Abstract

Teacher certification is a government policy that has a noble purpose to improve the quality of education and welfare of teachers, considering the magnitude services of a teacher in educating generation of people. Teacher certification is aimed to improving the quality of education and welfare of teachers. The purpose of this study is to analyze the concept, implementation and impact of teacher certification, and to formulate a reorientation of the conception and implementation of teacher certification. The method used is a qualitative approach, which falls into the category of policy analysis, on the basis of review and synthesis on the processed data and related information.Such goodwill has unfortunately been tainted by the fact that there has been a swift of paradigm among teachers. Initially, their main purpose to be a teacher is to transform science and to educate students to become better than before. But now, such a noble intention has been changed to a merely certificates oriented.

Abstract

The questions in this research are: 1) how do the regulation protect the rights of minority to freedom of religion and belief at the provincial level; 2) whether the existing regulations are in line with the instruments of human rights; and 3) how is the reality of people living in the context of harmony between religious groups. The purposes of this study are: 1) to find out the regulation of freedom of religion and belief for minority groups; 2) to find out whether regulations are in conflict with the human rights instruments in terms of freedom for religious minority groups; and 3) to find out the reality of people’s life in the context of harmony among believers. The method of this research is qualitative-descriptive research that generates descriptive data in the form of written word or spoken, and people’s behavior that can be observed. Several conclusions in this research are: 1) Regulatory policy in North Sulawesi rules that any religious organizations other than the six religions, namely Islam; Catholic; Protestants; Buddha; The Hindu; and Confucius, is considered to be a social organization (beliefs) that can be registered to the government, through the Ministry of culture and tourism; 2) instruments of human rights have been accomodated on one of the principles of human rights, i.e. participation, through the inter-faith cooperation forum (FKUB and BKSAUA); and 3) the reality of community’s life in the context of harmony between religious groups is tied by the rope of fraternity.

Abstract

The right to health is one of human rights, therefore the state should guarantee every citizen to get good health care and quality. Social Security Agency (BPJS) Health is one of the country’s efforts in fulfilling the right to health. Through this paper the authors wanted to know how the right to health is done by BPJS Health and Health BPJS obstacles encountered in providing adequate health insurance for the community. BPJS Health in carrying out the duties and functions must be able to ensure the availability, accessibility, acceptability and quality of health services is inadequate. Constraints that are regulatory, administrative and technical BPJS Health inhibit performance. Therefore, it is necessary to encourage improvements to all Indonesian people can participate and benefit from the existence BPJS Health.

Abstract

One effort to strengthen the idea of democratic policing is through civic education. This research has the main aim of analyzing the conceptual aspects contained in civic education in order to provide strengthening ideas for democratic policing. This research also attempts to outline the challenges of democratic policing as viewed from the perspective of civic education in Indonesia. This article uses Gary Goertz's three-level conceptual analysis framework to dissect the conceptual dimensions in civic education that are useful for strengthening democratic policing. Qualitatively, data was obtained using literature studies from various books, journal articles, report documents, and other literature. This study shows that civic education, which is integrated with democracy, politics, law, human rights, anti-corruption, and peace education, can be a vehicle for conceptually strengthening the idea of democratic policing. In addition, this study found a number of challenges for civic education in strengthening democratic policing efforts in Indonesia. The main challenges are the problems that occur in the police institution, including not yet fully supporting democratic culture and spaces for citizens, the issue of police neutrality in political life, the practice of violations of law and human rights by police officers, the existence of corrupt behavior, and the fact that the police has not yet fully become a humanist and non-violent institution. This study requires further research to see to what extent the implementation of the concept of civic education can strengthen democratic policing efforts that are oriented to the citizenship dimension.

Abstract

The evaluation discusses the implementation by the Guidelines for the Community Health Insurance Year 2008, the health insurance for the poor has become reality. JAMKESNAS is a great agenda for realizing to fulfill the rights of health that is facilitated by the Ministry of Health and Local Government with funding sourced from the tax and the natural resources. The core issues are implementation and realization JAMKESMAS programs such as, basic health services and referrall health service, beside to show the response of  poor society. This evaluation used qualitative methods with combine between juridical normative approach to review the legal and regulatory norms as well as policy analysis and implementation of study related any policy issued by the  local government to fulfill rights of health for the poor. The result of evaluation show relatively successfully help poor communities in the province West of Nusa Tenggara to get free service of health in the context of human rights protection from the state, but still need more significant enhancements for optimal benefits. There are several problems that needs the way out such as : the distribution of cards is not on target; variety of drugs and patients’ needs. The limited-quality drugs to be a dilemma for Hospital in Mataram.

