Abstract

The Strait of Malacca is one of the busiest straits in the world, with more than 60,000 vessels through the strait per year. This strait is located in a strategic location to connect the west part and east part of the world. However, the number of vessels transit and pass through the strait affects marine environmental issues. Pollution, especially vessel-based sources, may affect marine life. To settle the issues along with the boundary issue, Indonesia, Malaysia, and Singapore have entered into some agreements to cooperate to manage the Strait of Malacca since the 1970s. Recently, the concept of Cooperative Mechanism has been developed. Several meetings amongst these states have been done with some positive deals. With this concept, the littoral states believe that it can prevent, reduce, and control of marine pollution in the Strait of Malacca. However, more progress is still needed to enhance from the implementation of the Cooperative Mechanism. Keywords: Strait of Malacca, Pollution, Marine, Environment, Cooperative Mechanism.

Abstract

Abstract The concept of administrative sanctions is a doctrinal idea that is not normatively defined. The purpose of regulating sanctions in administrative law legislation is to counteract the feeling of impunity against certain violations of the rules of public law. Typical administrative law sanctions indicate juridical characters that are not the same, some have reparatoir/herstel characters (bestuursdwang and dwangsom), punitive - condemnatoir / bestraffende characters (administrative fines) and mixed characters (withdrawal of favorable decisions). Keywords: Administrative sanctions, Juridical characters. Abstrak Konsep sanksi administrasi merupakan gagasan doctrinal yang  tidak didefinisikan secara normatif. Tujuan diaturnya  sanksi dalam peraturan perundang-undangan hukum administrasi adalah untuk menangkal perasaan impunitas terhadap pelanggaran tertentu dari peraturan hukum publik. Sanksi hukum administrasi yang khas menunjukkan karakter yuridis yang tidak sama, ada yang memiliki karakter pemulihan/reparatoir  (bestuursdwang dan dwangsom), karakter hukuman/condemnatoir  (denda administrasi) dan karakter campuran (penarikan keputusan yang menguntungkan).    Kata Kunci : Sanksi administrasi,  Karakter yuridis.

Abstract

Abstract The correlation between decentralization and deconcentration on the concept of a unitary state and a federal state is not dichotomous but rather forms a matrix or continuum relationship. Within the continuum, it is possible to shift the pendulum swing both centripetally (concentrating or cone in a higher power) or centrifugal (spreading or dispersing into the power of smaller government units). In the practice of relations between the center and the regions in various countries, the pendulum swing of unitarism (unity) and federalism move in opposite directions. Keywords: Decentralization, Asymmetric, Republic of  Indonesia  Abstrak Korelasi hubungan desentralisasi dan dekonsentrasi antara konsep negara kesatuan dengan negara federal tidak bersifat dikhotomis yang saling berlawanan, melainkan membentuk sebuah hubungan matriks atau kontinum. Dalam rentang garis kontinum tadi, sangat dimungkinkan terjadinya pergeseran pendulum baik yang bersifat sentripetal (memusat atau mengerucut dalam kekuasaan yang lebih tinggi) maupun yang sentrifugal (menyebar atau pemencaran kedalam kekuasaan unit pemerintahan yang lebih kecil). Dalam praktik hubungan antara pusat dan daerah di berbagai negara, pendulum unitarisme (kesatuan) dan federalisme saling bergerak ke arah yang berlawanan. Kata Kunci: Desentralisasi, Asimetris, Negara Kesatuan Republik Indonesia.

