Abstract

Abstract The national economic development in Indonesia is inseparable from the banking role. The existence of the stipulation of Government Regulation in Lieu of Law (PERPU) Number 1 of 2017 on Access to Financial Information for Tax Purposes will certainly affect the regulation of the banking sector in particular related to bank secrets. The establishment of the Perpu appears to have attracted the attention of the government to immediately pass it into law. It is proven which on 23 August 2017 President Joko Widodo has authorized the Perpu to become a law through Law Number 9 of 2017 on Stipulation of Government Regulation in Lieu of Law (PERPPU) Number 1 of 2017 on Access to Financial Information for Tax Purposes into the Law -What. The policy is a form of Indonesias commitment to participate in the automatic exchange of information globally for tax purposes. The automatic opening of bank secrets for tax purposes will certainly affect the previous banking arrangements, especially those related to bank secrets. Therefore, in order to avoid overlapping arrangements, the state of Indonesia needs to harmonize all regulations relating to bank secrets and the opening of bank secrets for tax purposes. Abstract

Abstrak Perusahaan Pembiayaan Multiguna dalam Pasal 1 angka 1 Peraturan Otoritas Jasa Keuangan Nomor 29/POJK.05/2014 Tentang Penyelenggaraan Usaha Perusahaan Pembiayaan (untuk selanjutnya disebut POJK No 29/POJK.05/2014) adalah badan usaha yang melakukan kegiatan pembiayaan untuk pengadaan barang dan/atau jasa. Terkait itu pada pasal 18 ayat (2) POJK No 29/POJK.05/2014 yang mengatur tentang mitigasi risiko tidak ada norma tertulis yang membolehkan pembebanan jaminan Hak Tanggungan, namun manakala membaca penafsiran otentiknya memperluas norma yang sifatnya limitatif karena ada frase dapat dilakukan selain yang tertulis dalam pasal 18 ayat (2). Kekaburan norma itu berimplikasi pada adanya penyimpangan hukum yaitu dengan melakukan pembebanan Hak Tanggungan.  Perjanjian Pembebanan Hak Tanggungan  dalam pembiayaan multiguna tidak sesuai dengan karakteristik  perjanjian pembiayaan oleh Perusahaan Multiguna.  Kata kunci: Penyimpangan Hukum, Kekaburan Norma, Karakteristik Perjanjian Pembiayaan Multiguna   Abstract Multipurpose Financing Company in Article 1 number 1 Financial Services Authority Regulation Number 29 / POJK.05 / 2014 concerning Business Conduct of Financing Companies (hereinafter referred to as POJK No 29 / POJK.05 / 2014) is a business entity that carries out financing activities for the procurement of goods and / or services. Related to that, in article 18 paragraph (2) POJK No 29 / POJK.05 / 2014 which regulates risk mitigation there is no written norm that allows the imposition of guarantees of Mortgage Rights, but when reading the authentic interpretation expands the norms that are limitative because there are phrases that can be done in addition to written in article 18 paragraph (2). This vagueness of norms has implications for legal deviation, namely by imposing Mortgage Rights. Abstract

Prinsip mengenali Pengguna Jasa diterapkan dalam jabatan notaris dalam rangka melaksanakan ketentuan PP No 43 Tahun 2015 dan Permenkumham No 9 Tahun 2017, yang mana Notaris wajib menerapkan prinsip mengenali pengguna jasa. Prinsip Mengenali Pengguna Jasa bagi Notaris merupakan bagian dari upaya mendeteksi adanya penggunaan jasa notaris oleh para pelaku TPPU dengan melakukan identifikasi, verifikasi dan pemantauan identitas serta dokumen pada pengguna jasa Notaris. Tujuan dari penelitian ini yaitu untuk menemukan Menemukan kewajiban notaris mengenali pengguna jasa dalam upaya pencegahan tindak pidana pencucian uang oleh korporasi tidak bertentangan dengan Pasal 16 ayat (1) huruf f Undang-Undang Jabatan Notaris. Pada penelitian ini digunakan pendekatan yuridis normatif. Oleh karena itu, pengaturan hal tersebut harus seiring dan sejalan dengan peraturan perundang-undangan lain yang terkait agar tercipta adanya kepastian hukum, perlindungan hukum, keadilan dan kemakmuran bagi semua pihak yang berkepentingan.

Abstract

Nowadays Indonesia has not had a regulation on pet insurance. Meanwhile, in practice, there already are some pet insurance products. This gap has led to pet insurance policies that are only being based on general contract regulations and principles. One of the general contract principles is the consensual principle which is outlined in Article 1320 paragraph 1 of the Civil Code. The research of this paper is conducted based on pet insurance regulations, principles and norms application. It concludes that pet insurance policies that are being based only on the consensual principle have binding legal force as regulated on Article 1338 of the Civil Code. The conception of pet insurance in Indonesia subsequently should refer to the Ministerial Regulations, such as the Regulation of Minister of Agriculture Number 40/Permentan/SR.230/7/2015 regarding Agriculture Insurance Facility and also other supplementary regulations. Abstract

