Abstract

Religiously valid but unregistered marriages raise serious issues regarding the fulfillment of children’s maintenance rights. This study aims to analyze a father’s maintenance obligations from a fiqh perspective, examine Indonesia’s positive law regulations, map the normative dualism between the two, and formulate a synchronization model as a foundation for strengthening the protection of maintenance rights for children born of unregistered marriages. The study employs a qualitative normative legal method using legislative, conceptual, and comparative approaches, along with literature review as a data collection technique. The findings reveal that Islamic jurisprudence mandates child support unconditionally based on the validity of lineage without requiring administrative registration, whereas positive law requires formal proof through documents or court rulings. Constitutional Court Decision No. 46/PUU-VIII/2010 represents a significant breakthrough by recognizing the civil relationship between a child and their biological father through scientific evidence such as DNA testing. Legal dualism lies in the dichotomy between substantive-theological validity in fiqh and administrative-formal validity in positive law. Synchronization through the integration of the maqashid syariah with Article 28B of the 1945 Constitution, as well as the utilization of the isbat nikah mechanism and the determination of a child’s lineage, constitutes a crucial solution to ensure the certainty and enforceability of a child’s right to maintenance.

Abstract

The social security and economic stability of Indonesian society are seriously threatened by the increase in fraud and cybercrime on social media in 2024. In Indonesia, where 78.19% of the population uses the internet, online fraud, phishing, investment schemes, and illegal activities through digital platforms are increasingly rampant. To build an ethical foundation in tackling the increase in fraud and cybercrime on social media, this study seeks to understand the economic values of the Quran using thematic interpretation techniques. This qualitative study uses the thematic interpretation approach (al-tafsīr al-mawḍū'ī), which collects Quranic verses related to business ethics, transactions, and economics for thematic analysis. The fundamental economic principles contained in the Quran include: (1) transparency in transactions and honesty (al-ṣidq); (2) justice (al-'adl) and balance; (3) prohibition of exploitative practices and usury (al-ribā); (4) trust (al-amānah) in asset management; and (5) the consequences of accountability in this world and the hereafter. It is believed that a digital economic environment with integrity can be built by applying these principles within the framework of digital governance and literacy. In addition to offering useful suggestions for the government, social media companies, and the general public in developing Al-Qur'anic economic literacy as a deterrent to cybercrime, this study provides a theoretical contribution to the integration of interpretation with cybercrime studies.

Abstract

The digital era has reconstructed the social interaction space that offers communication efficiency as well as massive moral challenges, where the penetration of information technology that is not accompanied by spiritual maturity has triggered various digital social pathologies such as cyberbullying, hoaxes, flexing, and addiction to immoral content. This study aims to analyze the phenomenon of deviant behavior in cyberspace through the perspective of Islamic Religious Education (PAI) and formulate a holistic strategy for overcoming it using descriptive qualitative methods with a literature study approach (library research) that synthesizes findings from various recent literature related to education, ethics, and digital sociology. The results of the analysis show that deviant behavior in cyberspace is rooted in an identity crisis, loss of empathy due to digital anonymity (online disinhibition effect), and erosion of adab, so as a fundamental solution, this study offers a "Digital Piety" framework based on the value of muraqabah (transcendental awareness) and the revitalization of the epistemology of "Adab before Knowledge". Further analysis reveals that the deconstruction of morality in the virtual space is triggered by a shift in value authority that is now dominated by social media algorithms, which requires Islamic Education to reposition its methodological approach from a doctrinal approach to a persuasive-dialogical one in order to instill spiritual intelligence as an antidote to identity commodification and digital narcissism. The conclusion of this study emphasizes that overcoming digital moral decadence requires strategic synergy between value-based digital literacy in educational institutions and strengthening spiritual resilience in the family ecosystem, with recommendations for developing an Islamic Religious Education curriculum that is adaptive to the dynamics of digital sociology to produce individuals with moral autonomy and strong moral integrity in the era of disruption.