Abstract

Abstract This study aims to know the Principles of Good Corporate Governance in the Management of Third Party Contribution Donations at the Perum Perhutani Central Java. Research is a study of legal documents described in a qualitative form. The results of the study show that the effort to maintain the implementation of the core business and the Perum Perhutani business plan, in order to mitigate the risk of the relationship between Perhutani and Central Java Province, it is necessary to consider terminating the SP3 levy and turning it into a PNBP as stipulated in Law Number 20 of 1997 concerning Revenue Non-Tax State with all the consequences as regulated Article 4: All Non-Tax State Revenues must be paid immediately as soon as possible to the State Treasury, and Article 5: All Non-Tax State Revenues are managed in the State Budget and Revenue System, then it is necessary to formulate a basis for arranging grants to the Government Central Java Province with the approval of the Minister of Finance. Keywords: Good Corporate Governance, Third Party Charges, Perhutani. Abstark Penelitian ini bertujuan untuk mengatahui Prinsip Good Corporate Governane dalam Pengelolaan Pungutan Sumbangan Pihak Ketiga  Pada Perum Perhutani Jateng. Penelitian merupakan penelitian dokumen hukum yang diuraikan dalam bentuk kualitatif. Hasil penelitian menujukan bahwa upaya menjaga dilaksanakannya core bussines maupun bussines plan Perum Perhutani maka dalam rangka mitigasi risiko hubungan antara perum perhutani dengan Propinsi Jawa Tengah maka perlu dipertimbangkan untuk memberhentkan pungutan SP3 dan merubah menjadi PNBP sebagaimana diatur dalam Undang-Undang Nomer 20 Tahun 1997 tentang Penerimaan Negara Bukan Pajak  dengan segala konsekuensinya sebagaimana diatur Pasal 4 : Seluruh Penerimaan Negara Bukan Pajak wajib disetor langsung secepatnya ke Kas Negara, dan  Pasal 5:  Seluruh Penerimaan Negara Bukan Pajak dikelola dalam sistem Anggaran Pendapatan dan Belanja Negara , selanjutnya perlu  dirumuskan dasar pengaturan hibah  kepada Pemerintah Provinsi Jawa Tengah dengan persetujuan Menteri Keuangan. Kata Kunci: Good Corporate Governance, Pungutan Pihak Ketiga, Perhutani.

Abstract

Abstract Basicly, The government carries out three main duties, namely: organizing government, carrying out development, and holding public services. State that is required to attend to serve every citizen and citizen to fulfill the rights and basic needs of the community under government approval, accept the mandate of the UUD NRI 1945 (Constitution of the Republic of Indonesia). Based on data or empirical facts, the fact that public services in Indonesia are still not optimal. The quality of community services that have not been optimal, determine the expectations of the community, will reduce the essence of the objectives of the government (state) to realize social welfare for all the people of Indonesia. For this reason, one of the efforts that must be done immediately in realizing good and prime public services is to optimize public information disclosure in the implementation of public services. The main key to understanding good governance is understanding the principles of good governance. Starting from these principles, a benchmark for the performance of a government will be obtained. Information disclosure is one of the important principles of good governance, which can help to realize good and excellent public service delivery. The constitutional guarantee of the right to public information disclosure agreed is contained in Article 28F of the UUD NRI 1945, then further regulated in Act Number 14 / 2008 Concerning Public Information Openness (UU KIP), related to the budget for public service needs, namely transparent, effective and efficient, accountable and accountable. Public services related to information disclosure will create good governance. Keywords: Information disclosure, public service, good governance. Abstrak Pemerintah pada prinsipnya menjalankan tiga tugas utama, yaitu: menyelenggarakan pemerintahan, melaksanakan pembangunan, dan menyelenggarakan pelayanan publik. Negara wajib hadir untuk melayani setiap warga negara dan penduduk untuk memenuhi hak dan kebutuhan dasar masayarakat dalam kerangka pelayanan publik, sebagaimana amanat UUD NRI 1945. Berdasarkan data atau fakta empiris, tercermin bahwa pelayanan publik di Indonesia masih belum optimal. Kualitas pelayanan publik yang belum optimal, sebagaimana harapan masyarakat, akan mengurangi esensi tujuan pemerintah (negara) untuk mewujudkan kesejahteraan sosial bagi seluruh rakyat Indonesia. Untuk itu salah satu upaya yang harus segera dilakukan dalam mewujudkan pelayanan publik yang baik dan prima adalah mengoptimalkan keterbukaan informasi publik di dalam penyelenggaraan pelayanan publik. Kunci utama memahami good governance adalah pemahaman atas prinsip-prinsip di dalamnya. Bertolak dari prinsip-prinsip ini akan didapatkan tolak ukur kinerja suatu pemerintahan. Keterbukaan informasi merupakan salah satu prinsip yang penting dari good governance, yang dapat membantu untuk mewujudkan penyelenggaraan pelayanan publik yang baik dan prima. Jaminan konstitusional terhadap hak atas keterbukaan informasi publik sebagaimana termaktub dalam Pasal 28F UUD NRI 1945, kemudian diatur lebih lanjut ke dalam Undang-Undang Nomor 14 Tahun 2008 Tentang Keterbukaan Informasi Publik (UU KIP), menjadi dasar bagi pemerintah untuk melaksanakan fungsi pelayanan publik yang baik, yaitu yang transparan, efektif dan efisien, akuntabel serta dapat dipertanggungjawabkan. Pelayanan publik yang didasarkan pada keterbukaan informasi, akan mewujudkan suatu tata kelola pemerintahan yang baik. Kata kunci: Keterbukaan informasi, pelayanan publik, tata kelola pemerintahan yang baik (good governance).

