders of Indonesian nation has initiated a debate, design, structure, crystallization great ideas to directing the ark of Indonesian toward a law nation-country that modern, large and create a better fate. Debate and formulation of basic values integrated in constitution and legislation is related to format of citizens' basic values that must be respected, protected and fulfilled by the Republic of Indonesia named human rights (HAM).

In 2008, there was a case that made KPPU disappointed, namely the case of Temasek which Singapore Technologies Telemedia Pte Ltd (STT) sold 40.8% of its shares in PT Indosat Tbk to Qatar Telecom QSC (Qtel) through the acquisition of Asia Mobile Holdings Pte Ltd (AMH) in the midst of the cassation remedy process, which exceeds the stipulated provisions to transfer its ownership of shares. There are 3 reasons why interlocutory judgment is urgent, which are (1) Judging the abuse of dominant position by Temasek group on the sale of Indosat shares to Qatar Telecommunication in the middle The Supreme Court's process of legal remedies, creates uncertainty of KPPU's and District Court's verdict which ignored by Temasek business group by violating article 27 letter (a) Anti – Monopoli Act. (2) Judging from the objective of the formulation of the Anti – Monopoli Act particularly , that the regulation of abuse of dominant position is given on the basis to protect business competition and the public interest. (3). Judging from the economic aspect, the interlocutory judgement is useful to secure the assets of business actors who do not have good faith during the proceeding process. There will be no economic losses.

Terjaminnya kesamaan hak dan kedudukan penyandang disabilitas dalam dunia kerja seperti yang telah diatur dalam UU Penyandang Disabilitas, ternyata tidak disertai dengan pelaksanaannya di lapangan.Disabilitas tidak dapat dijadikan alasan untuk mengebiri atau mengeliminasi para penyandang disabilitas dalam memperoleh hak atas pekerjaan atau haknya selama bekerja, sebagaimana hal ini juga ditegaskan dalam Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Untuk memperkecil kemungkinan adanya diskriminasi maka perlu dilakukan penelaahan lebih mendalam mengenai implementasi Asas Keseimbangan pada kontrak kerja bagi tenaga kerja penyandang disabilitas yang diterapkan oleh yayasan nirlaba di Provinsi Bali.Dalam penelitian ini menggunakan teknik pengumpulan data yaitu teknik studi dokumen, teknik wawancara, observasi, dan dokumentasi. Implementasi asas keseimbangan pada kontrak kerja penyandang disabilitas telah diterapkan dengan baik. Hal ini dapat terlihat dari perlakuan tenaga kerja penyandang disabilitas dalam yayasan nirlaba di Bali telah diakomodasi hak-hak pekerjanya, dikarenakan seluruh peraturan perundang-undangan telah diimplementasikan melalui wujud kontrak kerja yang telah sesuai dengan kebutuhan penyandang disabilitas.

The international arbitration awards are basically final and binding. By its nature international arbitration award should has the power of self execution. However, the nature is not absolute because it is still open certain legal efforts. The existence of such legal effort causes the arbitral award not necessarily to be directly executed. This study aims to find out how the problematic of the implementation of international arbitration decision when viewed from the concept of justice in the perspective of legal philosophy and philosophy of Islamic law. The research is analytical descriptive with normative juridical approach and data obtained through library research. This research concluded that the implementation of international arbitration award faced with many obstacles causing delay of execution of the decision. As is known the purpose of the parties to choose arbitration institution as a dispute settlement forum is to get justice. However, if viewed from the perspective of legal philosophy, the enforcement of international arbitration rulings is not in line with the expected goal is to achieve justice. In line with that, the purpose of law in Islamic law perspective to realize kemashlahatan also can not be obtained by the parties. Due to the failure of the execution process, the search for justice or kemashlahatan also failed to execute. Keywords: international arbitration award, justice.

Pembagian waris seringkali menjadi awal timbulnya sengketa. Dalam pembagian waris berdasarkan hukum Islam permasalahan pembagian waris dapat disebabkan kekosongan norma dalam Kompilasi Hukum Islam (KHI) tentang pembagian haknya seperti halnya pada hak waris keponakan yang menjadi ahli waris pengganti jika terjadi sengketa dengan anak angkat penerima wasiat wajibah. Penulisan penelitian ini akan menelaah dan menganalisa lebih lanjut tentang kedudukan serta hak waris keponakan sebagai ahli waris pengganti dan hak waris anak angkat penerima wasiat wajibah Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan dalam mencari dan mengumpulkan data dilakukan dengan tiga pendekatan, yaitu pendekatan undang-undang, pendekatan konseptual dan pendekatan kasus. Hasil penelitian menunjukkan bahwa hak waris anak angkat penerima wasiat wajibah adalah sejumlah sepertiga dari harta warisan pewaris. Hak waris dari keponakan sebagai ahli waris pengganti didasarkan pada kedudukan ahli waris yang digantikannya. Apabila yang digantikan adalah ahli waris Ashobah maka ahli waris pengganti akan mendapatkan semua harta waris jika sebagai satu-satunya ahli waris dan memperoleh sebesar sisa sesudah bagian-bagian harta waris diberikan kepada Dzawil Furud. Apabila yang digantikan adalah ahli waris Dzawil Furud maka bagiannya adalah sama dengan bagian yang diterima ahli waris yang digantikannya.

