Abstract

Discussion of shari'ah which is a reference to divine decrees as "standard operational procedures" and fiqh which is a sub-foundation of shari'ah in the form of interpretation at the next level as a product of anthropological subjectivity, requires the formulation of rules so that the product of legal understanding does not go off the rails of shari' at. Meanwhile, the idea of renewing the rules of fiqh, which leads to changes in the formulation of the main rules of fiqh, will give rise to methodological problems which are feared to deconstruct the established formulation. The main objective of Islamic law is to realize the ideals of human benefit which are based on the values of social justice as God's creatures. The ideals of Islamic social justice at the level of implementation are reflected in the juridical-normative provisions in both the Qur'an and al-Hadith, the basis of which are the values of equality (al-musawah), justice (al-'ilah) and freedom ( al-hurriyah). Islamic Sharia is a concept of religious teachings that regulates all dimensions of human life. Thus, Islamic law is a comprehensive concept of life. However, the legal provisions in both the Qur'an and al-Hadith are mostly stated in common language (mujmal) so that they require ijtihad. Therefore, it is very possible or even inevitable that there will be a diversity of interpretations of religious texts.

Abstract

When a divorce occurs between a husband and wife, it creates obligations that must be obeyed by a husband and wife, and these obligations include the former husband being obliged to provide a gift that must be given to the former wife who has been divorced. This article aims to examine the husband's responsibilities towards his wife and children after divorce. The existence of divorce does not mean the release of the husband's responsibility to provide responsibilities to the ex-wife, be it iddah maintenance, mut'ah, and child maintenance, provided that it is in accordance with the husband's ability. This research is a type of empirical juridical research, or called field research, which examines the applicable legal provisions and what happens in reality in society. Empirical juridical research is legal research on the enactment or implementation of normative legal provisions in action on each specific legal event that occurs in society. The results of this study indicate that the husband is responsible for the former wife and children after divorce in the Religious Court, that the former wife must receive maintenance in the form of mut'ah, iddah maintenance, madhiyah maintenance, and for children's rights or child maintenance. The husband is obliged to provide maintenance to the child in the future, and the prosecution system is every month until the child is 21 years old or has grown up. This policy is carried out to provide justice for wives who are divorced by their husbands.

Abstract

Basically Islamic law stipulates that the share of a son's inheritance is twice that of a woman's, but the law came down to where in the classical and medieval periods the role of women in the household only revolved around the well, mattress, and kitchen. In contrast to today, where the role of women already has the same rights and obligations in running life in a family. So that contemporary scholars perform ijtihad by relating Islamic law to modern times. The purpose of this study was to find out how comparative the distribution of inheritance according to Munawir Sjadzali and M. Quraish Shihab. This research article uses the librray research method with a descriptive qualitative approach. The results of the study explained the provisions for the distribution of inheritance according to the opinion of Munawir Sjadzali and Quraish Shihab according to a progressive legal perspective, looking at the development of human life itself by adjusting the division of inheritance to 1: 1 by looking at the role roles between women and men who were equal, marriage activities that were dowry in the form of money and gold turned into a set of prayer tools, is a dynamic division with the development of life In this modern-day society, the morals of humanity are put forward for human welfare and happiness in the distribution of inheritance.

Abstract

Marriage is a form of legal action between husband and wife. Marriage is not only interpreted to realize worship to Allah alone, with the existence of a marriage, it will cause civil law consequences between the two. Here there are arrangements regarding the rights and obligations of each husband and wife, the husband is the heart of life in the family where it is the husband who has the advantage to lead a family compared to a wife who looks after assets and takes care of her husband and children, one of the responsibilities of a husband is in the wheels of the economy. The condition of the convicts who are in the Correctional Institution only participates in coaching program activities, there is no extra effort that must be made by convicts in fulfilling their own living because the independence coaching that is carried out is only limited to training. However, it is different from the situation when the prison itself has adequate facilities so that the convicts can work or manage in agriculture, animal husbandry or home industry. The research method used is Juridical-Dogmatic or Normative-Juridical. The results of the research conducted show that inmates who are in Correctional Institutions cannot provide a living for their families, but there are efforts they can make, namely first entrusting their wives and children to their families so that their dependents become debts, secondly by leaving a business for their children and wives before they are in the penitentiary.

Abstract

Religious education received from an early age will have an influence on the child's subsequent religious development. The aim of this research is to determine the curriculum and implementation of PAI in PAUD and SD. This panel research is qualitative research using the library research method. The results obtained from this research are that the PAI PAUD Curriculum seeks to develop children's religious and spiritual potential, including an introduction to Allah through His nature and creation, Kalimah Tayyibah which reflects everyday Islamic values such as alhamdulillah and astaghfirullah and an introduction to the fifth pillar of Islam. This competency is described in a number of learning outcome indicators covering faith, morals and worship. The implementation of Islamic religious and moral values in students tends to lead to habits in daily behavior at school. The application of Islamic religious education in PAUD can also be carried out by teaching children morals, praying fardhu prayers properly and correctly, training children to learn the Koran with Iqro. The PAI curriculum content in elementary schools has 5 scopes of material contained in PAI subjects for grades I to VI, with the distribution as follows; Koran, 11 KD; Aqidah, 17 KD; Morals 25 KD, Fiqh, 12 KD; and History of Islamic Civilization (SPI), namely 33 KD. Implementation of the PAI curriculum includes planning, implementation and evaluation.

Abstract

Bukhari Hadith Number 6531 All the narrators in the hadith sanad, totaling 4 narrators, are all qualified: tshiqah (trusted). All the transmitters each met with a transmitter who had the status of their teacher, thus their sanad was muttasil; The hadith explains that togetherness is something that is commanded. Allah to Muslims. In each of His commands, Allah always uses the jama'i (communal) form such as Ya ayyuhalladina A'manu (O you who believe) not the infiradi (individual) form Ya ayyuhal mu'min (O you who believe). Togetherness is important because by always being together and living side by side in society, we can exchange thoughts, life experiences and opinions which will be useful when we face a problem. Together, various problems can be solved and overcome.

Abstract

This article aims to examine the exploration of multiculturalism in Islamic society during the time of the Prophet and Khulafaur Rasyidin. This research concludes that: In the exploration of the multiculturalism of Islamic society in the era of the Prophet and Khullafaulr Rasyidin, it can be concluded that cross-cultural harmony created miracles in their lives. Diversity of ethnicities, cultures and social backgrounds is the main driver for unity and equality. This miracle not only creates tolerance, but also inspires positive collaboration between different individuals, forming an inclusive and strong society. This conclusion underlines that the understanding and application of multiculturalism values in past Islamic societies became an important foundation for harmony and continuity in collective life.

Abstract

Islam is a religion of mercy for all humans and the universe. As stated in the Qur'an, the Prophet Muhammad SAW was sent as rahmatan lil 'alamin, including in order to create peace for all mankind on the face of the earth and avoid conflicts, even though conflicts still occur in parts of the world, so many of the Prophet's hadiths contain efforts to Efforts in handling conflict that are still relevant to be implemented are: 1). Conveying good things to the parties involved in the conflict, 2). Reconciling conflicting parties, 3). Conflict resolution with explanations from witnesses, 4). Be patient and pray for the party who triggered the conflict, 5). Shaking hands between the parties in conflict.