Abstract

In the Lex Silencio Positivo cases, there is no Consultative Meeting and Preparatory Examination. Meanwhile, the two examinations are necessary. This research intends to explore the Role of Judges in Lex Silencio Positivo cases where the Judge does not get a particular stage to examine the Applicants' petition files, both formal and material terms. This study uses the normative juridical method. The results of this study Judges play an essential role in distributing the burden of evidence fairly. The Judge should also carefully examine the Applicants' petition files to prevent the misuse of Positive Fictitious Decisions by the Applicants Keywords: Judges, Lex Silencio Positivo, Evidence. AbstrakPada Penyelesaian Sengketa Keputusan Fiktif Positif tidak ada Rapat Permusyawaratan dan Pemeriksaan Persiapan karena sifatnya yang berupa permohonan. Sementara kedua pemeriksaan tersebut penting karena untuk memeriksa dari segi formil dan segi materiil. Penelitian ini hendak menggali Peran Hakim pada Penyelesaian Sengketa Keputusan Fiktif Positif di mana Hakim tidak mendapatkan tahapan khusus untuk memeriksa berkas Permohonan Pemohon baik dari segi formil maupun materiil. Penelitian ini menggunakan metode yuridis normatif dalam. Hasil dari penelitian ini Hakim memegang peranan penting dalam membagi beban pembuktian secara adil. Hakim juga harus memeriksa dengan teliti berkas Permohonan Pemohon untuk mencegah terjadinya penyalahgunaan Keputusan Fiktif Positif oleh Pemohon. Kata Kunci : Hakim, Keputusan Fiktif Positif, Pembuktian.

Abstract

AbstractThe diversity of Indonesian people will affect the social condition, including political life and decision. About the general election, Indonesian people who consist of various tribes, culture, and religion, highly depend on the political party to transfer their aspirations. Indonesian political party has a vital role in Indonesian political culture.  Hence, there are so many political parties in Indonesia because of the number of its citizens. The multi-party mechanism becomes much more important, considering Indonesia's social and geographical conditions. In the context of simplifies the number of the political party in Indonesia, this process will damage the diversity of the people. This article is using normative research method. Later on the discussion, this article will discuss the simplifying process of the political party in Indonesia. Furthermore, it will also examine the impact of the political party simplification on the Unity of the nation. Keywords: General Election; Simplification; Political Party; Unity  AbstrakKeberagaman masyarakat Indonesia merupakan salah satu kelebihan bangsa. Keberagaman masyarakat tersebut kemudian akan mempengaruhi kondisi sosial masyarakat termasuk juga dalam hal politik. Terkait dengan pelaksanaan pemilihan umum, masyarakat yang terdiri dari berbagai suku budaya dan agama ini membawa konsekuensi banyaknya aspirasi masyarakat yang antara satu dengan yang lain membawa kepentingan yang berbeda. Partai politik sebagai salah satu kanal aspirasi masyarakat mempunyai peran yang sangat vital. Mekanisme multipartai di Indonesia menjadi suatu keharusan dengan melihan kondisi sosial dan geografis Indonesia. Dalam konteks penyederhanaan partai politik, proses penyederhanaan kemudian akan merusak tatanan keberagaman tersebut. Penulisan hukum ini menggunakan metode penelitian yuridis normatif. Pada bagian pembahasan penulis akan melakukan kajian terhadap proses penyederhaan partai politik yang pernah terjadi serta mengkaji bagaimana penyederhanaan jumlah partai politik ini dapat menyebabkan terjadinya disintegrasi bangsa. Kata Kunci: Pemilu, Penyederhanaan, Partai Politik, Persatuan

