Abstract

In this study the author discusses one of the problems regarding the authority of civil servant investigators (PPNS) in carrying out forced searches based on the provisions of laws and regulations in Indonesia. The purpose of this study is to determine and analyze the authority of civil servant investigators (PPNS) in conducting forced searches based on the provisions of laws and regulations in Indonesia and to determine and analyze civil servant investigators (PPNS) can make forced searches of perpetrators suspected of committing criminal violations of local regulations. The research method uses normative legal research, so the research approach taken is a statute approach, conceptual approach, and case approach. The results of this study are the first, the authority of civil servant investigators (PPNS) according to Indonesian legislation is regulated in the provisions of Law No. 8 of 1981 concerning Criminal Procedure Law (KUHAP) Government Regulation No. 43 of 2012 concerning Procedures for Implementing Coordination, Supervision, and Technical Guidance of Special Police, Civil Servant Investigators, and forms of Private Security, Regulation of the Chief of the Indonesian National Police Number 14 of 2012 concerning Management of Criminal Investigations, Regulation of the Chief of the Indonesian National Police Number 6 of 2010 concerning Investigation Management by Civil Servant Investigators. Secondly, the provisions of the above laws and regulations that in the event of a criminal offense in the region, civil servant investigators (PPNS) can search the perpetrator of the offense, but still the PPNS authority must be expressly regulated in the provisions of regional regulations because however PPNS in the regions must be subject to Regional Regulations that regulate their authority.

Abstract

The acts of wild scrutiny against the PTSL program are clearly not based on clear legal rules except those which have been established in the SKB 3 ministers. The existence of long, complicated and exhausting procedures of service makes the public dependent and accustomed to dealing with corrupt public services, thus creating a tendency of the public to tolerate the practice of wild bullying. The study in this study focuses on the action of the complete systematic land registration program. The method of research used is the normative jurisprudence with the method of approaching legislative regulations and conceptual approaches. The results of the research showed that the practice of savage bribery against land registration activities and government strategic programmes was caused by the weakness of integrity and professionalism of the organizers of public briberies, the ineffectiveness of supervision of the government’s strategic programs in preventing the occurrence of acts of corruption and savage Bribery and the bad habits of the people who consider the process through which it is not easy so that culture provides a sum of money under the pretext of the processes quickly and improvised. Enforcement of the law can be done preventively by doing coordination between the police, local government, BPN and village government. Repressively enforcing is carried out with repression and punishment against the perpetrators of wild scourge measurably and consistently Together with the saber pungli team.

Abstract

This study aims to analyze the obstacles that occur in tax collection and the government's strategy in dealing with obstacles to tax collection in Indonesia and the implementation of taxes in Indonesia. This journal uses normative legal research methods or doctrinal research. The sources of legal materials used are primary legal materials and secondary legal materials. The procedure for collecting legal materials in this journal is by studying documents or library materials. Analysis of legal material sources is carried out descriptively using a statutory approach and a contextual approach. The results of the study concluded that the tax collection application system that is known in Indonesia consists of several things, namely: Official Assessment system, semi self assessment system, full self assessment system and witbbbolding. Obstacles in tax collection, namely passive tax resistance consisting of obstacles that complicate tax collection which are closely related to the economic structure, intellectual and moral development of the population and active resistance are efforts or actions that are directly or indirectly shown against tax collection. tax (Fiskus). As for the strategy carried out by the Directorate General of Taxes, the government needs to take a territorial approach to carry out tax extensions. tax extensification is supervision carried out by the Directorate General of Taxes on taxpayers who meet subjective and objective requirements but do not yet have a Taxpayer Identification Number and promote counseling in the field of taxation.

Abstract

Economic growth in Indonesia can be encouraged by increasing consumer confidence. In the event of a violation of consumer rights, consumers have the right to claim compensation from business actors, but in fact, consumers and business actors have an unequal position. Consumers have difficulties in terms of civil evidence. An imbalance in the distribution of the burden of proof is an injustice for the disputing parties. The research was conducted using normative juridical research methods and comparative research methods, namely research methods carried out by studying secondary data and library materials and approaches to comparing the laws of one country with the laws of other countries. This research was conducted through library research and field research to enrich the sources. The results of further research are described in descriptive writing that relates the problem to legal theory in evaluating the practices carried out by research objects. There are 2 conclusions from the research results. First, that the position of the re ipsa loquitur doctrine in the principle of proof in consumer protection cases is closely related to the evidence imposed by judges on business actors as parties who have responsibility for the products consumed by consumers as well as those who suffer less losses to provide more justice for consumers. and in line with the principle of proof contained in UUPK and the second conclusion is that the res ipsa loquitur doctrine can be applied in cases of consumer protection if it fulfills the elements that are the requirements of the application of the re ipsa loquitur doctrine.

