Abstract

Abstrak:  Penelitian ini difokuskan mencermati isu hukum dan politik pada Undang-Undang (UU)  Nomor 23 Tahun 2011 tentang Pengelolaan Zakat, terutama relasi zakat dan pajak sebagai pemenuhan amanat konstitusi Pasal 29 jo Pasal 34 ayat (1)  UUD 1945. Eksistensinya  menunjukkan  negara  bangsa menghadirkan aktualisasi hukum agama di ruang publik, yang pelaksanaannya bersinggungan dengan aspek politik dan ekonomi, tetapi dipahami cukup efektif dan efisien untuk membantu pencapaian tujuan negara. Penelitian ini merupakan penelitian hukum doktrinal  dengan pendekatan perundang-undangan, filsafat hukum dan politik. Bahan kepustakaan, baik berupa bahan hukum primer, maupun  sekunder dijadikan sebagai tumpuan utama dalam  inventarisasi dokumen. Bahan hukum yang terkumpul,  melalui prosedur berpikir deduktif dianalisis dengan menggunakan teori negara hukum, politik hukum, dan keadilan.Temuan penelitian menunjukkan bahwa politik hukum negara dalam menata relasi pengelolaan zakat dan pajak, dengan memperkuat kewenangan negara  sebagai ‘amil (kelembagaan) zakat, dalam peran sertanya  sebagai regulator sekaligus operator pada pengelolaan dana zakat, karena keterlibatan negara menjanjikan cukup manfaat (keuntungan) untuk kepentingan  politik,  sosial-ekonomi  kenegaraan dalam pemenuhan Pasal 34 ayat (1) UUD 1945Keywords: politik hukum, pengelolaan zakat, zakat di Indonesia, relasi zakat dan pajak, filantropi Islam  Abstract:  The focus of this research is on examining legal and political issues in Law Number 23 Year 2011 concerning Zakat Management, mostly on the relationship between zakat and tax as a requirement of the constitutional mandate on article 29 and Article 34 paragraph (1) of the 1945 Constitutional. The results show the state of nation provided actualization of religious law in the public space, which implementation contradicted to political and economic aspects. However, it is effective and efficient enough to help in gaining its objectives. This research method is doctrinal with the legislation, legal philosophy and politics were used as the approach. Data collection through library research conducted by the study of documents on primary and  secondary made as main focus in documents inventarization. The legal material collected data, then deductively analyzed, using theories of the rule of law, legal politic, and justice. The political law of a country manages the relationship between zakat and tax management by strengthening the country’s authority as 'amil (institutional) of zakat, in its role as a regulator and operator of zakat fund management, because the country involvement provided sufficient benefits for politics, socio-economic of the country to fill the requirements in Article 34 paragraph (1) of the 1945 Constitution. Keywords: political law; zakat management; zakat in Indonesia; relationship of zakat and tax; Islamic philanthropy

Abstract

Abstract:Divorce in Indonesia, legally positive, must be carried out before a panel of judges at trial in accordance with the mandate of Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law. However, out-of-court divorce is still common in several areas including Babelan district Bekasi where some of the community still practice out-of-court divorce. Out-of-court divorce even though it is considered religiously valid, leaves various legal issues such as neglect of the rights of children and wives who are divorced to the legality of the divorce itself. This study aims to find models of out-of-court divorce that are conducted by the community. Besides that, the study of the consequences and legal efforts to overcome this phenomenon are very important to be analyzed. This research is classified as a normative-empirical juridical study using a statutory approach assisted by a sociological approach. The results showed that research outside the court was carried out by: (1) kinship, and (2) through amil. From a positive legal perspective, divorce outside the court does not have a strong legal position, resulting in neglect of the right to support, distribution of assets and subsequent marriage.Keywords:divorce, Religious Court, legal consequences Abstrak:Perceraian di Indonesia secara hukum positif harus dilakukan dihadapan majelis hakim di persidangan sesuai dengan amanat Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan dan Kompilasi Hukum Islam. Namun demikian, perceraian di luar pengadilan masih banyak ditemui di beberapa daerah termasuk di kecamatan Babelan Bekasi dimana sebagian masyarakatnya masih mempraktikkan perceraian di luar pengadilan. Perceraian di luar pengadilan meskipun dianggap sah secara agama, tetapi menyisakan berbagai persoalan hukum seperti pengabaian hak anak dan istri yang diceraikan hingga legalitas perceraian itu sendiri.Penelitian ini bertujuan untuk menemukan model-model perceraian di luar pengadilan yang dilakukan masyarakat. Disamping itu, kajian tentang akibat serta upaya hukum menanggulangi fenomena tersebut menjadi sangat penting untuk dianalisis. Penelitian ini tergolong penelitian yuridis normative-empiris dengan menggunakan pendekatan perundang-undangan dibantu dengan pendekatan sosiologis. Hasil penelitian menunjukkan bahwa penelitian di luar pengadilan dilakukan dengan cara: (1) secara kekeluargaan, dan (2) melalui amil. Dalam perspektif hukum positif, perceraian di luar pengadilan tidak memiliki kedudukan hukum yang kuat sehingga berakibat kepada pengabaian terhadap hak nafkah, pembagian harta serta pernikahan selanjutnya.Kata Kunci: akibat hukum, luar pengadilan, perceraian, Pengadilan Agama