Abstract

Rights of children in conflict with the law which consists of the right to be examined in a family, the right to always be accompanied by a parent / guardian or foster parent, the right to be accompanied by a supervising community and the right to be accompanied by legal counsel can not be protected and enforced. While the factors that support and hinder the implementation process of children in conflict with the law are based on the ignorance of the rights of children suspected or accused child rights are protected by laws and regulations, law enforcement officials are not divulging information about rights owned by the suspect or the accused child either intentionally or unintentionally, there is no provision that expressly regulate the legal consequences if the rights of the suspect or defendant is not notified or violated and the role of legal counsel in the examination of cases of children in conflict with the law in the District Court of the less obvious

Abstract

This research was conducted in Aceh, West Kalimantan, Central Sulawesi and Maluku. The goal is to get an overview of the role of civil society, as well as to analyze the synergy between government policies and the activities of civil society in fostering religious tolerance. The results of this research are expected to provide insights for central and local government policy making, especially those related with efforts to foster communal harmony and inter-religious tolerance in Indonesia. The method used in this research is a combination of quantitative and qualitative methods. Primary data collection was done by using in-depth interviews and distributing questionnaires, while secondary data were obtained through library studies. Every data obtained as such were processed and analyzed with the ultimate goal of answering the research question. The development in the four provinces reveals the important role of community leaders in the creation of supportive conditions for inter-religious tolerance and communal harmony. Various community organizations have also asserted their roles in the efforts to foster a culture of inter-religious tolerance. NGOs, as part of civil society organizations, have also showed their awareness to the importance of creating social cohesion within the community.

Abstract

Sexual abuse of children are serious crimes that can occur in children, anywhere, anytime and regardless of their social background. Crime is mostly carried out by someone in the child’s social environment, such as family, relatives, family friends, teachers, religious leaders, and neighbors. The effects of sexual assault for victims of very serious because of perceived trauma will continue to carry over until they mature and can affect all aspects of their lives and threaten the lives of children as the future generation. Many of the factors that trigger the occurrence of sexual violence against children in West Nusa Tenggara, namely poverty, education is still low and cases of early marriage. The phenomenon of early marriage is causing risk of disruption to children’s education, especially for girls. This study is a qualitative research that focuses on the phenomenological paradigm that seeks to understand the meaning of the event or events that are related to the situation on the ground. This type of research is descriptive analytical approach, which wants to give a clear and detailed description as well as systematic, on all matters relating to the protection of child victims of sexual violence. Results of the study in order to become the recommendation for the central government and local government as research areas in formulating policy strategy is best for the child victims of sexual violence. There are still many cases are not reported because families consider it a disgrace and families often suggested or decided to reconcile with the perpetrator if a relative or family, so that the data presented in the case of the police or the court is only the tip of the iceberg compared to the actual events occur. Encourages all stakeholders including central and local government, police, prosecutors and judges, to have the same perception of the law on the protection of children in order to provide future better for the children of Indonesia.

Abstract

This article focuses on the Indonesian Police (Polri) efforts in the realization of human rights-based policing, as well as its articulation in the forming education (pendidikan pembentukan/ DIKTUKBA) of Polri, specifically at the State Police School (Sekolah Polisi Negara/SPN) in North Sumatra, established in 1960-s and one of the oldest SPN in Indonesia. Since 2021, Polri has acknowledged and developed the ‘presisi’ curriculum to become a starting point for transformation agenda and, of course, to strive Polri’s obligation in the implementation of human rights values, principles and standards in the police functions. The research applied a qualitative approach with a descriptive design. Data collection was employed using documents, FGD, observations and literature relevant to police and human rights issues. Respondents were selected using a purposive sampling technique. Data validation was carried out by extending observations and triangulation and analyzed using the spiral technique. Human rights-based policing through the DIKTUKBA POLRI level at the SPN Poldasu brings the vision of ‘presisi’ police through the ‘presisi’ curriculum. The ‘presisi’ curriculum offers good ways to achieve the transformation of the Polri. However, the increasingly short training period for the DIKTUKBA POLRI represents a challenge to improve human rights-based policing. The challenges affirm the correlation between human rights and policing in a dynamic police workspace. In this context, the instructors’s capacity must continuously acquire knowledge and experience. Therefore, collaboration and innovation in using learning models and methods such as group learning, problem-solving, discussion, and active involvement of students can be continuously developed.

Abstract

Ideally, if a person that is categorized as“the have” has a legal problem, she/he may appoint one or more lawyers to defend their interests. Likewise, someone who are poor (the have not) can also ask a defense from one or more public defender (public defenders) as workers in legal aid institute to defend their interests in a lawsuit. This condition must be fulfilled in order to implement the principle of equality before the law and equality of treatment and access to justice. In fact, a number of cases invite the public attention, which shows the lack of access to the poor to obtain legal assistance. This study aimed to describe the model of legal aid “probono” in the field, to identify and analyze the role of advocate, state or local government and law enforcement agencies in implementing the legal aid “probono”, and to inventory and analyze supporting factors and obstacles in fulfilling legal aid for the poor. This research uses qualitative research, where the primary data collected from informants, obtained by in-depth interviews with informants including the legal agency of local government, law enforcement officers (police, prosecutors, judges), legal aid, academics from the universities, and people with legal problems. Secondary data collected from books, scholarly works, research reports, and documents related to the research topic.