Abstract

This study critically examines the epistemology, methodology, and implementation of contextual interpretation (tafsir kontekstual) in contemporary Qur'anic studies. Employing a qualitative approach with library research method, this study analyzes the thoughts of four key figures Fazlur Rahman with his double movement theory, Abdullah Saeed with his systematization of value hierarchy and structured interpretive steps, Hassan Hanafi with his engagement hermeneutics and transformative interpretation, and Sahiron Syamsuddin with the Ma'na Cum Maghza method as a local innovation from the Indonesian archipelago. The findings reveal that all four scholars share a common thread: the rejection of literal-textual readings and the recognition of the role of context in meaning-making, although they differ in their starting points of interpretation and operational steps. The implementation of this method on contemporary issues such as gender equality, religious tolerance, and socio-economic justice has proven capable of providing alternative interpretations that are more humane and progressive. However, this study also identifies theoretical and practical challenges, including criticism from traditionalist circles regarding the risks of relativism and erosion of textual authority, as well as implementational problems within Muslim communities that still strongly adhere to classical interpretations. Theoretically, this study strengthens the argument that contextual interpretation is a natural continuation of the maqasid al-shari'ah principle and the tradition of ijtihad, while practically, the results of this study can serve as a reference for exegetes, lecturers, and students in developing contextual and anticipatory interpretive strategies responsive to contemporary dynamics. The limitations of this study lie in the data sources being restricted to English and Indonesian literature, not yet including Arabic or Persian sources, as well as the lack of empirical testing of the implementation of contextual interpretation in specific Muslim communities.

Abstract

This article examines the urgency of substantive competence possessed by the classical concept of hakam as a freame of reference for mediators handling syiqaq cases in Indonesian Religious Courts (Pengadilan Agama). Syiqaq a form of severe and on going marital discor, is addressed in fiqh through the appoinment of two arbitrators (hakam) who are expected to be knowledgeable in Islamic family law, trusted by both parties, and ideally drawn from their respective families. However, positive Indonesian law, specifically Article 76 of Law No. 7 of 1989 on Religious Courts, merely allows the court to appoint hakam without prescribing substantive qualification standards. Meanwhile, the mediation procedure under Supreme Court Regulation (PERMA) No. 1 of 2016 only requires a certified mediator without mandating any specialization in Islamic family matters. This normative-doctrinal study, supported by a statutory and conceptual approach, finds that the gap between the classical hakam qualification and the current regulatory framework results in a suboptimal peace-seeking process in syiqaq cases. The novelty of this article lies in its proposal for integrating classical hakam qualification criteria into the certification standard for mediators assigned to syiqaq cases at the Religious Court level, as a concrete reform measure.

Abstract

This study aims to map the development of publications on the application of Machine Learning in Arabic language studies through bibliometric analysis. Research data was obtained from the Lens.org database and analyzed using VOSviewer software to identify publication trends, keyword networks, and research opportunities. The results show that the number of publications has increased significantly since 2015 and peaked in the 2020–2025 period. Keyword co-occurrence analysis shows that Machine Learning is a central theme closely related to deep learning, Arabic Natural Language Processing, classification, and Arabic Sentiment Analysis. Overlay visualizations show a shift in research focus from basic topics, such as translation, tagging, and text mining, to more sophisticated themes, such as Arabic hate speech, clustering, and ensemble learning. Meanwhile, density analysis indicates that Arabic Sign Language, FastText, Ensemble Learning, and Arabic Hate Speech still have a low publication density, thus potentially becoming future research directions. The findings of this study provide a comprehensive overview of the trends and developments in Machine Learning research in Arabic language studies and can serve as a reference for researchers in determining research themes and developing artificial intelligence-based innovations in Arabic language learning and processing.

Abstract

This study aims to describe and analyze the role of teachers in developing the Qur'an reading skills of students in both the talent and regular classes at RA Al-Munawwarah Pamekasan. The background of the research is the varying levels of students’ abilities in reading the Qur'an at an early age, which led the school to group students into talent and regular classes. In this context, teachers play a crucial role in adapting instructional strategies to suit the needs and abilities of each student group. This research employed a qualitative approach with a descriptive method. Data were collected through observation, in-depth interviews with teachers, and documentation of teaching and learning activities. The results revealed that teachers in the talent class focused more on improving tajweed, reading fluency, and memorization through individualized approaches and the talaqqi method. In contrast, teachers in the regular class concentrated on introducing the Arabic alphabet and basic Qur’anic reading skills using the Iqra’ method, songs, and educational games. The difference in teacher roles between the two classes was adjusted according to students’ initial abilities. Supporting factors included professional teacher competence, parental support, and a conducive learning environment. Inhibiting factors included limited instructional time and varying student abilities within the same class. In conclusion, the teacher's role is essential and significantly influences the gradual and targeted development of students' Qur’an reading skills in both the talent and regular classes.
