Abstract

State Financial Losses are the result of acts of misuse of the authority of the state apparatus which have an impact on not maximisingnational development. This problem is also experienced by many countries and seeks to eradicate and minimise such events. Indonesia hasa national regulation, namely Law Number 30 of 2014, there is a growing assumption that in the abuse of authority that causes statelosses and the losses are returned the problem is over. In fact, according to Article 4 of Law Number 31 Year 1999, the return of statelosses does not eliminate criminal liability. This research examines how to resolve abuse of authority that harms state finances in theperspective of government administration law and corruption offences. This research is a normative research that uses normative andphilosophical juridical analysis methods. The results of the study found that the return of state losses does not erase the criminal penalty. The perpetrator must still be held criminally responsible for his actions. Administrative examination files are used as evidence in criminalcases. In addition, the internal supervisory institution formed from the Government Administration Law which has the function ofsupervising abuse of authority must coordinate with law enforcement agencies to enforce the law in eradicating acts that result in statefinancial losses. Keywords: Abuse of Authority; State Loss; State Finance

Abstract

This study aims to review the delibration process of The Panel of Judges in imposing a heavier sentence than the Prosecutor's demands forthe perpetrator of sexual violence criminal offense committed by a stepfather against a stepchild in Verdict of District Court of KefamenanuNumber 3/Pid.Sus/2023/PN Kfm. In imposing a sentence, the Panel of Judges must consider juridical and non-juridical circumstancesto impose a fair sentence for the defendant and the victim. This research is conducted by reviewing written norms with a case approachsupported by secondary data or library materials. The data were collected through a literature study and documentation. The method of dataanalysis in this study is descriptive qualitative method. The results of this study indicate that in imposing a verdict to the Defendant whocommitted the crime of sexual violence against his stepdaughter, the Panel of Judges has considered 3 (three) aspects, namely juridical, philosophical, and sociological considerations. The Panel of Judges is convinced to heighten the criminal penalties imposed on the Defendantbased on philosophical considerations. In philosophical considerations, the Panel of Judges considered that the urgency of sexual violence thatis often committed against children could threaten the crucial roles of children as the next generation of the nation in the future. Therefore, the Panel of Judges believes that imposing a heavier sentence than the Prosecutor's demands for the perpetrators of sexual violence crimes isexceptional in the court. In practice, judges commonly impose less or the same punishment as the charges of the Prosecutor in other existingverdicts. Keywords: judges’ considerations, sexual violence, criminal law, children

Abstract

The purpose of writing this article is to describe the image of women in the 19th century represented by the characterJo March in the film 'Little Woman' directed by Gillian Armstrong. The image of women here is the perception ofwomen in the 19th century in expressing love, career, struggle for existence and independence in making choices. Indescribing the image of women reflected in the film 'Little Woman', the researcher used a descriptive qualitativeresearch method with the type of Library research. The results showed that women in the 19th century, especiallywomen in the middle to upper social status, were considered as ideal women if they could fulfil the criteria as a womanwho could do all domestic work in the household. Women in the 19th century were more inclined to the male viewof the ideal woman at that time. The presence of the character Jo March in the film 'Little Woman' breaks the view ofthe ideal woman who must submit or obey the rules and do domestic household chores. The presence of the characterJo March shows that women also want self-actualization, independence, freedom to choose a life partner, expressfeelings, and achieve goals. In addition, the presence of Jo March as a woman who is able to actualize herself is arepresentation of most women in the 19th century who began to break the rules that restrained women's freedom inshowing their existence along with the industrial revolution at that time. This research is examined from theperspective of feminism. The film 'Little Woman' represents the image of women in the 19th century who tried toreach their dreams, love life, and independence. And the character Jo March is able to represent the women in the19th century who succeeded in achieving all their dreams. Keywords: Feminism, Women's Image, Descriptive Qualitative

Abstract

Globalization was born as a strong current that flows the transfer of cultural values, products, lifestyles, communication, andtechnology. In this era, the ecosystem of world life has relied on cellphones, computers, and the internet to interact. Onlinegames as a result of advances in science and technology have begun to show a new impact or it can be said that the impact isunpredictable in Indonesia. Some of the impacts of online games are far from positive because they weaken the development ofthe younger generation, including: 1) Relationships with friends and family are tenuous, distant, disharmonious, 2) Decreasedphysical activity that leads to health / fitness / long-term threats. This research method is library research, so the role of theresearcher is dominant to ensure the quality of the research. Researchers strengthen their role by exploring secondary data, sothat data analysis is more credible. The results show that the negative impact of online games is already at a critical level, some cases are (1) murder, (2) health problems, (3) changes in social behavior. In Indonesia, state protection has not yetemerged in anticipating the negative impact of online games. In fact, the state seems to be blundering because it gives legitimacyto the E-Sports ecosystem through the formation of a management institution. Keywords: Protection, Country, Globalization, Online Games