Abstract

AbstractThere is a dilemma in implementing social distancing as a government policy program to stay at home. For this, the author analyzed the police law perspective, especially the role of the National Police in overcoming the problems during the enactment of government regulations. The study was conducted using primary and secondary data. Primary data obtained through observation and interview, while secondary data obtained through library research. The data was then analyzed qualitatively and presented descriptively. From the results, it was concluded that the impact of the Covid-19 outbreak in the area of West Kalimantan Province was relatively safe and well-controlled which was indicated by no extraordinary crimes there. Polices had carried out their duties in all aspects both in maintaining security and public, law enforcement, protection, guard, and community services.Keywords: Social and Security Impacts; Police Law Perspective; Main Duties of Police. AbstrakAda dilema dalam pelaksanaan social distancing sebagai program kebijakan pemerintah untuk berdiam di rumah saja. Dalam menyikapi dilema tersebut, penulis menganalisis dalam perspektif hukum kepolisian. yaitu peran Polri dalam mengatasi permasalahan selama diberlakukannya peraturan pemerintah. Kajian dilakukan dengan menggunakan data primer dan data sekunder. Data primer didapatkan melalui pengamatan (observasi) dan wawancara di lapangan, sedangkan data sekunder didapatkan melalu penelitian kepustakaan. Data tersebut selanjutnya dianalisis secara kualitatif dan disajikan secara deskriptif. Dari hasil pembahasan disimpulkan bahwa dampak wabah Covid-19 di wilayah Provinsi Kalimantan Barat relatif aman dan terkendali dengan baik yang ditandai dengan tidak ada kejahatan luar biasa. Polri telah melakukan tugasnya dalam segala aspek baik dalam aspek pemeliharaan keamanan dan ketertiban masyarakat, dalam aspek penegakkan hukum, dan dalam aspek perlindungan, pengayoman dan pelayanan kepada masyarakat.Kata Kunci: Dampak Sosial dan Keamanan; Perspektif Hukum Kepolisian; Tugas Pokok Kepolisian

Abstract

The Regional government which carried out based on the principle of autonomy as wide as possible implies that the regions are given the authority to regulate and manage all their own affairs. So, this study tried to conduct a study of normative law to further examine the nature of the implementation of regional autonomy, and the second tried to analyze the role of regional regulations in order to support the implementation of regional autonomy through library research using the statute approach and conceptual approach. The results of the study indicated that one of the important ideals and rationalities for implementing regional autonomy was to make the policy process closer to the society, not only in the central government. For this reason, authority needs to be given so that local governments can take their own initiative to make decisions regarding the interests of the local community through laws at the local government level. Thus, the contents of the Regional Regulations are to accommodate the interests of the people in the regions in order to achieve happiness and prosperity that is distributed equally to the people in the area.Pemerintah daerah dilaksanakan berdasarkan prinsip otonomi yaitu memberi dan melaksanakan rumah tangga itu sendiri. Untuk alasan ini, penelitian ini adalah studi hukum normatif untuk memeriksa lebih lanjut tentang pelaksanaan otonomi daerah dan pendekatan lain yang dapat dianalisis dengan menggunakan pendekatan perpustakaan menggunakan pendekatan Statuta dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa salah satu cita-cita dan rasionalitas penting pelaksanaan otonomi daerah adalah membuat proses lebih dekat dengan masyarakat, tidak hanya di pemerintah pusat. Untuk alasan ini, perlu mengisi ruang sehingga pemerintah dapat mengambil inisiatif sendiri untuk membuat keputusan tentang lingkungan masyarakat melalui peraturan di tingkat pemerintah daerah. Ini adalah konten materi dari Peraturan Daerah pada dasarnya untuk mengakomodasi manfaat masyarakat di daerah dalam rangka mencapai kebahagiaan dan kemakmuran yang didistribusikan secara merata kepada orang-orang di daerah tersebut.(The regional government is carried out based on the principle of autonomy is giving and carrying out the household itself. Abstract