Copyright recognizes a declarative system in which the state automatically protects a creation after it was born, without having to be preceded by registration. Article 64 of Copyrights Act Number 28 of 2014 (Copyright Act) confirms the registration, even though it is not a necessity for the creator. This study aims to examine and analyze the legal consequences, forms of legal protection, as well as the future conception of regulations relating to the recording of similar work, by using legal research as its method. The results of the study indicate that the legal consequences on the similar work to the registration, inter alia, the abolition of the power of law for the registration of works, compensation for the creator, and criminal threats. Based on the theory of legal certainty, a provision is a form of legal certainty provided by the Copyright Law. There is a form of legal protection for the creator of the registration of the similar creation, inter alia, the abolition of the power of the law for registering the work by the court, the creator has the right to compensation, and the creator has the right to sue criminally. Based on the theory of legal protection, a provision is a form of protection provided by the Copyright Law. The future conception of the regulation of registration of creation, so that it can provide legal protection against the creator through the renewal related to the addition of authority and procedures in conducting checks for ministers in the case of the registration of creation since it was first realized and announced. Based on the theory of legal certainty and the benefits of law, change and renewal can provide legal certainty and legal benefits for the creator and his creation. Abstract

The Plantation Core Estate and Smallholders (PIR/Perkebunan Inti Rakyat) is a partnership scheme of the estates whereby a large estate acts as the core of development to small local farms in a mutually beneficial, integral, and continous system. Simply put, PIR is one form of contract farming. The PIR scheme was first introduced in by Indonesia government in order to encourage the development in local farms. Moreover, the partnership system is based on patron-client relationship and regulated through a contract in which the large estate is the patron and local farms are the client. However, the PIR system involves state within the contract. The state’s involvement is important so as to safeguard the interests of local farms (client) which are prone to predatory exploitation by the patron (large estate) and thus, balancing the bargaining powers of each party in the contract. This paper problematizes the contractual mechanism of PIR in respect to the freedom of contract. Thus, it can be concluded that the state’s involvement in the PIR shows that the freedom of contract principles are rigged to a degree which restricts some of the patron’s powers such as controls on supply and price in order to protect the local farms from being exploited.

Abstract

Ethics and law are often related to politics, not least in the Regional Head Election (Pemilukada). However, the implementation of legal and ethical relations in political dynamics is often a matter of debate, not a code of ethics. The purpose of this study is to examine aspects of the relationship between ethics and politics in terms of legal compliance, providing a study of the validity of the COVID-19 Health protocol as a code of ethics at regional head elections from the perspective of dignified justice. This legal research uses primary and secondary legal materials with a conceptual and statutory approach. The results of the study stated that from the point of view of legal compliance, the code of ethics is an element that should be applied in political life; because the code of ethics will encourage the participants of the Pemilukada to have three main characteristics, namely compliance, identification, and internalization. Then, the perspective of dignified justice assesses the position of the COVID-19 health protocol as a code of ethics as valid and relevant to legal practice, the concept of legal reform, and the general idea of the theory of dignified justice.

Abstract

Indonesia is one of the countries that has large population. Development of public housing is tended in order that every family can occupy a public housing that is proper in healthful, secure, harmonious, and uniformed environment. The proper public house is a house construction that is fulfill safety regulation in its construction, suffice the minimum construction area, and give health for public house occupant. Realize of the statements, is needed for developing a construction public housing that can be occupied together in a public house building,that is devided in some parts separately, on vertical ar horizontal for every occupation. There is a lot of participants that is involved in developing a public house building, that is the developer as a participant for developing a public house building, owner, and the occupant as an organizer. The public house building certificate will be proven with a freehold public house building certificate for every occupant that is already fulfill the regulations as an owner in the public house building. Researcher has taken one of the case studies about the restraining of a freehold of public house building, with purpose of the case study is knowing a consumer protection legally toward the participant developer that is restraing a freehold public house building. Researcher solved this case study using the normative method that is supported an interview with related parties. Based on the research will be knowing that the regulation of a freehold public house building certificate does not applied clearly on the sanction of participant developer that is restraining a freehold public house building certificate on the time that is determined.

Abstract

Smoking is one activity that is still done by individuals in all ages, from teenegers to adulthood. Many ways that can be done in the effort to stop smoking, such as commited, seplacing cigarettes by consuming candy, divert cigarettes with activity, but now smokers try to quit smoking by using electric cigarettes. Which electric cigarette is one alternative that can be done as a substitute for conventional cigarettes. Electric cigarette is a set of tools that function to convert the chemicals intp steam form, and electric cigarette consists of three(3) parts, Battery(the part contains the battery), atomizer(the part that will heat and vaporize the nicotine solution), and  catridge( the part contains a nicotine solution). Electric cigarette doesn’t contain tobacco but using a liquid compound which concists of a mixture of water, nicotine, propylene glycol and flavors. According Badan Pengawasan Obat dan Makanan(BPOM) electric cigarette containing liquid nicotine, propylene glycol, diethyl glycol, and glycerin. If all of the materials is heated it wil produce nitrosamine compounds. And that compounds can cause cancer.Therefoe consumer protection must be strcly enforced.