Abstract

The existence of fishing gear type padang hoe began to spread in the area of Lake Lut Tawar, Central Aceh. As a result of massive and uncontrolled fishing practices and disregard for local culture, this is very dangerous for the preservation of Lake Lut Tawar. So if it continues to be left unchecked, fish endemic to Lake Lut Tawar, such as the depik fish, are threatened with extinction. In the Gayo community in Central Aceh District, cases/disputes that occur within the community are resolved by a customary institution called sarak opat. The purpose of this study is to find out the authority of sarak opat in solving environmental pollution and to find out the obstacles of sarak opat in solving environmental pollution. This type of research is empirical normative research. The data sources used are primary data and secondary data obtained from primary legal materials, secondary legal materials and tertiary legal materials. The method of collecting data is through interviews and document studies. The way of analyzing the data that has been collected from both primary and secondary data will be analyzed qualitatively, so that it is found that facts as symptoms of primary data are associated with theories from secondary data presented descriptively. The results of the study explained that sarak opat's authority has a legal basis for resolving environmental pollution cases, as mandated in the Aceh Qanun and the Aceh Governor's Regulations concerning Implementation. Customary and Indigenous Dispute/Dispute Resolution. custom. Obstacles to the sarak opat customary institution in resolving environmental pollution cases, namely: First, the loss of the function of the Pawang Lut in Gayo society. Second, there is a lack of understanding of the apparatus of the Sarak Opat customary institution regarding the authority to settle cases of minor environmental pollution.

Abstract

The implementation of buying and selling will not always be in accordance with what has been agreed. As an example of the case between Johandi Akman who is consumer and PT.Putra Adhi Prima who is a seller or business actor. In this case the panel of judges in the Cibinong Court Decision Number: 57/Pdt.G/2021/Pn.Cbi on 12 July 2021 stated that PT. Putra Adhi Prima had committed an unlawful act where there were hidden defects in the NE-21 villa that was purchased by Johandi Akman. The formulation of the problem in this writing is; First, how is the validity of the binding sale and purchase agreement (PPJB) of villa NE-21 which contains hidden defects? Second, what are the legal consequences of the binding sale and purchase agreement (PPJB) of villa NE-21 which contains elements of an unlawful act? Third, what are the legal considerations in the decision number. 57/Pdt.G/2021 is in accordance with the provisions of Law Number 8 of 1999 concerning Consumer Protection? The research method used is normative juridical with a statutory and conceptual approach. The results obtained from the research are the invalidity of the binding sale and purchase agreement which contains hidden defects, legal consequences of the binding sale and purchase agreement which contains elements of unlawful acts, so the injured party can claim responsibility for the losses suffered, and the legal considerations in decision number 57/Pdt.G/2021/Pn.Cbi are in accordance with applicable legal provisions.

Abstract

Penelitian bertujuan untuk mendeskripsikan ketentuan hukum pidana Indonesia mengenai penahanan terhadap tersangka serta untuk menganalisis perlindungan hukum terhadap tersangka pada saat dilakukan penahanan ditinjau dari hukum pidana Indonesia. Penelitian ini merupakan penelitian hukum normatif, yang mengkaji peraturan perundang-undangan dalam suatu tata hukum yang koheren serta nilai-nilai hukum yang terkait dengan penahanan tersangka dalam kajian hukum pidana Indonesia. Hasil penelitian menunjukkan bahwa ketentuan penahanan terhadap tersangka diatur dalam KUHAP Pasal 1 butir 21, Penahanan merupakan penempatan tersangka atau terdakwa di suatu tempat tertentu oleh penyidik atau penuntut umum atau hakim dengan penetapannya dalam hal serta menurut cara yang diatur dalam undang-undang. Selama dalam penahanan, tersangka dapat menggunakan hak-haknya sesuai dengan pasal 50 sampai dengan pasal 68 Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Perlindungan hukum selalu dikaitkan dengan konsep rechtstaat atau konsep Rule of Law karena lahirnya konsep-konsep tersebut tidak lepas dari keinginan memberikan pengakuan dan perlindungan terhadap hak asasi manusia. Tersangka mempunyai hak pada saat dilakukan penahanan yang dijamin oleh hukum seperti hak menerima dan membaca Surat Perintah Penahanan atau Penetapan Hakim yang mencantumkan identitas tersangka atau terdakwa dan menyebutkan alasan penahanan serta uraian singkat perkara kejahatan yang dipersangkakan atau didakwakan serta tempat ia ditahan sesuai dengan Pasal 21 ayat (2) KUHAP