ABSTRAKPerkawinan hanya diizinkan jika pihak pria dan wanita sudah mencapai umur 19 tahun. Jika terjadi penyimpangan dari persyaratan usia perkawinan tersebut, maka perkawinan baru dapat dilangsungkan setelah mendapat dispensasi dari Pengadilan Agama. Dengan adanya peluang perkawinan anak di bawah umur yang diberikan oleh Undang-undang Nomor 16 tahun 2019 perubahan atas Undang-undang Nomor 1 tahun 1974 Tentag Perkawinan. Hal ini bertentangan dengan Undang-Undang Perlindungan Anak yaitu Pasal 26 Ayat (1) huruf c Undang-undang Nomor 35 tahun 2014 perubahan atas Undang-undang Nomor 23 tahun 2002 yaitu  orang tua berkewajiban dan bertangung jawab untuk mencegah terjadinya perkawinan pada usia anak-anak, namun pada kenyataanya dilapangan malah sebaliknya orang tua mendukung perkawinan pada usia dini. Permasalahan yang penulis angkat dalam tesis ini adalah: Bagaimana pengaturan hukum terhadap dispensasi kawin di Indonesia setelah putusan Makamah Konstitusi Nomor 22/PUU-XV/2017, Apakah faktor-faktor penyebab terjadinya permohonan dispensasi kawin terhadap perkawinan anak di bawah umur dan Bagaimanakah sikronisasi pengaturan usia kawin anak antara Undang-undang Perkawinan  dengan Undang-undang Perlindungan Anak.  Penulis melakukan penelitian dengan mengunakan metode penelitian yuridis Normatif, sedangkan sifat penelitianya adalah deskriptif. Data yang digunakan adalah data sekunder dengan sumbernya bahan hukum primer, sekunder dan tesier alat pengumpulan data dengan mengunakan studi kepustakaan. Berdasarkan hasil penelitian maka dapat disimpulkan bahwa: pengaturan usia kawin setelah putusan Mahkamah Konstitusi Nomor 22/PUU-XV/2017 adalah lahirnya Undang-undang Nomor 16 tahun 2019 yang menyatakan batas usia minimal untuk menikah baik pria maunpun wanita yaitu 19 tahun. Faktor-faktor penyebab terjadi nya permohonan dispensasi adalah sudah hamilnya seorang perempuan, faktor pendidikan, faktor pergaulan bebas, faktor Agama dan faktor kebiasaan masyarakat dan budaya. Sinkronisasi yang dipakai adalah sinkronisasi secara horizontal, bahwa Undang-undang Perkawinan dan Undang-undang perlindungan anak jelas bertentangan dengan adanya pengecualian untuk mengajukan dispensasi kawin.Kata Kunci : Dispensasi kawin; Perkawinan anak di bawah umur. ABSTRACTMarriage is only permitted if the man and woman have reached the age of 19. If there is a deviation from the age requirement of the marriage, then the new marriage can take place after receiving a dispensation from the Religious Court. With the opportunity for underage marriage provided by Law Number 16 of 2019, amendments to Law Number 1 of 1974 Concerning Marriage. This is contrary to the Child Protection Law, namely Article 26 Paragraph (1) letter c of Law Number 35 of 2014, amendments to Law Number 23 of 2002, namely that parents are obliged and responsible to prevent marriage at the age of children. However, in reality, in the field, the parents support marriage at an early age. The problems that the author raises in this thesis are: How are the legal arrangements for dispensation of marriage in Indonesia after the decision of the Constitutional Court Number 22 / PUU-XV / 2017, What are the factors causing the application for dispensation of marriage to child marriage under age and how is the synchronization of age regulation child marriage between the Marriage Law and the Child Protection Law. The author conducted research using Normative juridical research methods, while the nature of the research was descriptive. The data used are secondary data with primary, secondary and thesier legal materials as data collection tools using literature study. Based on the results of the research, it can be concluded that: setting the age of marriage after the Constitutional Court decision Number 22 / PUU-XV / 2017 is the birth of Law Number 16 of 2019 which states that the minimum age limit for marriage, both male and female, is 19 years. The factors causing the request for dispensation include the pregnancy of a woman, education, promiscuity, religious factors and social and cultural habits. The synchronization used is horizontal synchronization, that the Marriage Law and the Child Protection Law are clearly contrary to the existence of an exception to apply for dispensation of marriage. Keywords: Dispensation of marriage; marriage of minors.

