Abstract

This study delves into the intricate interplay between transformational leadership and the Maqashid Shariah framework within the context of organizational triumph, drawing from established theory and a comprehensive analysis of prior research through literature review. Transformational leadership emphasizes visionary outlooks, motivational dynamics, and constructive influence, while Maqashid Shariah underscores Islamic ideals of prosperity. The amalgamation of these paradigms holds promise for cultivating leadership that is not solely effective in material terms but also morally grounded and adaptable amidst global transformations. Within the Maqashid Shariah framework, leaders are tasked with upholding religious tenets, safeguarding life, property, lineage, and rationality in their decision-making and actions, fostering inclusivity in the workplace, promoting mental well-being, ensuring economic equity, nurturing a morally upright future generation, and fostering intellectual growth. Consequently, leaders imbued with the ethos of Maqashid Shariah serve as catalysts for positive change, propelling organizational objectives forward with Islamic ethics as their moral compass.

Abstract

This article aims to discuss the relationship between the state and Muslim civil society in managing zakat in Indonesia. The practice of zakat management in Indonesia has experienced ups and downs in the context of relations between the state and Muslim civil society. However, this kind of relationship does not hinder efforts to manage zakat optimally. Zakat management through zakat institutions has great benefits when compared to non-institutionalized zakat management. This article attempts to answer the question of what is the relationship between the state and Muslim civil society in managing zakat in Indonesia? Why is institutionalizing zakat important in efforts to manage zakat in Indonesia? This article is a type of literature research with a ma'na cum maghza approach which has found, first, that the management of zakat is in the domain of Muslim civil society in its relations with the state, especially after Indonesia's independence. The relationship between the National Amil Zakat Agency (BAZNAS) which is affiliated with the state and the National Amil Zakat Institute (LAZNAS) which is affiliated with Muslim civil society is synergistic in efforts to manage zakat optimally. However, after the enactment of Law Number 23 of 2011 concerning Zakat Management, the state attempted to manage zakat nationally through the existence of BAZNAS. Secondly, zakat management in a zakat institution is important in an effort to optimize professional zakat management as indicated in Surah at-Taubah verse 60 which is represented through the existence of BAZNAS and LAZNAS

Abstract

The growing demand for education and the increasing awareness of its value have also had an impact on the financing of higher education. Governments are working to meet the growing demand for sustainable higher education with better quality but with limited resources. Although many governments have launched student loan programs, the debate about the failure of student loan programs in developing countries is still unresolved. This study aims to collect and analyze articles related to the reasons why student loan programs are not more widely recognized in Indonesia by analyzing the implications of student loans. The method used in this study is a literature review by collecting various sources of articles related to the issues discussed. The results of the study show that there are many problems with student loans that are not widely known, such as irrelevant student loan policies, challenges in their application systems, and unrecoverable loans that eventually burden the community. The role of government, bank trust, and community commitment are the factors that determine the level of success in achieving these student loans

Abstract

Hermeneutics is a branch of philosophy concerned with interpreting meaning. In Islamic religion, hermeneutics have something in common with interpretation. It is the presence of a text or message, the person delivering it, and the person who needs to understand it. This writing aims to expose Khaled M. Abou El Fadl's hermeneutics in his book On the Name of God, which arose from Khaled's disagreement with the misogynistic fatwa issued by UCLA. This research uses a qualitative approach with content analysis. In solving the problems related to the interpretation of the text, Khaled Abou el Fadl offers to negotiate hermeneutics. Hermeneutics negotiates the complex interactions between three: the author, the text, and the reader. This research indicates that the role of the writer, text, and reader is more important than in religious texts. Additionally, the reader interpreting the text must fulfill five conditions: honesty, sincerity, integrity, rationality, and self-control. This approach emphasizes the importance of understanding the social, cultural, historical, and linguistic contexts behind religious texts to interpret them correctly. Several points emphasize the importance of Khaled Abou El-Fadl's hermeneutics, namely contextuality, in-depth understanding, ethical and moral importance, responsive and relevant to the development of the times, the last being multidisciplinary use that combines knowledge of religion, history, philosophy, and social sciences.

Abstract

After the enactment of SEMA No. 3/2018, the issue of unregistered polygamous validation has become a new polemic in religious courts. Decision No. 130/Pdt.G/2020/Ms.Bna and No. 311/Pdr.P/2022/PA.Bjb granted the application for unregistered polygamous validation, thus raising a question, what kind of legal considerations underlie the judges to oppose SEMA No. 3/2018? This study examines the consideration of granting the validation of unregistered polygamy by judges in the two decisions above to find out the typology of Islamic legal thinking in them. This research is a normative legal research with a case approach. The results showed that the judges used the legal doctrine of previous scholars as the basis for granting the application for the validation of unregistered polygamy, thus reflecting a traditional style of thinking. This thinking is evident when: 1) The judge based the validation of the applicant's second marriage only on the validity of the unregistered marriage; 2) The judge did not consider the conditions for the permissibility of polygamy due to emergency conditions; and 3) The judge also did not explore the potential power relations in the polygamy permit from the first wife which allowed for coercion. This research shows that the traditionalism of Islamic legal thought is used by judges to counter the policy of the Supreme Court Circular that has taken effect.