General election is an important means for the state to ensure the implementation of a government that obtains the legitimacy of the people. In addition, the general election also aims to uphold democracy within sovereign states and ensure the implementation of the human rights of the citizens. Likewise in Indonesia, which periodically conducts general elections every 5 (five) years. General elections in Indonesia have undergone a shift from closed mechanical systems to open mechanical systems since 2004. This is influenced by the reforms that uphold the democracy and sovereignity, as well as respect for the political rights of citizens. The open mechanical system has variations since its use in 2004 to date, especially concerning the valid vote in the election. Therefore, this research will focus on analysing democracy that is being implemented in the election through open mechanical system, and various variations in open mechanical mechanical system in Indonesia. This research will be conducted by using normative research method by using primary legal materials in the form of laws governing the election, as well as secondary legal materials from various literature and scientific articles related to the problems discussed in the research. The results will be presented iin the form of problem description with analysis of the variety of open mechanical systems practiced in Indonesia. This study portrays the elections that are carried out honestly has manifested democracy and sovereignty of the people in the country. Furthermore there are various weaknesses of democratic interpretation in the variation of the implementation of open mechanical systems in elections in Indonesia.

Indonesia consists of many islands, and has a wealth of natural flora and fauna that is very much spread across 33 islands. The abundance of natural resources in Indonesia makes Indonesia known by many countries. Because there are only a few animals that are native to Indonesia and not found in any country, flora that only exists in Indonesia, namely Bangkai Flowers which can only be found in Indonesia. In addition to these 33 islands Indonesia also has a hidden island that is unknown to many people, namely Pulau Sipadan and Ligitan. The island of Sipadan and the Ligitan are located on Borneo, the island is not populated. The large number of uninhabited islands in Indonesia has led many countries to recognize the island, raising concerns for the Indonesian people. Now what the Indonesians are concerned about is becoming apparent. Sipadan and Ligitan islands have been taken by Malaysia, now Indonesia has lost the two islands. Before the islands of Sipadan and Ligitan fell into the hands of Malaysia, Indonesia and Malaysia mutually acknowledged the existence of the island, so that Indonesia and Malaysia also disputed because of fighting over the two islands. Obtaining rights to a region can be done by a country, provided that the country can carry out effective controls (Effective occupation). Effective occupation, which is carried out continuously and peacefully accompanied by recognition of not having physical characteristics alone, but related to the implementation of government functions as a manifestation of territorial sovereignty, as found through various legal cases, such as the Sipadan-case Ligitan. Through the ruling of the International Court, it was decided that Malaysia was worthy of the two islands compared to Indonesia even though the islands of Sipadan and Ligitan were clearly in the territory of Indonesia. It is unfair for the decision of the International Court for Indonesia.

The business world is something that cannot be separated from business competition. There are business actors who compete in a fair competition and there are also business actors who compete in a unfair competition. This is where the importance of the presence of business competition law in a country. In Indonesia, business competition law is contained in Law Number 5 of 1999 which prohibits monopolistic practices and unfair business competition. In relation to consumer protection, Law Number 5 Year 1999 has the aim of protecting the public interest and seeking public welfare. The prohibitions in the law indirectly have a protected effect on consumer interests. Need consistency in enforcement of business competition law so that the goal of protecting consumers can be achieved optimally.

This research is motivated by the number of traffic violation cases carried out by the community in Bangka Belitung. Many traffic violations carried out by children. This study aims to determine the number of traffic violators based on the level of education of the people in the Bangka Belitung Islands Province in 2016, thus it can be seen the number of traffic violators at certain levels of education in the Bangka Belitung region. The method used in this research is descriptive quantitative. This descriptive research is used to describe an event or event and social phenomenon in factual and systematic. This method is used to explain the data contained in the table by using descriptive explanations. The data used is secondary data. The results showed that the highest violations in Pangkalpinang City compared to other districts. Based on the data obtained, the high school level in the city of Pangkalpinang becomes the highest number of traffic violators. Many factors cause violations among students, namely internal and external factors. Internal factors come from within the individual, while external factors are found in the surrounding environment. Need appropriate handling to overcome the occurrence of various traffic violations among students. The method taken can be preventive and repressive. Keywords: BPS, students, minor violations.

In this era of globalization, people are pampered with any technology made easy with technological developments. With this technology able to create many opportunities one of them for the development of music in Indoneisa with social media in Indonesia can be rapidly spread and can be accessed by everyone so that the music can be Opportunities for artists to be commercialized. But with these developments many Parties are not responsible by doing music piracy by downloading so as to save or record with recording technology and storage nowadays, such as Memory card or flash disk with different types of brands. The advancement of storage technology has made it easier for users to record or duplicate a large number of creations that appear on internet media with ease and cheap cost even free, thus it does not comply with article 9 paragraph (3) UUHC Number 28 Year 2014: Any person without permission the creator or copyright holder is prohibited from making a reproduction and/or commercial use of the creation. And article 4 Law No 28 year 2014 part of article by article is a right that is only intended for the author, so that no other party can exploit that right without the permission of the creator. Copyright holders who are not creators only have a portion of the exclusive right of economic rights. Legal protections that government grants to songwriters or rights holders are now in two ways, first being a site blocking that is deemed to commit copyright infringement despite not running maximally and not reducing The occurrence of violations, and the second is to socialize both the songwriters or the rightsholders on the importance of registering the creation, as well as to the public about the culture respecting the work of the nation for law enforcement rights Intellectual property can be implemented well and currently the government has established a new institution of non-Ministry called Creative Economic Agency (BEKRAF). The liability made by the provider of free download sites is not compliant with the law. Providers of illegal sites even circumcarent their existence as illegal sites by way of positioning itself as a song search site that does not upload songs in the site but rather equate its site with search sites such as Google and Ymail.