Abstract

AbstractResearch on kerakatan and baparcayaan culture in diamond transactions through pengempit was motivated by the aim to describe the culture of kerakatan (solidarity) and baparcayaan (trust). They were not only ordinary activities but also cultures that had far more complex meaning than what was predicted. This research made cultural meaning could be understood and became a positive example for people. This research was categorized within the anthropology of Islamic law studies using a legal anthropological approach. The data in this study were obtained from in-depth interviews about the informants’ experiences. The findings of this study were the culture of kerakatan and baparcayaan in the transactions of diamonds through pengempit was a law in society. Those two cultures were the manifestation of Islamic law values in a concrete social space which motivated by the faith in Allah. The culture of kerakatan could be seen from the behavior of pengempit who helped each other in disasters, gave money to each other if the diamonds were sold, and gave information to each other about buyers and diamonds. The culture of baparcayaan could be seen from the behavior between diamond owners and pengempit who only made verbal not written agreements. Kerakatan and baparcayaan culture had religious, economic, and social meanings. Kerakatan and baparcayaan culture reflected a strong religious-shar'i for the economic and social life of the Banjar people.Keywords: culture, kerakatan, baparcayaan, diamond, pengempitAbstrakPenelitian terhadap budaya kerakatan dan baparcayaan dalam transaksi jual beli intan melalui pengempit ini dilatarbelakangi oleh keinginan untuk menggambarkan budaya kerakatan dan baparcayaan tersebut beserta maknanya karena aktivitas transaksi jual beli intan melalui pengempit ini bagi kebanyakan orang hanya merupakan aktivitas biasa. Akan tetapi sebenarnya ia merupakan budaya yang mempunyai makna jauh lebih kompleks dari pada yang diperkirakan bahkan oleh pemilik budaya sendiri, sehingga penelitian ini akan menjadikan makna budaya dapat dipahami dan dapat menjadi contoh positif bagi masyarakat lainnya. Penelitian ini adalah penelitian antropologi hukum Islam dengan pendekatan antropologi hukum. Data dalam penelitian ini diperoleh dari wawancara mendalam (indepht interview) mengenai pengalaman informan (individual’s life history). Temuan dalam penelitian ini menunjukkan bahwa budaya kerakatan dan baparcayaan yang terdapat dalam transaksi jual beli intan melalui pengempit adalah hukum yang hidup dalam masyarakat. Budaya tersebut merupakan pengejawantahan nilai-nilai hukum Islam dalam ruang sosial konkret dan dimotivasi oleh iman kepada Allah swt. Budaya kerakatan dapat dilihat dari perilaku sesama pengempit yang saling membantu bila terjadi musibah, saling memberi bila intannya laku terjual, dan saling memberi informasi mengenai pembeli dan mengenai intannya. Sedangkan budaya baparcayaan dapat dilihat dari perilaku antara pemilik intan dengan pengempit yang tidak membuat perjanjian tertulis tetapi hanya secara lisan saja. Budaya kerakatan dan baparcayaan  ini mempunyai makna religius, ekonomi, dan sosial. Budaya kerakatan dan baparcayaan ini merefleksikan platform religius-syar’i yang kuat bagi kehidupan ekonomi dan sosial masyarakat Banjar.Kata Kunci: budaya, kerakatan, baparcayaan, intan, pengempit

