Abstract

Islam is a religion adhered to by most of Lombok’s population. Lombok is an area rich in religious traditions. One of them in the Praya area is the ‘Nyiwak’ tradition. Nyiwak is a religious tradition of dhikr and tahlil carried out on the ninth day of a person’s death. This “Nyiwak” tradition applies to all levels of society regardless of the economic level of the family left behind. This tradition is difficult for the people of Praya to abandon because it is ingrained and has become a forum for friendship between communities. In addition, this tradition is also one of their ancestors’ legacies, which continues to be preserved to this day. Thus, some view it as a heresy (bid’ah). Therefore, this research aims to analyze the Nyiwak tradition based on an Islamic law perspective. This research was a descriptive analysis research, where the researcher tried to describe the concept of the Nyiwak tradition in Praya globally and then analyzed it based on Islamic law. Data was collected through participant observation by being one of the congregation readers of Yasin, dhikr, and Tahlil at the forum. The research results obtained two views about Islamic law’s “Nyiwak” tradition. Firstly, the research revealed that it was not based on the Sunnah of the Prophet or Bid’ah Dholalah. Secondly, this tradition was Bid’ah Mahmudah or praiseworthy, because it contained good habits to bring one’s soul closer to Allah SWT.

Abstract

The Baayun tradition is one of the cultural practices that remain sustainable in Sukamara Regency, Central Kalimantan. Acculturation between local culture and Islamic teachings in this tradition is an interesting topic to study. This research aims to analyze and describe the Baayun tradition of the Sukamara people as a form of the Living Qur'an. The research method used is qualitative, using semiotic analysis techniques, namely analyzing symbols, language, and actions in the procession. Data was obtained through interviews, observation, and documentation. The research results show that there is an intense syncretism process between local culture and Islamic teachings, resulting in a unique form of religious expression and reflecting the flexibility of Islam in adapting to local culture so that it becomes an integral part of community life.

Abstract

This study aims to explore why the values of the Medina Charter (Piagam Madinah) have begun to be abandoned by major world powers, resulting in disruptions to global peace and the persistence of conflicts, such as those between Israel and Hamas, Myanmar and the Rohingya ethnic group, as well as the Syrian civil war, which has claimed numerous lives. The data collection method involved systematic procedures through a literature review. The findings reveal that the reasons for the abandonment of the Medina Charter stem from political and social factors. Politically, countries such as the United Kingdom and the United States support Israel as a gesture of gratitude, as these nations received assistance from Jewish individuals during World Wars I and II. Additionally, human rights violations, a social factor, manifest in forms such as discrimination, as seen in Myanmar against the Rohingya ethnic group. Also, the civil war in Syria was caused by political and social factors.

Abstract

Bullying can cause adverse physical and mental effects on victims, including stress, depression, and social isolation. Bullying contradicts the values of Islamic teachings, which emphasize compassion, justice, and respect for others. In the context of da'wah (Islamic preaching), it is important for preachers (da'i) to understand and address the issue of bullying in accordance with religious teachings. The purpose of this research is to discuss the bullying issues occurring in society and provide recommendations and solutions for da'i in addressing or delivering da'wah related to bullying cases. This study is descriptive-qualitative research using a literature review approach. The primary data sources include the Qur'an, hadith, and relevant documents. Secondary data are derived from scientific studies, articles, journals, and books discussing the phenomenon of bullying. Data analysis is conducted by deeply interpreting the collected data and then concluding. The research results identified several factors contributing to bullying in schools, including individual factors, such as a sense of superiority (having power), lack of supervision by teachers or educators, family or parental influences, and peer factors. Preventive steps for da'i to address bullying are by giving an understanding of retaliating with no harm action, building friendships, supporting networks, relocating to a better environment (hijrah), self-defense, education, and awareness. As da'i, they can share stories of the Prophet and his companions that illustrate good behavior, instill empathy and tolerance, and encourage positive behavior to prevent bullying.

Abstract

Adultery and marriage are discussed concerning ideality. Marrying an adulterer becomes a legal issue that needs to be studied due to the impropriety of marrying an adulterer. This study analyzes the effect of adultery on future marriages in interpreting Al-Misbah surah An-Nur verse 3, written originally by M. Quraish Shihab. In addition, the interpretation by Quraish will also be parsed with Rebbeca F. Plante's sociology of sexuality analysis to connect the context study of an adulterer's marriage described in Tafsir Al-Misbah with the stigma of sexuality that occurs due to the act of penetration before marriage. The method used is qualitative with a normative-juridical approach, and to sharpen and deepen this study, a sociological analysis of sexuality is used. This study explains that Tafsir Al-Misbah interprets verse 3 of Surah An-Nur with circumstances that benefit one gender and harm the female to achieve the ideal of marriage. With a social approach, there is an implicit stigmatization effort in the interpretation of verse 3 of Surah An-Nur by labeling adulterous females as partners who are not ideal for marriage. This also indicates that socially, a female with such stigmatization is presented as having a bad sexual reputation and provides space for injustice for a female to choose a partner with ideal considerations as befits a male who desires a partner with ideality towards marriage. Thus, the interpretation of the law in verse 3 of surah An-Nur in Tafsir Al-Misbah appears to disadvantage one gender (female) subjectively.

Abstract

The significance of women in public life rises as Indonesia embarks on reforming its political institutions and processes due to democratization. This study examines women's public life in Banyumas Regency, Central Java, in the context of cultural and Islamic values. Both Islamic and Penginyongan cultural values endorse traditional gender roles, potentially limiting women's public participation. However, these values also foster social harmony, community involvement, and religious ethics, which may support women's political engagement. The research data includes the number of women in public roles, their effectiveness in advocating for women's interests, and the interpretation of Islamic and Penginyongan cultural values. Data collection methods encompass interviews, observations, and document analysis. This study concludes by utilizing a sociological approach based on David Easton's systems theory that Islamic and Penginyongan cultural values influence women's public life, and political representation in Banyumas is multifaceted and shaped by various interacting factors. Understanding these dynamics is essential for crafting strategies to advance gender equality and women's public life empowerment in the region.

Abstract

Sharia advocates (Sharia lawyers) in Indonesia face the challenge of maintaining their significant role amidst the dominance of general advocates. This research evaluates the professionalism of Sharia advocates in the Banyumas region, focusing on the Banyumas Religious Court, Banyumas District Court, Purwokerto Religious Court, and Purwokerto District Court. This study used a qualitative and constructivist approach and collected primary data through interviews with Sharia advocates and secondary data from documents. Findings indicate that legislation recognizes Sharia advocates as professional advocates eligible to practice in all courts, akin to general advocates. However, Islamic universities, especially Sharia faculties, need to prepare graduates to compete with general law graduates for advocacy roles. In the Banyumas region, Sharia advocates provide legal services primarily in civil law cases under religious court jurisdiction across four courts. The main challenge for Sharia advocates is the public perception that they only handle Islamic legal cases and only practice in religious courts. Furthermore, there is a strong negative stigma among legal practitioners regarding the low proficiency of Sharia advocates in positive law, leading to their limited involvement in handling cases in District Courts (Civil Courts).
