Abstract

Indonesia is a large and densely populated country, so the opportunities for human trafficking to occur are even greater. This crime has been going on since the time of ignorance. Women are considered weak and useless, so men enslave and satisfy their lust for women. However, with the entry of Islam, the degree of women began to rise, and there was no difference between men and women. The Qur'an also mentions a lot about the prohibition of this crime, although it is not explained clearly. Therefore, the author is interested in exploring how the Qur'an views the crime of trafficking in persons, both women and children, what is an Islamic perspective and what solutions are offered to minimize this crime. This research includes library research through texts or verses of the Qur'an related to the subject of human trafficking. The result of this research is that the term human trafficking is mentioned in several letters, namely in Surah An-Nur verse 33, and Yusuf in verses 19-20. Textually and contextually, talk about human trafficking is seen from various angles of the context, namely through recruitment, sale and exploitation, which in fact today tends to be sexual exploitation or prostitution. Islam highly upholds the humanity of every person, therefore Islam makes various efforts to abolish slavery, namely freeing slaves, giving punishment for various violations of law by freeing slaves, ordering employers to offer self-emancipation (muktabah) and fulfillment of promises/votives by freeing or free slaves

Abstract

The pattern of harmonization of the age limit for marriage in Indonesia between living law and positive law is described in this study. The purpose of this descriptive-analytic study is to provide a comprehensive explanation of the age limit for marriage from a variety of perspectives. The method of seeking to harmonize Islamic and positive law was then used to analyze and interpret the obtained data. Harmonization in limiting the age of marriage can be seen in three ways, according to the findings of this study: First, the philosophical differences between the two regarding how to interpret marriage's purpose. According to both positive and Islamic law, marriage is intended to benefit both parties. Second, Epistemological Considerations Islamic law provides an epistemological foundation for the government's age limit for marriage, siyasah syar'iyyah. Third, the legal aspect: despite the fact that positive law stipulates that a person must be 19 years old to get married, the state provides a marriage dispensation mechanism as an emergency exit for marriages performed before that age

Abstract

This study aims to determine the religious moderation hadith that focuses on tolerance between religious communities, asbab al wurud hadith and the relevance of moderated hadith in Indonesia. The type of research used is library research or library research. Primary sources are the hadith books of Bukhari, Muslim, and Musnad Ahmad. The data analysis technique used inductive analysis and descriptive analytic. The results of the study show that in the hadith of the Prophet Muhammad SAW, there are traditions of religious moderation in religious tolerance which are also practiced by friends and tabi'in. But historically, tolerance between religious communities is more about muamalah, not in terms of worship. To build a moderate understanding of Islam, it is necessary to review the understanding of religious texts (al-Qur'an and hadith) as well as social conditions at the time the verses of the Qur'an and hadith were revealed. A dynamic, progressive, and tolerant understanding is needed in the variety of religions and cultures that exist in Indonesia. Correlated texts and realities are two inseparable things in achieving religious moderation, so that an understanding emerges that moderation in Islam is a noble teaching.