Abstract

Abstract This study aims to find out how the implications of the abuse of Administrative Authority in the Village Apparatus Selection in Demak Regency. The research is a concise study based on cases that were consulted at the Legal Consultation Board, Faculty of Law, University of Diponegoro. Research Results Aimed that the abuse of authority occurred in the process of selecting village officials in Demak Regency. The authority to determine the selection committee of the village apparatus is the authority of the Village Head as mandated by the Law - Invitation on the Village, and not the authority of the Regent of Demak Regency. Keywords: Power Utilization, Village Officials, Demak Regency.  Abstrak  Penelitian ini bertujuan untuk mengtahui bagaimana implikasi penyalagunaan Wewenang Administrasi Dalam Seleksi Perangkat Desa di Kabupaten Demak. Penelitian merupakan kajian ringkas berdasarkan pada kasus yang dikonsultasikan pada Badan Konsultasi Hukum, Fakultas Hukum Universitas Diponegoro. Hasil Penelitian Menujukan bahwa penyalagunaan wewenang terjadi pada proses seleksi perangkat desa di Kabupaten Demak. Kewenangan untuk menetapkan panitian seleksi perangkat desa merupakan kewenangan dari Kepala Desa sebagaimana amanat Peraturan Perundang – Undangan tentang Desa, dan bukan berada pada kewenangan Bupati Kabupaten Demak. Kata Kunci: Penyalagunaan Wewenang, Perangkat Desa, Kabupaten Demak.

Abstract

Abstract This study aims to determine the urgency of using legal analysis instruments in the formation of government policies within the Cabinet Secretariat Republic of Indonesia. This research was analyzed by using a qualitative analysis method that uses a comparative approach. The results showed that the use of legal analysis instruments in the formation of government policies within the cabinet secretariat is very important given the strategic role of the cabbage secretariat as an institution whose function is to provide approval to the Minister of State Secretary for requests for permission to draft legislation and on the substance of the draft regulations legislation. Keywords: Legal Analysis, Policy, Cabinet Secretariat, Over Regulation .Abstrak Penelitian ini bertujuan untuk mengetahui urgensi penggunaan instrumen analisis hukum dalam pembentukan kebijakan pemerintah di lingkungan Sekretariat Kabinet. Penelitian ini dianalisis dengan menggunakan metode analisis kualitatif yang menggunakan pendekatan perbandingan konsep (comparative approach). Hasil penelitian menunjukkan bahwa penggunaan instrumen analisis hukum dalam pembentukan kebijakan pemerintah di lingkungan sekretariat kabinet sangat penting dilakukan mengingat peran strategis sekretariat kabinet sebagai lembaga yang berfungsi untuk memberikan persetujuan kepada Menteri Sekretaris Negara atas permohonan izin prakarsa penyusunan rancangan peraturan perundang-undangan dan atas substansi rancangan peraturan perundang-undangan. Kata Kunci: Analisis Hukum, Kebijakan, Sekretariat Kabinet, Over Regulasi

Abstract

The use of foreign workers in Indonesia is increasingly in demand by companies. The Ministry of Manpower of the Republic of Indonesia (Kemnaker) noted that throughout 2016 there were 74,183 TKA in Indonesia). The Foreign Workers are to meet the needs, skilled and professional workforce in specific fields that cannot yet be filled by workers, Indonesia and to encourage the transfer of knowledge and technology. With the normative juridical case approach method, this study conducted to analyze how legal certainty and justice related to regulation. The 1945 Constitution of the Republic of Indonesia states that every citizen has the right to work and a decent life. Consequently, citizens have the right to receive compensation and fair treatment in employment relations and the state has the constitutional responsibility to guarantee the fulfilment of the right to work (TKI) and Foreign Workers (TKA) to create legal certainty and legal protection between them.Keywords : Legal Protection, Foreign workers, Principle of Certainty and Justice. AbstrakPenggunaan tenaga kerja asing di Indonesia semakin banyak diminati oleh perusahaan. Kementerian Ketenagakerjaan Republik Indonesia (Kemnaker) mencatat bahwa sepanjang tahun 2016 terdapat 74.183 TKA di Indonesia. Tenaga Kerja Asing tersebut adalah untuk   memenuhi kebutuhan, tenaga kerja yang terampil dan professional di bidang tertentu yang belum dapat diisi oleh tenaga kerja, Indonesia serta mendorong alih ilmu dan teknologi. Dengan metode pendekatan kasus yang bersifat yuridis normative, penelitian ini dilakukan untuk menganalisis tentang bagaimana kepastian dan keadilan hukum terkait regulasi. Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyebutkan bahwa setiap warga negara berhak atas pekerjaan dan hidup yang layak. Konsekuensinya, warga negara berhak untuk mendapat imbalan dan perlakuan yang adil dalam hubungan kerja dan negara memiliki tanggung jawab konstitusional untuk menjamin terpenuhinya keseimbangan hak atas pekerjaan Tenaga Kerja (TKI) dan Tenaga Kerja Asing (TKA) guna tercipta perlindungan kepastian dan keadilan hukum di antara keduanya.Kata Kunci : Perlindungan Hukum, Tenaga Kerja Asing, Asas Kepastian dan Keadilan.