Abstract

Abstract: The problem of this research is the dual role of female officials (hereinafter referred to as “career women”) at Islamic universities in Kalimantan. The reasons for the research are (1) Knowing the constraints of the role played by career women at Islamic universities in Kalimantan in carrying out their obligations as housewives. (2) Revealing the role strategy of career women at Islamic universities in Kalimantan in carrying out household obligations from the Maqashid Syari'ah perspective. This research method is descriptive analytical with a normative approach. The results of the study are (1) The obstacles for career women in carrying out their obligations as housewives are not having enough productive time at home, feeling beyond their capabilities by playing multiple roles, and feeling tired. (2) The role strategy that is carried out to complete household obligations is carried out by adopting students, preparing household assistants, asking for help from family or other people, and cooperating with husbands. It can be concluded that in the perspective of Maqashid Syari'ah, the role strategy carried out by female officials in completing household obligations belongs to the Maqashid al-Hajiyyah level, namely the efforts made by career women to eliminate their difficulties in carrying out household obligations assigned to them to be the responsibility together in the family. Abstrak: permasalahan dalam penelitian ini adalah peran ganda yang dilakukan pejabat perempuan (selanjutnya disebut “wanita karir”) pada perguruan tinggi Islam di Kalimantan. Adapun alasan dari penelitian adalah (1) Mengetahui kendala peran yang dilakukan wanita karir pada perguruan tinggi Islam di Kalimantan dalam melaksanakan kewajibanya sebagai ibu rumah tangga. (2) Mengungkap Strategi peran yang dilakukan wanita karir pada perguruan tinggi Islam di Kalimantan dalam melaksanakan kewajiba dalam rumah tangga perspektif Maqashid Syari’ah. Metode yang digunakan dalam penelitian ini bersifat deskriptif analitis dengan pendekatan normatif. Hasil penelitian adalah (1) Kendala wanita karier dalam melaksanakan kewajibannya sebagi ibu rumah tangga adalah tidak memiliki waktu produktif yang cukup ketika dirumah, merasa diluar kemampuan dengan memerankan peran ganda, dan merasa kelelahan. (2) Strategi peran yang dilakukan untuk menyelesaikan kewajiban rumah tangga dilakukan dengan mengadopsi mahasiswa, menyiapkan asisten rumah tangga, meminta bantuan keluarga atau bantuan orang lain, dan bekerjasama dengan suami. Dalam perspektif Maqashid Syari’ah strategi peran yang dilakukan pejabat perempuan dalam menyelesaikan kewajiban rumah tangga tergolong pada tingkatan maqashid al-Hajiyyah yaitu upaya yang dilakukan wanita karir untuk menghilangkan kesulitannya dalam melaksanakan kewajiban rumah tangga yang dibebankan kepadanya untuk menjadi tanggungjawab bersama dalam keluarga.Kata Kunci: Peran ganda, wanita karir, maqashid as-Syari’ah

Abstract

The implementation of large-scale social restrictions in Indonesia to prevent the wider spread of the Covid-19 pandemic, ultimately has socio-economic impacts, which then on a household scale also has the potential to cause violence in it. Women are those who are vulnerable to becoming victims of violence, especially during this pandemic. This research aims to describe the efforts taken by the government in Indonesia in preventing potential violence against women during the Covid-19 pandemic. This research uses qualitative-descriptive-textual methods. The results of this research are, to overcome these socio-economic impacts, the government has taken efforts through social safety net programs. Furthermore, to prevent the potential for violence against women during this pandemic, the government took the effort by implementing the Protocol on the Handling of Cases of Violence Against Women in the Covid-19 Pandemic Period. The value of this research are, to explain that the government has special attention to ensure the availability of protection services for victims of violence against women during this pandemic. Furthermore, through this research, the researchers invite together to work together in support of the efforts taken by the government to minimize the socio-economic impact of the Covid-19 pandemic, so that it can be resolved immediately.