Abstract

The purpose of this research is to determine the form of unclear norms in the preparation of academic texts, and to determine the involvement of universities through academic texts in the formation of regional regulations. The method used in this research uses normative legal research methods which raise the theme of legal systematics or the systematics of statutory regulations with vertical and horizontal levels of synchronization, with legal, conceptual, historical, theoretical and interpretive approaches. The results of this research show that explanatory words or adverbs, and/or academic texts have very different positions so that their diction cannot be in harmony because each position is very different. Apart from that, there are inconsistencies in norms which cause laws and regulations to be out of sync with each other, so that there is no normative harmonization from a vertical and/or horizontal perspective. Meanwhile, higher education institutions' involvement in academic texts is still situationally involuntary, namely a temporary situation within the limits of academic paper preparation activities and there is no aspect of continuity of this involvement. Thus, the position of academic texts is very respectable, however, in terms of legal norms governing academic texts, they are still not clear, so there is no legal certainty.

Abstract

Investasi  merupakan suatu  kegiatan  berupa  penanaman  modal  yang memiliki  periode  waktu  yang  panjang  serta  dimaksud untuk  mendapatkan  sebuah keuntungan   di   masa   mendatang. Kota Batam diidentikkan dengan iklim berinvestasi, karena lokasinya yang strategis Kota Batam menjadi tempat berkumpulnya para investor dari manca negara untuk menanamkan modalnya. Kepastian hukum yang jelas mengenai investasi juga menjadi salah satu faktor investor mau berinvestasi di Indonesia. Oleh karena itu, pemerintah membuat beberapa perubahan mengenai investasi dengan dikeluarkannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja pada tahun 2020 silam. Namun, pemerintah menggantinya dengan Undang-Undang No. 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja. Dengan adanya Undang-Undang Cipta Kerja ini diharapkan ada kepastian hukum dan tidak  terjadi tumpang tindih peraturan  baik dalam proses  perizinan  maupun pasca  perizinan (saat beroperasi). Dengan dikeluarkannya peraturan yang memuat aturan mengenai investasi, tentu terdapat berbagai perubahan yang dirasakan dan  menimbulkan pertanyaan, terkhusus bagaimana pemerintah Kota Batam menyikapi akan perubahan tersebut. Penelitian ini dilakukan dengan tujuan untuk menemukan jawaban atas pertanyaan-pertanyaan tersebut. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis empiris, yaitu pendekatan yang melihat dan mengkaji peraturan perundang-undangan terkait permasalahan kemudian menghubungkannya dengan kenyataan yang ada di lapangan. Hasil penelitian menunjukkan bahwa pemerintah Kota Batam sudah menerapkan berbagai kemudahan kepada investor melalui regulasi UU Cipta Kerja, dimana output dari UU Cipta Kerja tersebut, pemerintah Kota Batam membuat Peraturan Daerah Provinsi Kepulauan Riau tentang Pemberian Insentif dan Kemudahan Investasi. Guna membuat kepastian hukum mengenai insentif investasi di Kota Batam semakin jelas.

Abstract

With the rapid advancement of technology, the emergence of Non-Fungible Token (NFT) platforms has revolutionized digital buying and selling. However, this innovative platform has also given rise to a concerning issue: the unintentional trade of personal data instead of artwork. This problem poses a significant challenge in protecting individuals' personal information, especially when items like National Identity Card (KTP) photos are sold as NFT assets. This research aims to explore the critical importance of legal education in safeguarding personal data, thus preventing such transactions that may lead to self-harm. Employing a normative juridical method and a conceptual approach, this study extensively analyzes legal aspects and regulations related to personal data protection. The findings underscore the urgent need for legal education to effectively address personal data transactions on NFT sites within marketplace platforms. Despite the implementation of the Personal Data Protection Act (Law Number 27 of 2022), it is clear that the legislation alone is insufficient. Given the gravity of the issue, comprehensive public education initiatives involving various segments of society are crucial. Protecting personal data has become a matter of utmost concern for the government, the state, NFT platform users, and internet users at large. Individuals must adopt a vigilant and proactive approach in safeguarding their personal data. Legal education programs, including outreach activities conducted by governmental and non-governmental entities, along with the involvement of students and academics in community counseling, can effectively support this objective.