Abstract

Abstrak: Konstitusi sebagai dasar negara memberikan petunjuk bahwa bangsa Indonesia seluruhnya memiliki hak yang sama, lihat pada pasal 27 (1) UUD 1945, termasuk posisi perempuan dan laki-laki. Namun dominasi budaya partiarki memposisikan perempuan sebagai subaltern dari laki-laki. Bagi paradigma Feminisme Legal Theory hukum merupakan produk laki-laki, sehingga menjadi barometer produk hukum adalah laki-laki, seperti penentuan upah dalam UU ketenagakerjaan,  UU terkait Lingkungan dan UU tentang perkawinan. Belakangan ada peristiwa menarik yaitu ketika Mahkamah Konstitusi mengabulkan permohonan Judicial Review terkait batas minimal usia perkawinan, dimana di UU perkawinan sebelum revisi ada perbedaan usia anak yang relatif cukup jauh, 16 tahun perempuan dan 19 laki-laki. Setelah adanya Putusan MK No. 22/Puu-Xv/2017, kemudian Pemerintah merevisi UU Nomor 1 Tahun 1974 tentang perkawinan menjadi UU No. 16 Tahun 2019 Tentang Perubahan Atas UU 1 Tahun 1974 ini mengatur batas usia untuk melakukan pekawinan, khususnya usia perempuan minimal 19 tahun bisa melakukan perkawinan, sama dengan laki. Apakah ini menandakan politik hukum Indonesia mengarah pada paradigma teori hukum feminisme atau Feminist Legal Theory (FLT). Sebenarnya masih banyak norma dalam undang undang yang bias gender, termasuk dalam UU No. 16 Tahun 2019. Adapun pendekatan dalam penelitian ini menggunakan statute approach dan conseptual approach.Kata Kunci: Paradigma Feminisme Hukum; Hukum Perkawinan; Perempuan Abstract: The constitution as the basis of the state indicates that all Indonesians have the same rights, see Article 27 (1) of the 1945 Constitution, including the position of women and men. However, the domination of patriarchal culture places women as a subaltern of men. For the paradigm of Feminist Legal Theory, the law is a product of men, so that it becomes a barometer that legal products are men, such as determining wages in labor laws, laws related to the environment, and laws on marriage. Recently, there was an interesting incident when the Constitutional Court granted the Judicial Review request related to the minimum age of marriage, wherein the Marriage Law before the revision there was a relatively different minimum age for marriage between the couples, 16 years old for girls and 19 for boys. After the Constitutional Court Decision No. 22 / Puu-Xv / 2017, then the Government revised Law No. 1 of 1974 on marriage to become Law No. 16 of 2019 concerning Amendments to Law 1 of 1974 regulates the age limit for marriage, especially women who are at least 19 years old can marry, same as men. It may indicate that Indonesian legal politics leads to the paradigm of feminist legal theory or Feminist Legal Theory (FLT). Many legal norms are gender-biased, including in Law no. 16 of 2019. Abstract

Abstrak: Tujuan dari penelitian ini adalah untuk menganalisa status hukum dari ada nya disruptive innovation terhadap penerapan hukum persaingan usaha dan untuk menentukan arah kebijakan hukum persaingan usaha di Indonesia pada masa yang akan datang. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan konsep dan pendekatan Undang-Undang serta memanfaatkan data sekunder. Dewasa ini, permasalahan terkait penerapan hukum persaingan usaha mulai memuncak dikarenakan hadirnya disruptive innovation, inovasi yang merusak ini mampu merubah paradigma produsen dan konsumen terhadap aktivitas bisnis, yang mana terbiasa melakukan transaksi secara langsung atau tradisonal. Muncul nya teknologi modern akibat ada nya revolusi industri 4.0, mampu mengkombinasikan automisasi dan komputerisasi produk dengan internet, berdampak pada hadirnya inovasi-inovasi yang merusak produk pendahulu. Disruptive innovation memberikan kesempatan bagi produsen untuk menawarkan produk nya secara efisien dan tepat sasaran melalui online-based offerings untuk memfasilitasi konsumen dengan berbagai pilihan produk. Hasil penelitian ini menunjukan bahwa ada nya konsep disruptive innovation justru mampu merangsang sikap berkompetisi para produsen menjadi lebih intensif, dan bagi konsumen dapat memberikan kemudahan dalam menentukan pilihan produk berdasarkan kebutuhan dan kesanggupan secara ekonomi. Dalam hubungan nya dengan politik hukum Undang-Undang persaingan usaha, perlu diperhatikan bahwa hukum persaingan usaha seharusnya dirujuk sebagai social control dan social engineering untuk menciptakan pasar yang efisien dan efektif dengan menggunakan Pasal 33 UUD 1945 sebagai dasar menentukan arah kebijakan pasar.Kata Kunci: Hukum Persaingan Usaha; Inovasi yang Merusak; Politik Hukum Abstract: This research aims to analyze the legal status of disruptive innovation concerning the competition act and outline the policy direction of business competition regulations. In conducting this research, the author uses normative research methods by utilizing secondary data. In recent years, legal issues related to business competition have culminated in the presence of innovations that can change the paradigm of producers and consumers towards market activity habits, which are accustomed to conducting direct transactions. The emergence of modern technology has created a new, fourth industrial revolution that combines automation and computing with the internet of things. Disruptive innovation enables producers to offer their products and services efficiently and effectively through online-based offerings to provide consumers with various product choices to determine their needs efficiently and according to economic capacity. This paradigm shift must be balanced with regulations that can limit the legal corridors that have been adjusted to create prosperity for consumers and producers. It can be concluded that disruptive innovation has made the competition very intensive for consumers, making it easier for them to make choices according to economic capacity. In connection with the legal politics of business competition regulation, the law must be directed as a means of social control and social engineering to make business competition effective and efficient by still paying attention to Article 33 of the 1945 Constitution as the basis for market policy direction.
